AMENDMENTS (LCPA 93-02, LCPA 94-02 AND IXPA 95-01) !3EALIN\IG Dear Ms. Lee: Enclosed for review are three completed applications from the City of Carlsknb to ar-rierd it’s Local Coastal Program with respect to the addilion/mocEifi,7atio,.; o: i!olic.ins arid implementing zoning dealing with affordable housing. In October of 1991, the Carlsbad City Council approved a major amendment io it‘s Housing Element (GPA 90-08) to add new policies to encourage and enable the development of affordable housing within the City. As a consequence, of this major Housing Element amendment, the State Department of Housing and Community Development (HCD) formally certified the City’s Housing Element cn Mq‘ 26, 1992. Subsequent to the certification by the State, the Carlsbad City Council approved several affordable housing zone code amendments (ZCA’s) to implement the new iiodnsiriy Element policies. These zone code amendments include the following: i /ZCA 91-05 - Density Bonus Ordinance; J ZCA 91-06 - lnclusionary Housing Ordinance; v’ZCA 92-02 - Affordable Housing Site Development Plan Procedures and v‘ ZCA 92-04 - Second Dwelling Units; and wZCA 93-05 - Senior Citizen Housing. Standards Modifications (i.e.; Density increases); The Local Coastal Program Amendments proposed with this application will add affordable housing policies to the City’s six Local Coastal Program (LCP) segments and adopt the above noted companion zone code amendments a5 the impternenting zoning for the City’s LCP. This LCP amendment is necessary to ~~SLII’E? consistency between the City’s amended Housing Element, Zoning Ordinance and it’s LCP. This LCPA includes the addition of new policies dealing with lnclusionary Housing, Density Bonuses, Second Dwelling Units and Senior Housing to the City's six LCP segments and the adoption of two new City Ordinances (Inclusionary Housing and Density Bonus) and text amendments to other Sections of the City's Zoning Ordinance to allow Development Standards Modifications and Density Increases, as discussed below: HOUSING ELEMENT POLICIES The following affordable housing policies have been adopted as amendments to the City's Housing Element (GPA 90-08). INCLUSIONARY HOUSING POLICIES A minimum of 15% of all units approved within residential projects of 7 or more dwelling units shall be set aside and made affordable to lower income households. In those developments which are required to include 10 or more units affordable to lower income households, at least 10% of the lower income units should have 3 or more bedrooms. An in-lieu fee may meet the requirement to construct lower income housing for residential developments of less than 7 units. DENSITY BONUS POLICY The City shall offer the private sector economic incentives to encourage and enable the development of affordable housing. Accordingly, the City shall develop an ordinance that implements Government Code Sections 6591 5 and 6591 5.5 (State Density Bonus Law). SECOND DWELLING UNIT POLICY The City will examine it's existing Second Dwelling Unit ordinance to explore means of better encouraging and facilitating the development of affordable second dwelling units. SENIOR HOUSING POLICY Amend the City's Senior Citizen Housing regulations to conform to State Density Bonus Law and establish standards for location, parking, safety, recreational facilities, medical care and other aspects of senior housing. INCLUSIONARY HOUSING ORDINANCE The lnclusionary Housing Ordinance establishes requirements for the reservation and affordability of housing units for lower-income households in residential developments. The ordinance establishes the following mandates: 1. Not less than 15% of all residential units within any residential project shall be set aside for occupancy by and be affordable to lower-income households. 2. For those developments which are required to provide 10 or more units affordable to lower-income households, at least 10% of the lower-income units shall have 3 or more bedrooms. 3. All inclusionary units shall be deed restricted to remain affordable to the designated income group for the useful life of the project or housing unit. DENSITY BONUS ORDINANCE The Density Bonus Ordinance implements State Density Bonus Law (State Government Code Sections 65915 and 65915.5). The ordinance mandates that the City grant a minimum 25% residential density bonus and an additional economic incentive (Le.; (a) the modification of site development standards, (b) approval of mixed use zoning, (c) an additional density bonus above the minimum 25% or (d) other regulatory concessions which result in identifiable cost reductions), in return for a developer reserving a certain percentage of the dwelling units of a project as affordable (either; 10% for very low income households, or 20% for low-income households or 50% for senior households). AFFORDABLE HOUSING SITE DEVELOPMENT PLAN PROCEDURES This Zone Code Amendment : 1) requires all affordable housing projects to be processed through a Site Development Plan application, and 2) amends the development standards provisions to enable the City to approve modified (less restrictive) development standards (i.e.; density increases) for affordable housing projects. -. ATTACHMENT "C" 3. AMENDMENTS RELATIONSHIP TO AND EFFECT ON OTHER SECTIONS OF THE PREVIOUSLY CERTIFIED LCP This proposed amendment will: (1) require that all future residential development within the City comply with the City's lnclusionary Housing mandate (15% of the total units of all residential developments to be reserved and affordable to low- income households), (2) enable the City to grant density bonuses and other economic incentives in return for affordable housing units being created, and (3) allow the City to grant development standards modifications to enable the achievement of affordable housing (i.e.; 2nd Dwelling Units and Senior Housing). However, in that all affordable housing and 2nd dwelling unit and senior projects, processed pursuant to these amended regulations, shall be required to be consistent with all applicable development standards, policies, and provisions of Carlsbad's LCP segments, this proposed Local Coastal Program Amendment (LCPA) is not expected to impact other sections of Carlsbad's Certified LCP. 4. ZONING MEASURES THAT WILL IMPLEMENT THE LCPA Five Zone Code Amendments, which are the implementing ordinances for this LCPA, were approved by the Carlsbad City Council as follows: 1. 2. 3. 4. 5. ZCA 91 -06 - lnclusionary Housing - May 21, 1993; ZCA 91 -05 - Density Bonus - May 21, 1993; ZCA 92-02 - Affordable Housing Site Development Plan Procedures - July 21, 1992; ZCA 92-04 - Second Dwelling Units - June 14, 1994, (LCPA 94-02 approved 2/14/95); and ZCA 93-05 - Senior Citizen Housing - April 26, 1994 (LCPA 94-02 approved 2/14/95). 5. AFFECT ON PUBLIC ACCESS This proposed LCPA is not affiliated with any specific development project and therefore will not directly affect public access to and from the coast. Any future affordable housing project, processed pursuant to these amended regulations and provisions, shall be required to address and adequately mitigate any project related parking, traffic and coastal access impacts. 6. ANALYSIS OF POTENTIALLY SIGNIFICANT ADVERSE CUMULATIVE IMPACTS ON COASTAL RESOURCES This proposed LCPA is not anticipated to result in significant adverse cumulative impacts on coastal resources. Any affordable housing project, processed pursuant to these amended regulations, shall be required to comply with all applicable LCP development standards, policies and provisions, especially those dealing with the protection and/or preservation of coastal resources. Potential environmental impacts associated with the development of affordable housing within the Coastal Zone, pursuant to the amended regulations, include: soil erosion, drainage, landform alteration, geotechnical, visual quality, parking, traffic, and biological. These potential impacts shall be required to be adequately mitigated, consistent with the California Environmental Quality Act. 8.
