As you recall, PDC acquired the Sonata Parcel in 2012 for the location of mitigation requirements for La Costa Town Square. PROJECT DESCRIPTION SONATA PARCEL The Sonata Parcel AP 255-031-26 (11 plus acres) was acquired by the developer of La Costa Town Square for mitigation of impacts from the development of La Costa Town Square Commercial and Residential uses east of Rancho Santa Fe Road and north of La Costa Avenue in LFMP Zone #11. There currently is no development within the Sonata Parcel other than underground utilities - sewer - storm drain and communications facilities and a gravel road for access and maintenance. No development is proposed and the existing General Plan/La Costa Master Plan uses will remain open space (the zoning is Planned Community). The proposed minor subdivision will create 2 parcels. Parcel #1 will be 2.98 acres and will be covered with a conservation easement. Thread-leaved brodiaea and Orcutt's brodiaea have already been translocated from the La Costa Town Square into parcel #1 along with enhancement of wetland areas to mitigate La Costa Town Square wetland impacts as identified by the State and Federal agencies. The 2.98 acre parcel 1 is currently in year 1 of 5 years of maintenance. When the 5 year maintenance is completed and accepted by the agencies and City the San Diego Habitat Conservancy (SDHC) will take over perpetual maintenance using an endowment established by the owner - Property Development Center, LLC (PDC). SDHC will also take fee title to parcel #1. Parcel #2 is 8 plus acres and contains a variety of upland and wetland habitat. There is about 1.92 acres within the 8 plus acres that can by enhanced to create credits for future projects not associated with La Costa Town Square. Within the existing 11 plus acre parcel is a gravel access road constructed by the previous owner - Santa Fe Sonata HOA - for access to a slope failure repair done on HOA property off-site of the current Sonata parcel. The HOA completed the slope repair but required as part of PDC's purchase of the property to retain access over the gravel road for future maintenance of their adjacent slope and property. A non-exclusive grant of easement was conveyed back to the HOA on November 12, 2012 at the time of purchase by PDC. PDC also will use this gravel road/access and drainage easement for access to both parcel 1 and parcel 2. ENVIRONMENTAL SETTING (EIA INFORMATION) (SONATA PARCEL - 255-031-26) Question No. 32 Response The 10 plus acre site is currently undeveloped open space and the proposed use is open space. Improvements within the parcel are existing sewer, storm drains and underground utilities, all within previously recorded easements. Several years ago, before the current owner acquired the property the previous owner constructed a gravel access road off Camino de los Coches to aide in the repair of a slope failure on the adjacent off-site property. This work was performed and completed per City approved grading plan Drawing 462-3A. When the current owner acquired this property, an easement for access was reserved for the adjacent owner for continued maintenance of the landscaping and slope repair area. The current owners have used a portion of the site (2.98 acres) for transplanting 2 types of brodiaea from La Costs Town Square (now under construction) and wetland mitigation. The balance of the property (about 8 acres) will be offered for sale to someone looking for habitat enhancement credits (about 1.9 acres of the 8 acre parcel). No development is proposed and the property will be maintained in its natural state. Question No. 33 Response The properties surrounding the 10 plus acre site include: North: Camino de los Coches and Stage Coach Park across the street. East: A single family subdivision elevated above the site for the northerly 1/3 and an elementary school site also elevated above the site for the southerly 2/3. South: Calle Barcelona and additional single family homes and open space south of Calle Barcelona. West: Adjacent to Rancho Santa Fe Road elevated above the site for about /4 the parcel length and a developed shopping center also elevated along the site supported by a large retaining wall. The function of the site is to transport drainage from the area to the north southerly to Encinitas Creek about a half mile to the south. I have tried several times to get a response from the District and according to Gerry Devitt their attorney is looking at it. We would like to get the conditions of approval from the City so we can proceed with the finai map preparation including a boundary survey and all else that goes along with a final map. I would suggest that if we don't get a written response by 5:00 PM on October 27*'^ from the District that we forget about offering the District a pedestrian easement. We need to move forward with the final parcel map for other reasons - having a recorded map to define the lot/conservation easement for the Sonata mitigation site. I would appreciate your response. On May 21, 2014 I did submit an application and check for $2,971 for PUD 14-03. The application number has been added to minor subdivision exhibit. There were no engineering items needed to complete the application. Issues of Concern - Planning 1. We agree with staff comments on the need for a non-residential Planned Development Permit (PUD) to subdivide the property with Parcel 1 not fronting on a public street. As mentioned, we have applied for and paid the permit fee for PUD 14-03. 2. Per staff request, we did stake the property line between the elementary school (Mission Estancia) and Sonata to see it there was room to construct a public trail adjacent to the existing school fence at the top of a large fill slope. On July 10, 2014 I met with staff (Van Lynch - Planning, Steve Jantz and Liz Ketabian - Parks and Recreation) and we reviewed the property line markings for the "A" line based on the recorded legal description for the school which is also the same legal description which is an exception to the Sonata Grant Deed. The project does not qualify as an environmental subdivision under Chapter 20.22 of the Carlsbad Municipal Code (CMC) as provisions for both the properties to have perpetual maintenance has not been provided. Only Parcel 1 is proposed to have perpetual maintenance as it is the mitigation site for the La Costa Town Square project. The city will consider this a regular subdivision of land. As such, by definition lots are required to have frontage that allows usable access onto a dedicated street (21.04.210 CMC). Because Parcel 1 does not have frontage onto Camino De Los Coches, the lot does not meet the above requirement. It is understood that the reason for the property not to have frontage is that the prospective land manager of the parcel for conservation purposes does not want the responsibility or liability for the manufactured slopes associated with Camino De Los Coches. In order to subdivide the property without frontage onto a street, the project will need to apply for a Non-Residential Planned Development Permit. 2. The project site is located within the La Costa Master Plan. Pursuant to Section IV (B) of the plan, the project is required to offer for dedication a public trail easement to implement the Master Plan Open Space trail plan (Exhibit IV-1 of the Master Plan). Per the Master Plan, this offer of dedication shall provide that the trail shall not be for public use unless and until the city accepts the offer to dedicate and assumes liability and maintenance responsibility for the pedestrian trail. The city would like to determine the feasibility of locating the trail adjacent to the fence line ofthe adjacent Mission Estancia elementary school. Please have the property line staked to determine if there is adequate room for a trail. The city will further pursue the maintenance and liability responsibilities for the trail segment.
