CA 921084402 (619) 767-2370 December 22,2003 k City of Carlsbad Eric Munoz 1635 Faraday Avenue Carlsbad, CAY 92008-73 14 Re: City of Carlsbad Local Coastal Program (LCP) Amendment #3-03 (Floodplain Regs/ Code Changes) Dear Mr. Munoz: The above-referenced LCP amendment was submitted to this office on December 8, 2003. Section 13553 of the California Code of Regulations states “[aln amendment to a certified LCP or LFZDP together with all necessary attachments and exhibits shall be deemed “submitted” after having been received and found by the executive director of the Commission to be in proper order and legally adequate to comply with Public Resources Code Section 305 1 O(b). Said review shall be completed within a reasonable time, but unless there are unusual circumstances, no later than ten (1 0) working days after the date it is received in the Commission offices during normal working hours [. . .I”. Staff has completed the initial review of the LCP amendment package within the 10 day time period and has identified several items that the Executive Director determines are necessary to complete the submittal pursuant to Section 13552 of the California Code of Regulations, and deem it suitable for filing. Please provide three copies of each of the following: 0 The six-week notice of availability for the floodplain regulations amendment; 0 Identify the land use plan (LUP) policies for all LCP segments that the proposed floodplain regulations are designed to implement. The Commission must find that the certified implementation program is adequate to carry out specific policies of the certified (LUP). If the certified LUP does not contain policies addressing floodplain development, a LUP amendment may also be necessary prior to the Executive Director filing complete the proposed amendment to the floodplain regulations. 0 Provide context for the proposed changes to the variance and density provisions of the certified LCP, Le., how they can be found consistent with existing land use plan policies and implementation plan standards.
