AND OTHER PROVISIONS OF THE CONDITIONS AND STIPULATIONS HERETO
ANNEXED AND MADE A PART OF THIS GUARANTEE,
LAND TITLE INSURANCE COMPANY
a corporation, herein called "the Company",
GUARANTEES
THE CITY OF CARLSBAD
herein called the Assured, against loss not exceeding $1,000, which
the Assured shall sustain by reason of any incorrectness in the
assurance which the Company hereby gives that, according to the
public records on the date stated below,
1. The title to the herein described estate or interest was
vested in the vestee named, subject to the matters
shown as Exceptions herein, which Exceptions are not
necessarily shown in the order of their priority; and
2. Had said Parcel Map been recorded in the office of the
County Recorder of said county, such map would be
sufficient for use as a primary reference in legal
descriptions of the·parce1s within its boundaries.

The estate or interest in the land hereinafter described or referred to
covered by this Guarantee is a fee.
Title to said estate or interest at the date hereof is vested in:
JOSEPH CAFARELLA AND CLEMENTINE CAFARELLA, Husband and Wife as Joint Tenants
as to an undivided 1/2 interest and LORENZO VERON CRUZ AND ESTHER MAE CRUZ,
Husband and Wife as Joint Tenants as to an undivided 1/2 interest.
The land i~cluded within the boundaries of the Parcel Map hereinbefore
referred to in this Guarantee is described as follows:
Lot 295 of La Costa Meadows Unit No.2, in the City of Carlsbad, County of
San Diego, State of California, according to Map thereof No. 6905, filed in
the Office of the County Recorder of San Diego County on April 21, 1971.
EXCEPTIONS:
1. Secured property taxes, a lien not yet payable, for the fiscal year
1983-1984.
2. Covenants, conditions and restrictions, but deleting restrictions,
if any, based upon race, color, religion or national origin, as contained
in an instrument recorded May 6, 19,71 as File No. 93263.
Said instrument provides that a violation thereof shall not defeat nor render
invalid the Lien of any mortgage or deed of trust made in good faith and for
value.
3. A deed of trust dated March 21, 19aO, to secure an indebtedness
of $120,000.00, recorded March 28, 1980 as File No. 80-106815.
Trustor: Joseph Cafarella and Clementine Cafarella, Lorenzo Veron Cruz and
Esther Mae Cruz.
Trustee: Verdugo Service Corporation, a California corporation.
Beneficiary: Glendale Federal Savings and Loan Association, a United States
corporation.
4. An agreement between developer-owner and the City of Carlsbad for the
payment of a public facilities fee above, upon the terms and conditions
contained therein recorded May 25, 1983 as File No. 83-174068.
Said instrument recites in part as follows:
"This agreement shall be recorded but shall not create a lien or security
interest in the property. When the obligations of this agreement have been
satisfied, City shall record a release".
