The grading shown on plans by Project Design Consultants (Drawing
No. 377-A, CT-97-16) is acceptable to the Recreation Department as
it concerns the encroachment on the City's park land, with the
following conditions.
1. Prior to issuance of a Grading Permit, the owner of Lot 107 of the
"Kelly Core" area, shall submit a Letter of Agreement, to be signed by
the owner of Lot 107 and the City, agreeing to dedicate in fee, Lot
107. This dedication shall exclude "constrained land" as shown on an
Exhibit prepared by Planning Systems (7/22/99) by Eric Johnston. The
dedication shall be no less than -9 acres.
2. Prior to receiving a City of Carlsbad Building Permit, the dedicate
the said land to the City of Carlsbad in fee shall be fully executed.
