Dear Mr. Grim,
Thi s office received several i tems representing the above-descri bed request on
October 11, 1995.

However, most of the outstanding items are background or procedural materials which should be readily available from your files.

In addition, to again evidence compliance with the Act's public participation provisions, the submittal must include a copy

meeting minutes; public notice mailing lists and the Council report.
On more substantive issues, could you provide us with a clearer copy or a stri ke-out version of the proposed LCP amendment ("Exhibit YYY")? The xeroxed
copy is clear enough to read but it is not clear enough to determine what portions have been revised; it appears that amended sections may have been
highlighted in bold print but that highlighting is no longer discernable. The
submittal included a biological assessment on open space encroachments and a parking analysis. Given previous experience on the "give-back" and "take-away" revisions to open space areas, we will likely need additional

discussed with them were increasing concerns at this agency about timeshares
being a competing commercial use with more traditional vi si tor accommodations
and maintaining the availability of visitor facilities and recreational amenities for the general public. We would also appreciate getting the City's perspective on these issues. What provisions have been made, if any, on the
required phasing of the hotel resort or timeshare units? Has the City required any commitment on the construction, completion or availability of the
hotel accommodations relative to occupancy of any timeshare units? What provisions, if any, has the City accepted or specified on the availability of the resort units or facilities for the general public? With regard to the golf clubhouse or golf course operation, are there any exclusive operating or priority use provisions that have been approved by the City? Are there any other use or operating provisions for any of the resort, timeshare development, sports club or golf course facilities that the Commission should consider and evaluate? Because these i ssues have been generati ng increased discussion at the Commission itself, it would be beneficial if we considered these points as part of the Commission review and staff report.
Among the issues we
As soon as the outstanding items are received, we will reassess the submittal's suitability for filing. However, as we are aware of applicant's
desire for the December hearing, please let us know if there will be any problem in getting the identified materials or information to us by November 3, 1995. The planner who will be reviewing this item is Bill Ponder. Please
don't hesitate to call if you have any questions.
