SUMMARY OF AMENDMENT PROPOSAL Y/N, DATE Yes Yes No N/A No N/A The proposed local coastal program amendment, and corresponding zone code amendment, was initiated by the City so that future “basement” areas would be more submerged relative to adjacent grade. The current “basement” definition requires that more of the basement area be located below grade than above grade; furthermore, this definition must be applied to 50% of a building’s perimeter. The proposed change to the “basement” definition involves increasing the 50% requirement to 75%. This means that more of the basement area must be located below grade than above for 75% of a building’s perimeter; not just 50% of a building’s perimeter. In reviewing compliance with the this definition, each elevation of a given building must be reviewed to see if more of the basement area is submerged below grade as opposed to emerged above grade. With the new definition, this must be the case for 75% of the building perimeter, not just 50%. The current definition essentially allows half (or 50%) of a building to not comply with the definition; the proposal would now allow only 25% of a building to not comply. It is reasonable to allow up to 25% of a basement area to be exempt because in the City of Carlsbad, “underground parking” areas must qualify as “basements” otherwise it af- 1635 Faraday Avenue Carlsbad, CA 92008-7314 - (760) 602-4600 - FAX (760) 602-8559 @ 4 fects building height measurements. Furthermore, the city has flat as well as hillside ter- rain, and this revision is intended to provide truly subterranean basement areas by im- plementing one definition citywide. Implementing the current definition has resulted in the construction of some large buildings in the city that technically comply with applica- ble codes and definitions, however, have the visual appearance of an overheight struc- ture for up to half of its perimeter. v. AMENDMENTS RELATIONSHIP TO AND EFFECT ON OTHER SECTIONS OF THE PREVIOUSLY CERTIFIED LCP The proposed LCP amendment will reflect changes to the City’s Zoning Ordinance, the implementing ordinance for the coastal zone properties in the City, which will involve the revision of the citywide “basement” definition. The effect on other sections of the City’s Zoning Ordinance and coastal resource policies and objectives will be non-existent. 4. ZONING MEASURES THAT WILL IMPLEMENT THE LCPA The LCPA will be implemented via the proposed zone code amendment which will es- tablish the “basement definition” revision within the zoning ordinance (ZCA 99-07). 5. AFFECT OF PUBLIC ACCESS No specific development proposals are associated with this project; nor are any regula- tions which affect the public’s coastal access. The revisions to the City’s “basement definition” will not prevent the provision of required public access improvements with the future development of coastal properties. 6. ANALYSIS OF POTENTIALLY SIGNIFICANT ADVERSE CUMULATIVE IMPACTS ON COASTAL RESOURCES The revisions to the “basement“ definition will not contribute to any cumulative impacts on coastal resources in the area or region. 8. SUMMARY OF MEASURES TO ENSURE PUBLIC AND AGENCY PARTICIPATION The Local Coastal Program Amendment was duly noticed for the required six week re- view period, from December 2, 1999 to January 14, 2000, and no written comments were received.
