Dear Deborah:
Thank you for considering the City's requested revisions to the suggested modifications as originally
drafted. It appears that we will be unable to come to an agreement concerning the application of
the agricultural lands conversion policy and that this will be left to the Coastal Commission to
resolve. The Coastal Staff memo to the Commissioners dated June 8, 1993 contains a new
suggested modification that the City also disagrees with. Suggested Modification number 9 requires
that all amendments, whether minor or major, be submitted to the California Coastal Commission
for their review and approval.
The reason for establishing the minor and major amendment process in Section M of the Carlsbad
Ranch Specific Plan was to establish parameters for administratively approving limited types of
changes associated with the preparation of final construction plans such as grading plans,
improvement plans, and final maps. The need to make the types of minor adjustments
contemplated in the minor amendment section provides for those changes related to final
engineering design. Accommodating these minor adjustments without the requirement for a LCPA
is appropriate. A Specific Plan and even a Tentative Tract Map while containing a great deal of
detail should be expected to require a minor degree of adjustment due to final engineering. To
require a LCPA places a significant burden on the project without providing additional benefit.
Your consideration of acceptance of the proposed minor amendment process whereby the Executive
Director would have the authority to administratively approve minor amendments as described in
the Carlsbad Ranch Specific Plan would be appreciated.
