SUBJECT: Request to Waive Time Limit for Carlsbad LCP Amendment No. 3-99B
for the Commission Meeting of December 7-10,1999
On October 6, 1999, the City of Carlsbad’s proposed Local Coastal Program Amendment
(LCPA) #3-99 was received in the San Diego District office. The amendment package
contains five separate LCPAs. A staff report has been prepared for the December, 1999
hearing for an amendment to the Carlsbad Ranch Specific Plan permitting a museum
open to the public with incidental retail sales (LCPA 3-99A). This implementation plan
amendment affects the Mello II segment.
The item for which a staff report and recommendation have not been prepared are the
proposed implementation plan amendments to the Mello 11 LCP regarding the Hadley and
Carnation zone changes and the proposed citywide changes to the certified municipal
code regarding Appellate Procedures and Incidental Outdoor Dining Areas (IODA).
Regarding the Hadley and Carnation properties, amendments to the Mello 11 zoning map
are proposed to change the zoning designations of the 14.7 and 10 acre properties from
Limited Control (L-C) to One Family Residential with a Qualified Development Overlay
Zone (R-1-7500-Q). Regarding the citywide Appellate Procedures and IODA
amendments, the former would revise provisions regarding appeals of planning and land
use matters and the latter would allow small incidental outdoor dining areas (IODA’s) of
limited size to be provided without parking. Pursuant to Section 305 12 of the Coastal
Act, the Commission must act on a zoning amendment within 60 days of complete
submittal. To be heard within the allotted time period, the amendment requests would
have to be agendized for the scheduled December 1999 hearing.
Section 30517 of the Coastal Act and Section 13535 of the Code of Regulations state,
however, that the Commission may for good cause extend a time limit for a period not to
exceed one year, after consultation with the local government and by a majority vote of
the Commissioners present. Commission staff is requesting the time extension due to
insufficient staff time to adequately review the preceding amendments and prepare a
recommendation. The City has indicated the item could be postponed until the January
2000 hearing in Santa Monica, provided the Commission grants the waiver of the
Summarv of Staff Recommendation. Staff recommends the Commission extend the 60-
day time limit for a period not to exceed one year. However, it is anticipated that the
amendment requests will be scheduled for the January 2000 hearing in Santa Monica.

I move that the Commission extend the 60-day time limit to Carlsbad LCP Amendment
No. 3-99B for a period not to exceed one year.
STAFF RECOMMENDATION:
Staff recommends a yEs vote. An affitive vote of the majority of the Commissioners
present is needed to pass the motion.
