HomeMy WebLinkAboutLCPA 95-12; Accessory Structure Regulation; Local Coastal Program Amendment (LCPA) (2)April 3, 1996 Deborah Lee California Coastal Commission 3111 Camino Del Rio North, Suite 200 San Diego, CA 92108-1725 SUBJECT: APPLICATION FOR A LOCAL COASTAL PROGRAM AMENDMENT LCPA 95-12 - ACCESSORY STRUCTURES HEIGHT LIMITATION Dear Deborah: Enclosed is the City of Carlsbad’s completed application to amend its Local Coastal Program for all City- wide segments to allow for the implementation of a Citywide zone code amendment which will restrict the height limit of all residential accessory structures to 14 feet/one story. This would be more restrictive than existing City regulations which limit accessory structures to 14 feet/one story within setback areas (in addition to other restrictive development standards) and 30 feetltwo stories within the buildable area of a lot. LCPA 95-12 (and ZCA 95-04) would limit accessory structures within residential zones to the one story height limitation regardless of setback area or buildable area on a given lot. This amendment to the LCP is proposed to maintain consistency between the City’s General Plan, zoning ordinance and LCP/coastal regulations. The City Council approved the accessory structures height limitation zone code amendment and local coastal program on April 2, 1996. The support documentation specified on the application checklist is enclosed. AMENDMENT’S RELATIONSHIP TO AND EFFECT ON OTHER SECTIONS OF THE PR EVI 0 USLY C ERTl FI ED LCP The proposed LCP Amendment will reflect changes to the City’s Zoning Ordinance, the implementing ordinance for the coastal zone properties in the City, which will restrict all residential accessory structures to a one story/l4 foot height limitation. The effect on other sections of the City’s Zoning Ordinance and coastal resource policies and objectives will be non-existentlinsignificant. ZONING MEASURES THAT WILL IMPLEMENT THE LCPA The LCPA will be implemented via the proposed development standards for residential accessory structures to be incorporated into the development standards for the following zones: RA, Ri, R2, R3, RP, RT, RW and RDM. ANALYSIS OF POTENTIALLY SIGNIFICANT ADVERSE CUMULATIVE IMPACTS ON COASTAL RESOURCES No specific development proposals are associated with this request. Most accessory structure development requests are categorically exempt from environmental review and area ministerial, building permit items. This LCPA will not create any potentially significant adverse cumulative impacts on coastal resources SUMMARY OF MEASURES TO ENSURE BOTH PUBLIC AND AGENCY PARTICI PATlON The proposed LCP amendment (LCPA 95-12) was concurrently processed with a zone code amendment (ZCA 95-04). The entire package underwent the City’s prior compliance process for environmental review based on previously approved accessory structure regulations (1 993) affecting residential zones Citywide. This process includes a public review and comment period. No written comments were received. The LCP amendment itself underwent the standard 6 week public review and comment period from September 7 to October 19, 1995. No comments were received.
