NOTICE OF APPROVAL OF TENTATIVE PARCEL MAP
MINOR SUBDIVISION NO. 04-18
Notice is hereby given that a Tentative Parcel Map has been approved on property generally located
4998 Eucalyptus Lane.
The project involved is described as subdividing one (1) existing 1.9 acre residential lot into 4
residential lots.

STATEMENT OF THE MATTER: Per City of Carlsbad Code Section 20.24.140(b) and the
California Subdivision Map Act Section 66452.5(d) any interested person adversely affected by this
decision of the City Engineer may appeal it to the City Council. An appeal to the City Council must
be filed at the City Clerks Office and the appeal fee amount listed in the most recent edition of the
Carlsbad "Community Development Fees" schedule must be paid. The appeal must be filed with
the City Clerk in writing within 10 days of the date of the final approval letter (Attached). If you
wish to file an appeal please contact the City Clerks office in person.

PROPOSED MINOR SUBDIVISION NO. MS 04-18, Eucalyptus Subdivision
A preliminary decision has been made, pursuant to Section 20.24.120 of the City of Carlsbad
Municipal Code, to approve the tentative parcel map of the proposed minor subdivision subject to
the following conditions:
1. The applicant may request a review of the preliminary conditions within ten (10)
days of the date of this approval. The request must be submitted in writing to the
City Engineer in accordance with Section 20.24.120 through 140 of the Carlsbad
Municipal Code.
2. The parcel map shall comply with the Planning Department memorandum for Minor
Subdivision No. MS 04-18 dated as well as the Planning Commission conditions
contained in the resolutions of approval for CDP 04-34, SUP 04-09, and HDP 04-
08. Approval of this project subject the approval of CDP 04-34, SUP 04-09 and
HDP 04-08, and the conditions contained in the resolutions of approval for said
projects.
3. The tentative parcel map approval shall expire twenty-four (24) months from the
date of the letter containing the final decision for tentative parcel map approval.
4. The applicant shall provide the City with the approved tentative parcel map. The
map shall be to scale on a reproducible 24" x 36" xerox or photo mylar. The
tentative parcel map shall reflect the conditions of approval by the City. The
reproducible shall be submitted to the City Engineer, reviewed and signed by the
City's project engineer and project planner prior to submittal of the building plans,
final map, improvement or grading plans, whichever occurs first.
5. Unless a standards variance has been issued, no variance from City Standards is
authorized by virtue of approval of this tentative parcel map.
6. The applicant shall defend, indemnify and hold harmless the City and its agents,
officers, and employees from any claim, action or proceeding against the City or its
agents, officers, or employees to attack, set aside, void or null an approval of the
City, the Planning Commission or.City Engineer which has been brought against
the City within the time period provided for by Section 66499.37 of the Subdivision
Map Act.
7. All required fees and deposits shall be paid prior to approval of the parcel map.

8. The applicant shall pay the local drainage area fee prior to approval of the parcel
map. Prior to approval of the parcel map the owner shall pay and/or enter into an
agreement with the City to pay any drainage area fees established as a result of the
Master Drainage Plan Update.
9. The owner of the subject property shall execute the City's standard form Geologic
Failure Hold Harmless Agreement and a Hold Harmless Agreement regarding
drainage across the adjacent property prior to approval of the final map for this
project.
10. The applicant shall pay park-in-lieu fees to the City prior to the approval of the
parcel map as required by Chapter 20.44 of the Carlsbad Municipal Code.
11. The project is approved under the express condition the applicant pay the
additional public facilities fee prior to parcel map approval in accordance with City
Council Resolution No. 9169 adopted July 28, 1987 and as amended from time
to time. The applicant further agrees to pay any development fees established
by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code.
The applicant's written agreement to pay said fees is on file with the office of the
City Clerk and is incorporated herein by this reference. If the fees are not paid,
this application will not be consistent with the General Plan and approval for this
project shall be void.
12. The owner shall enter into an agreement to underground all of the existing
overhead utility lines along the boundary of the subdivision prior to parcel map
approval.
A note identifying these obligations shall be placed on an additional map sheet on
the parcel map per the provisions of Section 20.28.060 Carlsbad Municipal Code
and Sections 66434.2 and 66445(g) of the Subdivision Map Act. Improvements
listed above shall be constructed within twelve (12) months of approval of the
Secured Improvement Agreement or such other time as provided in said
agreement.
13. Plans, specifications, and supporting documents for all public improvements shall
be prepared to the satisfaction of the City Engineer. Public improvements shall
include but not be limited to -paving, base, sidewalks, curbs and gutters, medians,
grading, clearing and grubbing, undergrounding or relocation of utilities, sewer,
water, fire hydrants, street lights and retaining walls. Prior to approval of parcel
map in accordance with City Standards, the applicant shall install, or agree to install
and secure with appropriate security as provided by law, improvements shown on
the tentative parcel map and the following improvements to El Camino Real,
Crestview Drive and Eucalyptus Lane:
A. Pavement widening, including transitions and Installation of concrete curb,
gutter and sidewalk, an AC berm and raised landscaped median along El
Camino Real.
B. Installation of driveway aprons and repair of any existing damaged
pavement, concrete curb, gutter or sidewalk along Eucalpytus Lane.
C. Public fire hydrants as required by the City's Fire Marshall.

A note to this effect shall be placed on an additional map sheet on the final map per
the provisions of Sections 66434.2 of the Subdivision Map Act. Improvements
listed above shall be constructed within 18 months of approval of the secured
improvement agreement or such other time as provided in said agreement.
14. This project is approved upon the express condition that building permits will not be
issued for development of the subject property unless the City Engineer determines
that sewer facilities are available at the time of application for such sewer permits
and will continue to be available until time of occupancy. This note shall be placed
on the parcel map.
15. Based upon a review of the proposed grading and the grading quantities shown
on the tentative map, a grading permit for this project is required. Developer
shall apply for and obtain a grading permit from the City Engineer prior to
issuance of a building permit or commencement of any earthwork activities.
16. New utility services for Lot 3 shall not be installed as shown on the tentative map. If
determined adequate by the City Engineer at the time of development, the existing
sewer and water lateral within Eucalyptus Lane shall be used to serve Lot 3. The
existing sewer lateral shall be extended southerly to lot 3 over a portion of lot 2
within 5-foot wide private utility easement.
17. Prior to the issuance of a grading permit, Developer shall submit to the City
Engineer proof that a Notice of Intention for the start of work has been submitted
to the State Water Resources Control Board.
18. Prior to the issuance of grading permit, Developer shall submit for City approval a
"Storm Water Management Plan (SWMP)." The SWMP shall demonstrate
compliance with the City of Carlsbad Standard Urban Stormwater Mitigation Plan
(SUSMP), Order 2001-01 issued by the San Diego Region of the California
Regional Water Quality Control Board and City of Carlsbad Municipal Code. The
SWMP shall address measures to avoid contact or filter said pollutants from
storm water, to the maximum extent practicable, for the post-construction stage
of the project. At a minimum, the SWMP shall:
a. identify existing and post-development on-site pollutants-of-concern;
b. identify the hydrologic unit this project contributes to and impaired water
bodies that could be impacted by this project;
c. recommend source controls and treatment controls that will be implemented
with this project to avoid contact or filter said pollutants from storm water to the
maximum extent practicable before discharging to City right-of-way;
d. establish specific procedures for handling spills and routine clean up. Special
considerations and effort shall be applied to resident education on the proper
procedures for handling clean up and disposal of pollutants;
e. ensure long-term maintenance of all post construct BMPs in perpetuity; and
f. identify how post-development runoff rates and velocities from the site will not
exceed the pre-development runoff rates and velocities to the maximum extent
practicable.

19. Prior to the issuance of grading permit, Developer shall submit for City approval a
"Storm Water Pollution Prevention Plan (SWPPP)." The SWPPP shall be in
compliance with current requirements and provisions established by the San
Diego Region of the California Regional Water Quality Control Board and City of
Carlsbad Requirements. The SWPPP shall address measures to reduce to the
maximum extent practicable storm water pollutant runoff during construction of
the project. At a minimum, the SWPPP shall:
a. include all content as established by the California Regional Water Quality
Control Board requirements;
b. include the receipt of "Notice of Intent" issued by the California Regional
Water Quality Control Board;
c. recommend source control and treatment control Best Management Practices
• (BMPs) that will be implemented with this project to avoid contact or filter said
pollutants from storm water to the maximum extent practicable before
discharging to City right-of-way or natural drainage course; and
d. establish specific procedures for handling spills and routine clean up. Special
considerations and effort shall be applied to resident education on the proper
procedures for handling clean up and disposal of pollutants.
20. Developer shall cause Owner to waive direct access rights on the parcel map for
all lots abutting El Camino Real and Crestview Drive.
21. Developer shall install enhanced erosion control measures during the grading of the
manufactured slope adjacent to El Camino Real. Permanent landscaping shall be
installed and maintained upon completion of the grading for said slope.
