We believe the above stated regulation gives staff the authority to request this information and that thir infodon is necessary in order to find the LCP package is ''in proper order and legally adequate to comply with Public Resources Code Swlion 3051O(b)" . That rection of the statute states: Conahtent with this chapter. a propowl local coastal prom may be submittal to thc cornmimion, if both of the following arc, met: (a) It is submitted pursuant to a resolution adopted by the local govexnment, der public hewing that certifies the local coastal program ir intended to be carried out in a manner fully in conformity with this division. The submittal involves an amendment to the LCP Implementation Plan and has been classified a major amendment. Aa a major amendment, the Coastal Commission has 60 days to review an implementdon plan modincation, Thcrefome, upon rtceipt of the rtqucstcd information and completion of the subdttal, we wU1 schedule tbe UP amendment for the appropriate Commission agenda. Due to workload constraints and the fact that Commission stuff ia currently working on Carlsbad L€PA m99D Kelly Ranch, we anticipate it will be difRcult to pto#sr the entirc submittal withfn thc required time period; themfore, a time exteasion may be neccrrary. Phe let up know If them is any order of priority for which pardom of the submittal should be prclcessed first, and/or If the City Is intenstad in wgmenting the submittal in any way.
