Project Description
Per Housing Element Program 2.1, this amendment would affect the Village Master Plan and Design
Manual. Specifically, the "Residential Density" portion of the "Universal Standards" section of Chapter 3
("Development Standards") of the Manual would be amended as follows:
• Raise the minimum density in land use districts 1-4 from 15 du/ac to 28 du/ac. The maximum
permitted density is 35 du/ac.
• Raise the minimum density in land use districts 5-9 from 15 du/ac to 18 du/ac. The maximum
.permitted density is 23 du/ac.
• Add a statement that the city encourages lot consolidation because of the generally small lots in
the Village.
See page 98 of the manual for existing text.
The amendment proposes text changes only. No development would be approved by this project.

to recommend (1) approval of an amendment to the Village Master Plan and
Design Manual to implement part of Program 2.1 of the 2005-2010 Housing
Element, and (2) that the amendment is wijhin the scope of the Mitigated
Negative Declaration previously adopted for the 2005-2010 Housing
Element. The amendment would raose minimum residential densities to 18
dwellings/acre or 28 dwellings/acre. Maximum residential densities would
remain the same at 23 dwellings/acre or 35 dwellings/acre. The proposed
amendment would also add a policy to encourage lot-consolidation in the
Village area.
Staff has analyzed the project and has concluded that no potentially sognifi-
cant impacts would result with the implementation of the amendment that
were not previously examined and evaluated in the adopted Mitigated
Negative Declaration (MND) and Mitigation Monitorong and Reporting
Program (MMRP) lor the 2005-2010 Housing Element (GPA 03-02), dated
December 22, 2009. The MND for GPA 03-02 comprehensively evaluated
the potential environmental effects of future housing facilitated by implemen-
tation of Housing Element programs. ·

TO INTERESTED PARTIES:
Please be advised that the City of Carlsbad is considering text amendments to its Local Coastal
Program (LCP) as summarized below. This amendment is being proposed by the City of
Carlsbad and is currently under review. This notice hereby opens a six week review period after
which the Planning Commission and City Council will consider all comments and act on the
proposed amendment. The Planning Commission hearing is expected to take place in
September 2012, and will be duly noticed. The City Council hearing is expected to take place in
October 2012, and will be duly noticed.
Copies of the LCP amendment are available for review at the following locations: (1) Carlsbad
Planning Division, 1635 Faraday Avenue; (2) City Clerk's Office, 1200 Carlsbad Village Drive; (3)
Carlsbad Main Library, 1775 Dove Lane; (4) Georgina Cole Library, 1250 Carlsbad Village Drive;
and (5) the California Coastal Commission, 7575 Metropolitan Drive, Suite 103, San Diego, CA

PROPOSED LCP AMENDMENT SUMMARY
LCPA 95-lO(C)-Village Minimum Densities
The Village Master Plan and Design Manual is the LCP for the city's downtown Village area; this
area is zoned "Village Review" (V-R). The Village Master Plan and Design Manual also regulates
V-R zoned areas outside the Coastal Zone. The proposed amendment would revise the Village
Master Plan and Design Manual as explained below:
• In land use districts 1-4, it would raise the minimum density for residential uses from 15
dwelling units/acre (du/ac) to 28 du/ac.
• In land use districts 5-9, the amendment would raise the minimum density for residential uses
from 15 du/ac to 18 du/ac.
• The amendment would add a statement that the city encourages lot consolidation because of
the generally small lots in the Village.
• It would make minor changes to related provisions regarding Growth Management and City
Council Policy 43.
The amendment proposes text changes only and would not approve any development.

Proposed changes affect Chapter 3, Development Standards, as follows:
Residential Density
The properties within the Village Area do not have a residential density assigned to them for Growth
Management Program compliance purposes. Therefore, the minimum and maximum densities for
development that includes residential within the Village Area are set forth herein. For Land Use Districts

A density bonus may be granted in accordance with Chapter 21.86 of the Carlsbad Municipal Code to
exceed the maximum densit:ksy noted above. A density increase may also be granted, on a case-by-case
basis, for the purposes of providing affordable housing for low and/ or moderate income households
and/ or when an applicant can provide acceptable evidence to the City Council that the density increase is
necessary in order for the development to qualifY for silver level or higher LEED Certification, or a
comparable green building rating, and assist in maintaining the financial feasibility of the development
and/ or when the City Council determines that a project has significant public benefit or assists in meeting
the goals and objectives set forth within the Village Master Plan.
To approve a density above the maximum;; set forth herein, the following findings must be made by the
City Council:
1. That the project will provide sufficient additional public facilities for the density in excess of the
maximum permitted to ensure that the adequacy of the City's public facilities plans will not be
adversely impacted.
2. That there have been sufficient developments approved in the quadrant f!bslq1sitics below their
nuximmn dcn.-iriu .. c;rnwth 1\Ianagcmcnt Control Points. so the approval will not result in
exceeding the quadrant limit.
3. That all necessary public facilities will be constructed, or are guaranteed to be constructed,
concurrently with the need for them created by this development and in compliance with the
adopted city standards.
The minimum residential density for the Village shall be +5-J8 QL2t! dwelling units per acreJ::> nog~J
above. Pursuant to California Government Code Section 65863, the city utilized these minim!J.tJ1

1. The reduction is consistent with the adopted General Plan, including the Housing Element.

Project Description: To amend the Village Master Plan and Design Manual to (1) establish new,
higher minimum densities in all land use districts and (2) add a statement that the city encourages lot
consolidation as a general policy. No potentially significant impacts would result with the implementation
of the amendments that were not previously examined and evaluated in the adopted Mitigated Negative

On March 29,2013, the City of Carlsbad Local Coastal Program (LCP) Amendment #3-12 A, B, C,
D and E was filed in the San Diego District office. The amendment involves five unrelated revisions
to the Village Master Plan and Design Manual (LUP/IP) and the zoning code to implement Housing
Element policies for increasing minimum densities; farmworker housing; emergency shelters;
transitional and supportive housing and managed living units. Since the Village Master Plan and
Design Manual also constitutes the land use plan for that segment, the proposed amendment will
affect both the certified land use and implementation plans.
Pursuant to Section 30512 of the Coastal Act, the Commission must act on land use plan
amendments within 90 days of complete submittal or filing. Pursuant to Section 30513 of the
Coastal Act, the Commission must act on implementation plan amendments within 60 days of
filing. Amendments containing both land use and implementation plan components must be acted
upon by the Commission within 90 days of filing. Based on the above-cited time limits, the
proposed LCP amendment must be scheduled for review by the Commission at the June 2013
meeting. However, Section 30517 ofthe Coastal Act and Section 13535(c) of the California Code
of Regulations state that the Commission may extend for good cause any applicable time limits for
a period not to exceed one year.
In addition to these five amendments, there are five other pending LCP amendments filed from the
City of Carlsbad. Two of those are also related to housing element revisions (CAR-MAJ-2-12A &
B) and one other on land use administration (CAR-MAJ-2-12C) are scheduled for Commission
action at this same hearing (June 2013). Another pending LCP amendment relates to the Encina
Power Plant and it is being handled by the Energy Unit. The fifth LCP Amendment also relates to
housing element implementation in the Barrio area of the City and will likely need a time extension
next month. Commission staff is requesting the subject time extension due to insufficient time to
adequately review the amendment and prepare a recommendation given the volume of pending
LCP amendments; however, staff will plan to schedule this package no later than the October or
November 2013 hearings in Southern California. However, staff recommends that the Commission
extend the deadline for a full year as provided by the Coastal Act to allow for uncertainty in the
review process and scheduling issues that may arise. Staff therefore recommends the Commission
extend the 90-day time limit for one year.
MOTION:
I move that the Commission extend the 90-day time limit to act on the City of Carlsbad
LCP Amendment No. CAR-MAJ-3-12A, B, C, D and E for one year.
STAFF RECOMMENDATION:
Staff recommends a YES vote. An affirmative vote of the majority ofthe
Commissioners present is needed to pass the motion.

Dear Mr. Pointer,
In response to the submittal and letter, dated and received in this office on December 20,
2012, this letter addresses the status of the City of Carlsbad's second Local Coastal
Program (LCP) amendment submittal for the last calendar year (2012). This submittal
includes five distinct, but related housing amendment items. First, the request involves
revisions to the certified Village Master Plan and Design Manual, which serves as the
land use plan ("LUP") for the downtown Carlsbad Village segment; the proposed
changes establish new minimum densities in each residential land use district and a new
provision to encourage lot consolidation. Second, the next three amendments each
constitute revisions to the zoning ordinances for housing element implementation efforts.
Last, the fifth amendment again involves a revision to the certified Village Master Plan
and Design Manual (LUP) to address managed living units. Two of the proposed
amendments affect only the Carlsbad Village segment while the remainder would be
applicable citywide. As a whole, the amendment package will amend one of the City's
certified LCP land use plan segments, the Village area, and the City's implementation
program.
Section 13553 of the California Code of Regulations states "[a]n amendment to a
certified LCP or LRDP together with all necessary attachments and exhibits shall be
deemed "submitted" after having been received and found by the executive director of
the Commission to be in proper order and legally adequate to comply with Public
Resources Code Section 3051 O(b ). Said review shall be completed within a reasonable
time, but unless there are unusual circumstances, no later than ten (I 0) working days

after the date it is received in the Commission offices during normal working hours [ ... ]".
Due to existing LCP workload, including other City of Carlsbad LCP amendments, the
past holidays, staffing constraints with continued furloughs and the volume of this
submittal, we have had to take additional time to review it and we appreciate your
patience. Although the amendment request was well-organized, as of the date of this
letter, the amendment package is not complete or deemed filed. The submittal will not be
deemed complete until the outstanding items have been received. The following
paragraphs will describe the outstanding items still needed for each amendment request. .
First, relative to the Village Area minimum densities amendment, City reference LCP A /
95-1 O(C}, there are a couple of administrative items still needed. First, we need proofs of
publication for the submitted hearing notices. It does appear that the submittal included
all the required notices but we did not receive the corresponding proofs of publication for
them. In addition, and this element applies to the submittal as a whole, since the City
relied on the Mitigated Negative Declaration (MND) for GP A 03-02 to make its CEQA
determination, the submittal should include a copy of it fo~he Commission record and /

Second, relative to four remaining amendments that were "hatched" and processed
together at the local level, City references LCPAs 09-03; 09-04; 11-08 and 95-lO(B),
there are some clarifications needed. First, the local reference numbers between the
submitted resolutions and ordinances are different and I want to be sure that the
submitted documents are accurate. For example, Resolution No. 2012-227 addresses
LCPAs 09-03, 09-04, 11-08 and 95-10(B) while the submitted Ordinances identify
Farmworker Housing as ZCA 09-04, Emergency Shelters as ZCA 09-05 and Transitional
& Supportive Housing as ZCA 11-07. Alternatively, the submitted Planning
Commission resolution (Resolution No. 6898) for Managed Living Units does reference
the same citation -LCP A 95-1 O(B). So, please verify that the citations in the cover letter
and submitted resolutions and ordinances are correct. Again, as indicated above, since
the City relied on a previous environmental determination for these amendments, please
submit the cited mitigated negative declaration for our staff analysis and background
information. If there were any other associated reports, exhibits or reference materials
used in the local hearings that you believe would be helpful in our staff analysis, please
forward those documents to our office as well. Relative to LCPA 95-1 O(B) addressing
Managed Living Units in the Carlsbad Village Area, since it involves an amendment to
the Village Master Plan and Design Manual, it seems that it should be represented as a
land use plan revision similar to LCP A 95-1 O(C) rather than just a zoning code
amendment. Please advise and clarify.
As indicated above, for the most part, the submittals were well-organized and quite
thorough. However, given the volume of the materials and the detail of the proposed
revisions, I apologize but it took additional time to complete our initial review. Once we
receive the few identified items and review your responses, we will be able to proceed
with our more detailed review. I would anticipate at that juncture, it would be very
helpful to sit down and review the proposed amendments with you and other key City
staff to discuss issues and establish a schedule for Coastal Commission review. We
