HomeMy WebLinkAboutLCPA 03-02; Second Dwelling Unit Ordinance; Local Coastal Program Amendment (LCPA) (6)* - c PUBLIC NOTICE TO INTERESTED PARTIES: Please be advised that the City of Carlsbad is considering text amendments to its Local Coastal Program (LCP) as summarized below. This amendment is being proposed by the City of Carlsbad and is currently under review. This notice hereby opens a six week review period after which the Planning Commission and City Council will consider all comments and act on the proposed amendment. The Planning Commission hearing is expected to take place in May, 2003 and will be duly noticed. The City Council hearing is expected to take place in June, 2003 and will be duly noticed. Copies of the LCP amendment are available for review at the following locations: (1) Carlsbad Planning Department, 1635 Faraday Avenue; (2) City Clerk’s Office, 1200 Carlsbad Village Drive; (3) Carlsbad Main Library, 1775 Dove Lane; (4) Georgina Cole Library, 1250 Carlsbad Village Drive; and (5) the California Coastal Commission, 7575 Metropolitan Drive, Suite 103, San Diego, CA 921 08-4402 PROPOSED LCP AMENDMENT SUMMARY LCPA 03-02 - SECOND DWELLING UNIT ORDINANCE AMENDMENT The City’s Zoning Ordinance (Title 21 of the City’s Municipal Code) currently allows second dwelling units to be developed within all single-family zones and multi-family zones (which are developed with single family residences) subject to the approval of a minor coastal permit and/or an administrative discretionary permit by the Planning Director. California Government Code Section 65852.2 pertaining to second dwelling units was recently amended to: 1. Allow second dwelling units proposed outside of the coastal zone to be considered (reviewed and approved) ministerially without discretionary review or a public hearing; and 2. Allow second dwelling units proposed within the coastal zone to be considered as minor coastal development permits but without a public hearing. Compliance with this revised State law necessitates amendments to the City’s Zoning Ordinance. The City’s Zoning Ordinance is the implementing ordinance for the City’s Local Coastal Program. Accordingly, this Local Coastal Program Amendment is necessary to ensure consistency between its proposed amended Zoning Ordinance and its Local Coastal Program.
