Date of Meeting: Place of Meeting: April 7, 1999 CITY COUNCIL CHAMBERS CALL TO ORDER: Planning Commission Chairperson Heineman called the Regular Meeting to order at 6:Ol p.m. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Commissioner Compas. ROLL CALL: Present: Chairperson Heineman, Commissioners Compas, ~ L'Heureux, Savary, Segall Absent: N ielsen, Welshons Staff Present: Gary Wayne, Assistant Planning Director Rich Rudolf, Assistant City Attorney Bobbie Hoder, Senior Management Analyst Bob Wojcik, Principal Civil Engineer Don Neu, Senior Planner Van Lynch, Assistant Planner Anne Hysong, Associate Planner Christer Westman, Associate Planner APPROVAL OF MINUTES: ACTION: Motion by Commissioner Compas, and duly seconded, to approve the Minutes of the Regular Meeting of March 17, 1999, as presented. VOTE: 4-0-1 AYES: Heineman, Compas, L'Heureux, Savary NOES: None ABSTAIN: Segall Chairperson Heineman reviewed the procedures that would be followed for this evening's public hearing. COMMENTS FROM THE AUDIENCE ON ITEMS NOT LISTED ON THE AGENDA: PUBLIC HEARING: TAKEN OUT OF ORDER: 10. ZCA 99-011LCPA 99-01 - INCIDENTAL OUTDOOR DINING AREAS II - Request for approval of a Negative Declaration, Zone Code Amendment and a Local Coastal Program Amendment to modify Chapters 21.04,21.26, 21.27,21.28, 21.29,21.30,21.32, and 21.34 of the Municipal Code to allow Incidental Outdoor Dining Areas associated with restaurants on private property citywide outside of the Redevelopment Area. Assistant Planning Director, Gary Wayne introduced the item and stated that staff (the applicant) has requested a continuance to April 21, 1999. Chairperson Heineman asked if there was anyone in the audience who cannot return on April 21, 1999, MINUTES 1 \ L PLANNING COMMISSION - April 7, 1999 Page 2 and wished to be heard at this meeting. Seeing no one wishing to testify, Chairperson Heineman called for a motion. ACTION: Motion by Commissioner Compas, and duly seconded, to continue this item to April 21,1999. VOTE: 5-0 AYES: NOES: None ABSTAIN: None Heineman, Compas, L'Heureux, Savary, Segall Assistant Planning Director, Gary Wayne, stated that items #3, #4, #5, and ##6 would normally be heard in a Public Hearing context. However, Mr. Wayne continued, staff feels that there are no issues'with any of these requests and therefore, staff is recommending approval of each. Mr. Wayne also announced that the Commission's action on items #3, #4, and #5 is final unless it is appealed to the City Council within ten calendar days. However, the Commission's action on Item #6 is not final and will be forwarded to City Council for it's consideration. Chairperson Heineman asked if there was anyone in the audience wishing to testify on any of these items. Seeing no one wishing to testify, Chairperson Heineman called for motions on each item. 3. CDP 98-80 COURY RESIDENCE - Request for approval of a Coastal Development Permit to allow for the demolition of and the subsequent construction of a single family residence within the Coastal Zone, located at 5136 Shore Drive within Local Facilities Management Zone 3. ACTION: Motion by Commissioner Compas, and duly seconded, to adopt Planning Commission Resolution No. 4525, approving Coastal Development Permit CDP 98-80, based upon the findings and subject to the conditions contained therein. VOTE: 5-0 AYES: NOES: None ABSTAIN: None Heineman, Compas, L'Heureux, Savary, Segall 4. CDP 98-67IHDP 98-14 - GILSON RESIDENCE - Request for approval of a Negative Declaration, Coastal Development Permit and Hillside Development Permit to allow for the construction of a single family residence with detached garage within the City's Coastal Zone, located on the west side of Holly Brea Lane, south of Alder Avenue within Local Facilities Management Zone 1. ACTION: Motion by Commissioner Compas, and duly seconded, to adopt Planning Commission Resolution No. 451 1, approving the Negative Declaration , and Planning Commission Resolutions No. 451 3, and 4512, approving the Coastal Development Permit and Hillside Development Permit based upon the findings and subject to the conditions contained therein. VOTE: 5-0 AYES: NOES: None ABSTAIN: None Heineman, Compas, L'Heureux, Savary, Segall - 5. CUP 98-19/SUP 99-02 - ALGA ROAD - COX COMMUNICATIONS - Request for a Conditional Use Permit and Special Use Permit to allow the installation of a base transceiver station (enclosed equipment cabinets) located at-grade on the east side of an existing commercial building and the placement of a total of twelve (12) wall mounted antennas and a proposed architectural dormer element. The site is located at 6994 El Camino Real (West Bluff Plaza Shopping Center) in the C- 2Q Zone in Local Facilities Management Zone 6.
