HomeMy WebLinkAboutLCPA 95-06; Appellate Procedures; Local Coastal Program Amendment (LCPA) (5)!C 'I 1'3 PUBLIC NOTICE TO INTERESTED PARTIES: Please be advised that the City of Carlsbad is considering text amendments to the Local Coastal Program which will take the form of a zone code amendment as summarized below. This amendment is being proposed by the City of Carlsbad and is presently under review. This notice hereby opens a six week review period after which the Planing Commission and City Council ill consider all comments and act on the proposed amendment. The Planning Commission is expected to take place in October 1995 and will be duly noticed. The Cdy Council Hearing is expected to take place in November and will be duly noticed. Copies of the proposed LCP amendment are available for review at the Planning Department, 2075 Las Palmas Drive, Carlsbad, CA 92009. PROPOSED LCP AMENDMENT SUMMARY ZONE CODE AMENDMENT - LCPA 95-06 - APPELLATE PROCEDURES The City's Zoning Ordinance is the implementing ordinance for the City's Local Coastal Program. Accordingly, this Local Coastal Program Amendment is necessary to ensure consistency between it's proposed amended Zoning Ordinance and it's Local Coastal Program. The specific Zone Code Amendment is as follows: An amendment to various chapters of the City's Zoning Ordinance rile 21) to: (1) incorporate provisions to allow individual members of the City Council to appeal planning decisions of the Planning Commission, Design Review Board or the Planning Director to the full City Council by filing the same written appeal procedures required of other appellants, (2) adds new requirements that the written appeal include the stated reasons for the appeal so as to provide a focus for the decisionmakers' consideration, and (3) assigns the burden of proof to the appellant with regard to the presentation of evidence that the decision of the Planning Commission, Design Review Board or Planning Director is in error.
