to the boundaries of the proposed minor subdivisions;

STATEMENT OF AGREEMENT
TENTATIVE PARCEL MAP
CITY OF CARLSBAD
The Subdivision Map Act and the Carlsbad Municipal Code sets a
fifty (50) day time restriction on Engineering Department pro-
cessing. This time limit can only be extended by the mutual
concurrenoe of the applicant and the City. By accepting appli-
cations for Tent~tive Parcel Maps concurrently with applications
for other approvals which are prerequisites to the map; i.e.,
Environmental Assessment, 'Environmental Impact Report, Condominium
Plan, Planned Unit Development, etc., the fifty (50) day time
limits are often exceeded. If you wish to have. your application
processed concurrently, this agreement must be signed by the
applicant or his agent. If you choose not ·to sign the statement,
. the City wil~ not accept your application for the Tentative Parcel
Map until all prior necessary entitlements have been processed and
,approved.
The undersigned understands that the processing time required by
the City may exceed the time limits; therefore, the undersigned
agrees to extend the time limits for City Engineer action and
fully concurs with any extensions of time up to one year from
the date the application was accepted as complete to prope.rly
review all of the applications.

is named as an insured in Schedule A,
(e) "knowledge": actual knowledge. not constructive knowledce or not.ce "'hich
may be imputed to an lflsured by reason of any public recurds. •
(f) "land": the land described. specifically or by reference in Schedule A, and
improvements affixed thereto which by law constitute real properry, p~oYld(:d, howe, cr.
the term "land" does not include any area excluded by Paragraph No.6 ot Part I of Schedule B of this Policy. (g) "mortgage": mortgape, deed of trust. trust deed, or other security instrument.
(1) "public records": those records which by law impart comtructl\'e nvtice of
matters relating to the land.
2. lal CONTINUATION OF INSURANCE AFTER ACQUISITION OF TITLE

said jnsured mortgage at (he time o[ acquiSItion of such estate or Inttn:st jn
the land; or
(iii) the amount paid by any governmental agency or instrumentality, if such
agency or jnstrumt:ntality IS the insured claimant. in aCGUJsition of such estate
or interest in satisfactIOn of jts insurance contract or gliaranty.
Ibl CONTINUATION OF INSURANCE AFTER CONVEYANCE OF TITLE
The coverage of thi' policy shall continue in force as of Date of PolICY. in favor of an
insured so long as such Insured retains an estate or interest in the land, or owns an indebtednt:~s secured by a purchase money mortgage gh'en hy a purcha'ier from such in-
sured, or so long as such IOsured shall have hab.bty bv reason of covenants of warranty
made by such Insured in any trnnsfer or conveyance o( such estate or interest, pro\'lded,
however, this policy shall not (ominue in force in favor of 3ny purchaser from such
insured of either said estate or interest or thc indebtednt:ss ~f'cured by a purchase money
mortgage given to such insured.
3. DEFENSE AND PROSECUTION OF ACTIONS-NOTICE OF CLAIM TO BE GIVEN
BY AN INSURED CLAIMANT
(a) The Company, at its own cost and without undue deJa),. shall prO\'ide for the

are at capac~ty and will not be available to accommodate the
additional need for public facilities and services resulting
from the proposed Development; and
WHEREAS, Developer has asked the City to find that public
facilities and services will be available to meet the future
needs of the Development as it is presently proposed; but the
Developer is aware that the City cannot and will not be able to
make any such finding without financial assistance to pay for
such services and facilities; and, therefore, Developer proposes •

the development is intended. Developer shall pay to City a public
facilities fee in the' sum of $1,150 for each mobilehome space to be
construct'ed pursuant to the Request. The fee shall be paid prior
to the issuance of building or other.construction permits for the
development. This fee shall be in addition to any fees, dedica~ions
or improvements required according to Titles 18, 20 or 21 of the
Carlsbad Municipai Code. A credit tmvard such .fee 'shall be given
for land which has been dedicated for park purposes or for any fees
paid in lieu thereof pursuant to Chapter 20.44 of the Carlsbad
Municipal Code.
2e The Developer may offer to. donate a site or sites for
public facilities in lieu of all or part of the financial obligation
agreed upon in Paragraph 1 above. If Developer o:t;fers _ to : :
donate a site or sites for pu~lic facilities, the. City shall
consider I but is not obligated to accept the offer. The t'ime for
donation anti amount of credit against the fee shall be determined
by City prior to the issuance of any building or other permits.
Such de~ermination, when made, shall become a part of this agree~
'mente Sites donated under this paragraph shall not include improvements
required pursuant to Titles 18·or 20 of the Carlsbad Municipal
Code.
3.. This ~greement and the fee paid pursuant hereto are
~equired to ensure the consistency of the Development with the
City's General Plan. If the fee is not paid as provided herein,
the City will not have the funds to provide public facilities and
services,,'and the Development ~ill not be consistent with the
General Plan and any apprqval or pennit for the Development shall

be void.· No building or other construction permit or entitlement
for'use shall be issued until the public facilities fee required by
this agreement is paid.
4. City agre~s to deposit the fees paid pursuant to this
'agreement in a public facilities fund for the financing of public
facilities when the City Council determines the need exists to
provide the facilities and su~ficient funds from the payment of
t~is and similar public facilities fees are available.
5. City agrees to provide upon request reasonable assurances
to enable Developer to c~mply with any requirements of other public
ag~ncies as evidence of adequate public facilities and services
sufficient to accommodate the needs of the Development herein
described.
6m All obligations hereund~r shall' terminate in the event
the' Requests made by Developer are not approved.
,·7. Any notice from one party to the other shall be in
writing, and shall be dated and signed by the party giving such
not~ce or by a duly authorized representative of such party. Any
such notice shall not be effec~ive for any purpose whatsoever
unless served in one of the following manners:
7.1 If notice is given to the City by. personal delivery
thereof to the City or by depositing same in the Un{ted States
Mail, addressed to the City at the address set forth'heretn,
enclosed in a sealed envelope, addressed to the City for attention
of the City Manager, postage prepaid and certified.
7.2 If notice is given to Developer by personal delivery
thereof to Developer or by depositing the same in the United States

PUBLIC FACILITIES FEE REQUIREMENTS
City'Counci-l Policy Number 17 requires, that all developers
requesting a ~iscretionary action for ~ project pay a public
facilities fee in the amount of two-percent of the' building
valuation. The fee is computed by the Building Department and
paid at the' time the building permit is obtained. In the case
of a condominium conversion, the fee is calculated on the
bu~lding valuation at the time'the fee is ,paid.and the fee must
be paid prior to obtaining a final map on the project.
In addition to the above, a completed, signed and notarized
agreement to pay the public facilities fee must be submitted
with any application for a dis~retionary action. This· agreement
form 'should be completed as follows:
1. Selected, the appropriate form for either (a) the developer
and owner are the same party, or (b) the developer and owner
are different.
2. Fill in the date the agreement is completed, the name ~nd
address of the developer (and owner, if appropriate) and
state if each is an individual, partne:ship, corporation,
