Dear Mr. Munoz:
This letter k warding the March 16,2000 submittal of the City of Carlsbad’s first LCP
amendment package for the 2000 calendar y~ar, The package includes five eaparate actions taken by the City to amend the City’s Zoning ordinance and LCP Implementation
Plan. Sdon 13553 of the Califonria Code of Regulations 8- “[a]n amcndmtnt to a certified LCP or LRDP together with all necessary attachments and exhibits shall be
deemed “submitted” after having been received and found by the exccutivt director of the Commission to be in pmpcr order and legally adequate to comply with Public Resoum Code Section 30510(b), Said review sball bo completed within a reasonable
time, but unless them are unusual circumetances, no later thaa ten (10) working days after
the date it is rcccivcd in the Commission offices during normal working horn [. . .]”,
As you arc awaret staff completed the initial nview of the LCP amendment package within the initial 10 day time period and through a letter dated 3/30/00 firom Bill Ponder,
this omce identified mvd items which the Executive Director determines are necessary to complete tha submittal and deem tt suitable for Ning. With your reqxmse letter dated
4/13/00, you included several of the requested item, but asked that wa identify the legal
authority for mpairing the biological suways, fb suppression plans and resource agency
approvals associated with the Manzanita, Roach and Steina rubmittals. Section 13552’
of the commissionto administrative mgulations titled or LRDp
states in applicable part:
The LCP or LRDP amurdmcnt submittal shall include: (a) ....
(b) All policies, plane, standards, objectives, diagrams, drawings, maps, photographs, and supplementary data, related to the mandment in suiflcient detail
to allow review for wnformity with the rquhmts of the Coastal Act. ....
(C). v. (d), . . (e) Any environmental review documwrts, pureunnt to -A, required for all or any poxtion of the amendment to the Ixlp 01 LRDP.. . ..

Staff has determined the requested infomation is necessary in order to determine the
adequacy of the proposed LCP Implementation Plan amendments to carry out thc policies of the cdficd Mello ll LCP land we plan. We believe the above stated regulation gives
staff the authority to requa this information and that thir infodon is necessary in
order to find the LCP packago is "in proper order and le8ally adequate to comply with Public Resources Code Swllon 30510(b)" . That sectton of the statute States:
Consistent with this chapter, a proposed local coastal program may be submitted to thc commission, if both of the following are met
(a) It is submitted pursuant to a resolution adopted by the local government, after public hearing that ccrtifiett the local coastal program is intended to be carried out in
a manner fully in conformity with this division.
(b) It contains, in Bccordllllcc witb the guidelines establiohcd by the commission, materids suffuht far thorough and complete review.
The submittal involves an amendment to the Lcp Implementation Plan aud has been classified a major amendment. Att a major amendment, the Coastal Commission has 60
days to review an hplcmcntation plan modincation. Therefore, upon rcctipt of the
requested information and completion of the submittal, we will schedule the Lcp
amendment for the apprOpriate Commission agenda. Duo to workload constraints and the
fact that Commission staff ie cumntly working on Cnrlsbad LCPA m99D Kelly Ranch,
we anticipate it will bc difficult to proccsr the entirc submittal within tho required time
period: therefore, a time exteasion may be necsrrary. Plssse let ua know if there is any
order of priority for which portions of the subdttd ahould be pmccssed first, and/or if
the City is interested in segmenting the submittal in my way. At thia time the entire
submittal is considered incomplete and not yet filed for purposes of the 60-day time limit.
