HomeMy WebLinkAboutMCA 12-03; Modify References to Housing & Redev Commission; _N/AMCA 12-03 – MODIFY REFERENCES TO HOUSING & REDEVELOPMENT COMMISSION October 17, 2012 Page 2 With the passage of ABx1 26, effective June 27, 2012, all redevelopment agencies in the State of California were dissolved and consequently the City of Carlsbad Redevelopment Agency is no longer a legal entity. Likewise there is no longer a governing body known as the Redevelopment Commission for the dissolved Redevelopment Agency. The proposed action would rename the “Carlsbad Housing and Redevelopment Commission” to the “Community Development Commission”, which shall retain the functions of the former Carlsbad Housing and Redevelopment Commission with regard to housing and acting upon recommendations of the Housing Commission pursuant to Carlsbad Municipal Code Title 2, Chapter 2.40.010. The Community Development Commission shall continue to be the City Council. Associated components of the project that will be considered for approval by the City Council, but are not subject to review by the Planning Commission, consist of the following: Renaming of the Housing and Redevelopment Commission to the Community Development Commission, which shall have the same duties and perform the same functions as the former Housing and Redevelopment Commission with regard to housing; Designating the City Council as the Community Development Commission board members; and Modifying references in Title 2 of the Carlsbad Municipal Code (Administration and Personnel) from the Housing and Redevelopment Commission to the Community Development Commission. IV. ANALYSIS The proposed amendments to the Zoning Ordinance are provided in strikeout/underline format (Attachment 2) and analyzed as follows: General Plan and Zoning Ordinance Consistency: The proposed amendments are minor and primarily non-substantive in nature. Staff has analyzed the proposed amendments and finds that the amendments are consistent with other provisions of the Zoning Ordinance not being amended, and that the proposed amendments do not create any conflicts with the provisions of the General Plan. V. ENVIRONMENTAL REVIEW The proposed action is exempt from environmental review pursuant to CEQA Section 15378 as there is no potential for it to result in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.
