Therefore, the Tentative Parcel Map MS 05-02X1, Fidelman Project, shall not expire March 1, 2008 but shall be extended until February 28, 2009 subject to all the original conditions of approval listed in the preliminary approval letter dated February 13, 2006, except as modified below: The following conditions are hereby deleted: 4. Approval of this minor subdivision is subject to the approval and conditions of CDP 05-03 and HDP 05-01. 12. A private drainage easement shall be reserved over Lot 3 for the benefit of Lot 1 as shown on the tentative parcel map. 16. Prior to the issuance of grading permit or building permit, whichever occurs first, Developer shall submit for City approval a "Storm Water Pollution Prevention Plan (SWPPP)." The SWPPP shall be in compliance with current requirements and provisions established by the San Diego Region of the California Regional Water Quality Control Board and City of Carlsbad Requirements. The SWPPP shall address measures to reduce to the maximum extent practicable storm water pollutant runoff during construction of the project. At a minimum, the SWPPP shall: a. include all content as established by the California Regional Water Quality Control Board requirements; b. include the receipt of "Notice of Intent" issued by the California Regional Water Quality Control Board; c. recommend source control and treatment control Best Management Practices (BMPs) that will be implemented with this project to avoid contact or filter MS 05-02X1 Page 1 05/22/2008 1635 Faraday Avenue • Carlsbad, CA 92008-7314 • (760) 602-272O • FAX (760) 602-8562 said pollutants from storm water to the maximum extent practicable before discharging to City right-of-way or natural drainage course; and d. establish specific procedures for handling spills and routine clean up. Special considerations and effort shall be applied to employee education on the proper procedures for handling clean up and disposal of pollutants. The following conditions are hereby added: 1. Approval of this minor subdivision is subject to the approval and conditions of CDP 05-03X1 and HDP 05-01X1. 2. Developer shall cause Owner to execute a covenant of easement for private drainage as shown on the tentative parcel map. The obligation to execute and record the covenant of easement shall be shown and recording information called out on the parcel map. Developer shall provide City Engineer with proof of recordation prior to issuance of building permit. 3. Developer shall cause property owner to execute and submit to the City Engineer for recordation, the City's standard form Panhandle Lot Hold Harmless Agreement prior to the issuance of a building permit for Lot 3. 4. Developer shall submit for City approval a "Storm Water Management Plan (SWMP)." The SWMP shall demonstrate compliance with the City of Carlsbad Standard Urban Stormwater Mitigation Plan (SUSMP), Order R9-2007-0001 issued by the San Diego Region of the California Regional Water Quality Control Board and City of Carlsbad Municipal Code all to the satisfaction of the City Engineer. 5. Developer shall cause property owner to process, execute and ^ubmit an executed copy to the City Engineer for recordation a City standard Permanent Stormwater Quality Best Management Practice Maintenance Agreement for the perpetual maintenance of all treatment control, applicable site design and source control, post-construction permanent Best Management Practices prior to the issuance of a grading permit or building permit, or the recordation of a parcel map, whichever occurs first for this Project. 6. Developer shall complete and submit to the City Engineer a Project Threat Assessment Form (PTAF) pursuant to City Engineering Standards. Concurrent with the PTAF, Developer shall also submit the appropriate Tier level Storm Water Compliance form and Tier level Storm Water Pollution Prevention Plan (SWPPP) as determined by the completed PTAF all to the satisfaction of the City Engineer. 7. Developer shall incorporate Low Impact Development (LID) design techniques, on all final design plans submitted to the City, to reduce the amount of run-off by mimicking the natural hydrologic function of the site MS 05-02X1 ' Page 2 05/22/2008 by preserving natural open-spaces and natural drainage channels, minimizing impervious surfaces, promoting infiltration and evaporation of run-off before run-off leaves the site. Developer shall incorporate LID techniques using current County of San Diego Low Impact Development Handbook (Stormwater Management Strategies). LID techniques include, but are not limited to: vegetated swale/strip, rain gardens, and porous pavement, which can greatly reduce the volume, peak flow rate, velocity and pollutants. 8. A note to the following effect shall be placed on the map as non-mapping data: "The owner of this property on behalf of itself and all of its successors in interest has agreed to hold harmless and indemnify the City of Carlsbad from any action that may arise through any diversion of waters, the alteration of the normal flow of surface waters or drainage, or the concentration of surface waters or drainage from the drainage system or other improvements identified in the City approved development plans; or by the design, construction or maintenance of the drainage system or other improvements identified in the City approved development plans." The project involved is described as the subdivision of one 1.08 acre lot into three single family residential zoned lots. An appeal to the City Council must be filed at the City Clerks Office and the appeal fee amount listed in the most recent edition of the Carlsbad "Community Development Fees" schedule must be paid. The appeal must be filed with the City Clerk in writing within 10 days of the date of the final approval letter (Attached). APPLICANT: Mark Fidelman STATEMENT OF THE MATTER: This project is an extension for an approved minor subdivision (four units or less), which by subdivision ordinance, does not require a publ'c hearing. A minor subdivision extension is processed by the City staff and must comply with all applicable codes, regulations, and zoning. Each property owner may request, in writing, the opportunity to be heard on the Tentative Parcel Map Extension. In accordance with section 20.24.1 15 of the Municipal Code, a written request must be filed with the City Engineer within fifteen (15) days of this notice. Your comments and suggestions are appreciated. This is the 1st of two public notices you will receive.
