Pursuant to Section 13553 of the Commission's Code of Regulations, the Executive Director has reviewed the transmittal and determined it is not in proper order or legally adequate to comply with the requirements of Public Resources Code Section 30510(b). Therefore, as of this date, this item is not deemed to be properly submitted. Most of the outstanding items are background or procedural materials which should be readi ly available from your fi les. Pursuant to your request to process this amendment with the Aviara Four Seasons Resort LCPA already submitted to this office, we would need the identified materials to be submitted here no later than next Thursday, November 9th. If the materials are received by then, we will reassess whether or not this amendment can be "batched" with the Aviara Resort amendment. To demonstrate compliance with the public participation requirements of the Coastal Act and to provide us with the names/addresses of the parties we must notify for the Commission hearings, the submittal must include copies of all the speakers' slips and any written correspondence on these items that have been generated at the local hearings. received at the local hearings initially on the minor master plan amendments or the more recent LCPA action at the Planning Commission or City Council need to be forwarded to us. The submittal does include the minutes from the 8/16/95 Planning Commission meeting; but, we still need to receive the City Council minutes for the 10/17/95 hearing. This means that any public comments Relative to the exhibits and relevant amendment documents, the submittal does not appear to include Exhibit "A", dated January 4, 1995, for the Planning Area 28/MP 177(J) revisions and there did not appear to be any exhibits or draft amendment document for the Planning Area 15/MP 177(M) revisions. Could you please forward those materials to us? Based on the submittal, the draft amendments we did receive appear to be revised exhibits and excerpts from the Eric Munoz November 1, 1995 Page 2 Aviara Master Plan itself (ie. revised pages). sections were apparently highlighted in bold print in the original documents. However, after xeroxing, it is uncertain which sections have been revised and the highlighting is no longer clearly discernable. In particular, was there any sightline analysis completed on Planning Area 28 from areas along the lagoon or from Interstate 5 and La Costa Avenue? to us. If so, please provide them Lastly, it had been our understanding that this LCP amendment was going to have included all trail alignment amendments for the Aviara Master Plan. In particular, we were expecting realignment amendments for the trails in Planning Areas 25, 26 North, 26 South and 27 to be submitted. What is the status of those revisions at the local level? It would seem to make sense to us to process an amendment on the trai 1 system overall, incorporating a1 1 the proposed revisions to date, at one time. In addition, based on various meetings with City staff and subsequently with Aviara representatives, we have received conflicting direction as to whether or not any of the community trails and the golf course trail, in particular, are part of the city-wide public trail plan and system. trails within the citywide public trail system. Furthermore, there needs to be clarification as to when trail improvements are required to be made and by whom within the Aviara master planning area. We would appreciate getting the City's responses on these trail issues in writing.
