SUMMARY OF AMENDMENT PROPOSAL
Proposal
Change the zoning of two contiguous properties from General Commercial (C-2)
to Multiple-Family Residential (R-3). The proposed change is consistent with the
properties’ existing Local Coastal Program and General Plan land use
designations of Residential High Density (RH). The amendment consists of two
applications, a zone change and local coastal program amendment (ZC 99-08 &
LCPA 00-01). It is also city-initiated and not a part of any development proposal.
Background
As described in the LCPA public notice of June 2000, initially this project
proposed the rezoning of three, not two, contiguous properties: A single property
owned by the Mitze H. Eubanks Trust at 3878 Carlsbad Boulevard (site of the
Seaside Bistro) and two properties owned by the Charles B. Ledgerwood Trust at
3862 Carlsbad Boulevard.
On January 3, 2001, the Planning Commission took action to recommend to the
City Council that: (1) Only the two lots owned by the Ledgerwood Trust be
rezoned from commercial to residential; (2) No change be made at this time to
the commercial zoning of the lot owned by the Eubanks Trust, and that a suitable
commercial zone for the lot be considered pending further study. On January 17,
the Planning Commission passed attached resolutions 4891, 4892, and 4893,
formally adopting its recommendations and an addendum to the project’s
environmental documentation to reflect that the proposed rezoning applied to just
the Ledgerwood Trust properties.
On March 6, 2001, the City Council considered the project. The public hearing
notice for the Council meeting described the project per the Planning
Commission recommendations. The Council approved attached Resolution
2001 -72 and Ordinance NS-577, adopting the Planning Commission’s actions.
Accordingly, as reflected in the adopted ordinance and resolution, this LCPA
application proposes to amend the zoning of only the two Ledgerwood Trust
properties.
Since the project originally proposed the rezoning of the Eubanks Trust property,
a great deal of information regarding it is enclosed. However, because the
Council approved only the rezoning of the Ledgerwood Trust properties, any land
use changes proposed in the future to the Eubanks Trust lot will require public
hearings and formal applications, including a LCPA.

1. AMENDMENT’S RELATIONSHIP TO AND AFFECT ON OTHER SECTIONS OF
THE PREVIOUSLY CERTIFIED LCP
The amendment will not affect other sections of the City’s certified LCP and
coastal resource policies and objectives. The amendment rezones two proper-
ties from commercial to residential, specifically to the City’s adopted R-3 and
Beach Area Overlay zones. These zones reference other sections of the LCP as
necessary to adequately guide property development and use.
2. ZONING MEASURES THAT WILL IMPLEMENT THE LCPA
The zoning measures that will implement the LCPA are the City’s adopted R-3
Zone and Beach Area Overlay Zone regulations. No new zoning measures are
necessary to implement the proposed LCPA.
3. AFFECT ON PUBLIC ACCESS
The properties are not located between the coast and first public road.
4. ANALYSIS OF POTENTIALLY SIGNIFICANT ADVERSE CUMULATIVE IM-
PACTS ON COASTAL RESOURCES
The two affected properties are developed with a home and a garden, located in
a largely built-out area, and contain no sensitive resources or public access. The
project will have no potentially significant adverse cumulative impacts on coastal
resources. A Negative Declaration was issued for the project.
5. SUMMARY OF MEASURES TO ENSURE BOTH PUBLIC AND AGENCY PAR-
TICIPATION
The LCPA was duly noticed for the required six-week review period beginning
June 29, 2000. No comments were received.
The Negative Declaration of environmental impact for the project was noticed
and circulated for its required 30-day review period beginning June 8, 2000. As
part of its required public review, the Negative Declaration was mailed to and cir-
culated by the State Clearinghouse. No comments were received.
The Planning Commission considered the project at a duly noticed public hearing
on January 3, 2001. This hearing was continued to January 17, 2001. The City
Council considered the project at a duly noticed public hearing on March 6, 2001.
The attached copies include letters received in response to the public hearing no-
tices and meetings. However, as the letters show, only one specifically regards
the two properties that are the subject of this LCPA.
