We respectfidly request a change in the Second Addendum to the Carlsbad ).IMP which you will be considering February 4, 2003. The proposed language will render development of our properly economically unfeasible and which we consider a taking. Enclosed please fkd the following: 1, The proposed change. 2. 3. 4. With the area in gma indicating a furthw rcduction of development from the hardline previously reviewed and approved by the City of Carlsbad, US, Fish and Wildlife Service and the California Dcparbnent of Fish and Oame. Delete 3-8.14 in its entirety and substitute the following "3-8.14 Assessor's Parcel No. 21 5-050-44,45,46,47 (Kevane) - Development shall be limited to that area shown as developable on figure 25, Kevane, of the December 1899 approved Habitat Management Plan for Natural Communities in the Crty of Carlsbad. No unmitigated impacts to coast oak woodland, riparian areas or wetlands and on the easterly two parcels within fifty feet of the coast oak woodland drip line except for necessary utilities and requirements of the City of Carlsbad for fire and safety reasons." Please note that fmure 25 has been modified to significantly Increase open space. 760 720 9461 P. 84/14 A * FEB-03-2883 11 : 21 C I TY OF CARLSBAD I KEVANUKRASNOW REASONS TO SUPPORT PROPOSED CHANGE TO SECOND ADDENDUM TO THE CARLSBAD HABITAT MANAGEMENT PLAN BASED ON COMMENTS Dated December 16,2002 FROM THE CALIFORNIA COASTAL COMMISSION AND INCLUDING MISCELLANEOUS REVISIONS C THE OAKS AT BATIQUITOS - CARLSBAD CALIFORNIA Over the past ten years we have been working with the City of Carlsbad, U.S. Department of Fish and Witdlife and the California Department of Fish and Game. Three years ago we came to a joint agreement with all three of these agencies to support our project as presently designed. All three agencies agreed to a hardline development plan and included this plan within the City's Habitat Management Plan (HMP) (see attached figure 25). The staff suggested language contained within Policy 3-8.14 would result in a taking of 75% of our property. Furlher, the requirement that the development be clustemd only on the western portion of the property results in a taking of two of the four lots. Property has been in Family ownership for over thirty years. Properly has been properly zoned (R-1) for the proposed development for over twenty years. Map and planning has been in process for over ten years and included hundreds, of meetings between ourselves, our biologists, our engineers and land planners, along with the City of Carlsbad Planning and Environmental personnel, and the Departments of Fish and Game and Fish 8t Wildlife personnel. This is not a project that was conceived yesterday, but rather a project that has evolved through a coliaborative effort of hundreds of experts. Development proposal is consistent with surrounding property and community. The property is located 2 % miles inland from the coast. The local jurisdiction and both wildlife agencies have agreed to the hardline set forth as figure 25, For the proposed development, the property does not require a zone change. 1 Open space per December, 1999 approved HMP Additional open space per Owner's proposal
