TENTATIVE PARCEL NAP
CITY OF CARLSBAD
The Subdivision Map Act and the Carlsbad Municipal Code sets a fifty (50) day
time restriction on Engineering Department processing. This time limit can
only be extended by the mutual concurrence of the Applicant and the City. By
accepting applications for Tentative Parcel Maps concurrently with applications
for other approvals which are prerequisites to the Map (i.e., Environmental
Assessment, Environmental Impact Report, Condominium Plan, Planned Unit
Development, etc.), the fifty (50) day time limits are often exceeded. Ifyou
wish to have your application processed concurrently, this agreement must be
signed by the Applicant or his agent. If you choose not to sign the statement,
the City will not accept your application of the Tentative Parcel Map until all
prior necessary entitlements have been processed and approved.
The Undersigned understands that the processing time required by the City may
exceed the time limits; therefore, the Undersigned agrees to extend the time
limits for City Engineer action and fully concurs with any extensions of time
up to one (1) year from the date the application was accepted as complete to
properly review all of the applications.

Notice is hereby given that a Tentative Parcel Map has been approved on property generally located
at the south side of Hemlock Street between Garfield Avenue and AT&SF Raihoad and more
particularly described as 335 Hemlock Street.
The project involved is described as a three unit condominium.

STATEMENT OF THE MATTER: Per City of Carlsbad Code Section 20.24.140(b) and tiie CaKfomia
Subdivision Map Act Section 6645.5(d) any interested person adversely affected by this decision of
the City Engineer may appeal it to the City Council. An appeal to the City Council must be filed
at the City Clerks Office and an appeal fee of $275.00 paid. The appeal must be filed with the City
Clerk in writing within 10 days of the date of the final approval letter (Attached). If you wish to

Whereas no review of the conditions of the letter of preliminary approval was requested by the
appropriate date; and whereas the requirements of the Califomia Enviromnental Quahty Act and the
City of Carlsbad Environmental Protection Ordinance of 1973 relating to the subject proposed parcel
map have been examined by the Planning Director and declared to have a non-significant impact
upon the environment; and whereas negative findings delineated by Section 20.24.130 of the
Carlsbad Municipal Code have not been made; and whereas this minor subdivision is found to be
in conformity with the General Plan of the City of Carlsbad; therefore, a final decision has been
made to approve the subject tentative parcel map subject to the conditions set forth in the
preliminary approval letter.

PROPOSED MINOR SUBDIVISION NO. 807
A preliminary decision has been made, pursuant to Section 20.24.120 of the City of Carlsbad
Municipal Code, to approve the tentative map of the proposed minor subdivision subject to the
foUowing conditions:
1. The Subdivider shaU provide separate sewer, water, gas and electric services with meters
to each of tiie tmits.
2. The developer shaU be responsible for coordination with S.D.G.&E., Pacific Telephone, and
Cable TV authorities.
3. AH required fire hydrants, water mains, and appurtenances shall be operational prior to
combustible buUding materials being located on fhe project site.
4. AU required fees and deposits shaU be pzdd prior to final parcel map recordation. (See
attached Hst.)
5. The tentative parcel map approval shaU expire two (2) years from the date of the letter
containing the final decision for tentative map approval.
6. The appHcant may request a review of the conditions in writing within ten (10) days of
the date of this approvaL
7. AU lots within this project shaU conform to current Zoning Ordinance (Titie 21) with
respect to size, setbacks, and land use.

10. This project is also approved under the express condition that the appHcant pay the
additional pubHc facihties fee adopted by the City CouncU on AprU 22, 1986, and ciny
development fees established by tne City Council pursuant to (Drdinance No. 9791 or
subsequent ordinance adopted to implement a growth or development management system
or pubHc fadHties phasing plan to fulfiU the subdivider's agreement to pay the pubhc
facilities fee dated May 30, 1989, a copy of which is on file with the City Clerk and is
incorporated by this reference. If the fees are not paid, this appHcation wUl not be
consistent with the General Plan and approval for this project shall be void.
The developer shaU submit approval of the Califomia State Coastal Commission prior to
parcel map approval.
The developer shaU enter into an agreement to pay fees for undergrounding of aU existing
overhead utiHty Hnes along the boundary of fhe subdivision prior to final parcel map
approval.
This project has been reviewed for conformancy with the grading ordinance and found to
be a project for which a grading permit is required. Prior to any buUding pennits bemg
issued for the site a gradmg plan in conformance with City Standards and Section 11.06
of the Carlsbad Mumcipal Code must be submitted, approved and grading work must be
completed to the satisfaction of the City Engineer. All slopes within this project "shaU be
graded no steeper than two horizontal to one vertical unless specificaUy approved other-
wise pursuant to these conditions.
14. The developer shaU obtain a grading permit prior to the comm^cement of any clearing
or grading of the site.
15. The grading for this project is defined as "controUed grading" by Section 11.06.170(a) of
the Carlsbad Municipal Code. Grading shaU be performed under the observation of a civU
engineer whose responsibiHty it shaU be to coordinate site inspection and testing to ensure
comphance of the work with the approved grading plan, submit required reports to the
City Engineer and verify comphance with Chapter 11.06 of the Carlsbad Mumcipal Code.
A separate grading plan shaU be submitted and approved and a separate grading permit
issued for me borrow or disposal site if located within the city Hmits.
Prior to hauling dirt or construction materials to any proposed construction site within this
project the developer shaU submit to and receive approval form the City Engineer for the
proposed haul route, nfe'developer shaU comply with aU conditions and requirements the
City Engineer may impose with regards to the hauling operation.
18. Additional drainage easements and drainage stmctures shaU be provided or instaUed as
may be required by the City Engineer.
19. Unless a standard variance has been issued, no variance from City Standards is authorized
by virtue of approval of this tentative parcel map.
20. The developer shaU comply with aU the mles, regulations and design requirements of the
respective sewer and water agencies regarding services to the project.
21. Final parcel map shaU comply with the Land Use Planning Office memorandum for
Condominium Permit No. CP 89-06 and Site Development Plan No. SDP 89-04 (copies
included herewith).

22. AU private driveways shaU be kept clear of parked vehicles at aU times, and shaU have
posted "No Parking/Fire Lane Tow Away Zone" pursuant to Section 17.04.040, Carlsbad
Municipal Code.
Prior to approval of any grading or buUding permits for this project, the owner shaU give
written consent to the annexation of the area shown within the boundaries of the site
plan into the existing City of Carlsbad Street Lighting and Landscaping District No. 1.
24. The developer shaU tie the 6" sewer lateral into the existing sewer manhole. A dead end
riser shaU be placed on the 6" lateral at the property Hne.
25. The developer shaU remove and replace any curb and gutter damaged during the constric-
tion of the project at the discretion of the City Engineer.
26. For necessaiy work in the paved section of the pubHc right of way of Hemlock Avenue,
the developer shaU feather m the asphalt to match the existing roadway to the satisfaction
of the City Engineer.
27. The developer shaU be responsible for the removal/abandonment (to the satisfaction of
the City Engineer) of any existing sewer and water laterals along the project frontage that
are not to be used- This condition shaU be completed prior to the occupancy of any of
the units. (A note stating this, shaU be placed on tiie parcel map.)
28. If Site Development Plan SDP 89-04 is denied by the Planning Commission, the approval
of Minor Subdivision MS 807 shaU be nuU and void.

STANDARD CONDITIONS:
1. Notice of Receipt and Acknowledgement. The permit is not valid and
development shall not commence until a copy of the permit, signed by the
permittee or authorized agent, acknowledging receipt of the permit and
acceptance of the terms and conditions, is returned to the Commission
office.
2. Expi ration. If development has not commenced, the permit will expire two
years from the date on which the Commission voted on the application.
Development shall be pursued in a diligent manner and completed in a
reasonable period of time. Application for extension of the permit must
be made prior to the expiration date.
3. Compliance. All development must occur in strict compliance with the
proposal as set forth below. Any deviation from the approved plans must
be reviewed and approved by the staff and may require Commission approval.
4. Interpretation. Any questions of intent or interpretation of any
condition will be resolved by the Executive Director or the Commission.
5. Inspections. The Commission staff shall be allowed to inspect the site
and the development during construction, subject to 24-hour advance notice,
6. Assignment. The permit may be assigned to any qualified person, provided
assignee files with the Commission an affidavit accepting all terms and
conditions of the permit.

have no intentions of performing any work under your direction or

404.2. Definition of Responsible Charge for Land Surveyors.
The term "responsible charge" directly relates to the span or degree of control a licensed land surveyor is required
to maintain while exercising independent control and direction of land surveying work, and the land surveying decisions
which can be made only by a licensed land surveyor.
(a) Span of Control. The span of control necessary to be in responsible charge shall be such that the land surveyor:
(1) Personally makes land surveying decisions, or reviews and approves proposed decisions prior to their
implementation, including consideration of altematives. whenever land surveying decisions which could affect the
health, safety or welfare of the public are made.
In making land surveying decisions, the land surveyor must be physically present or through the use of communi-
calion devices be available in a reasonable period of time.
(2) Judges the qualifications of technical specialists and the validity and applicability of their recommendations
before such recommendations are incorporated in the work.
(b) Land Surveying Decisions. The term "responsible charge" relates to Land Surveyors' Act and does not refer
to management control in a hierarchy of those persons authorized to practice land surveying except as each of the
individuals in the hierarchy exercises independent land surveying judgement and thus responsible charge. It does not
refer to such administrative and personnel management functions as accounting, labor relations, performance standards,
marketing of service and goal setting. While a person authorized to practice land sur\'eying may also have such duties
in this position, it shall not enhance or decrease one's status of being in responsible charge of the work. The phrase does
not refer to the concept of financial liability.
Land surveying decisions which must be made by and are the responsibility of the land surveyor in responsible
charge are those decisions conceming permanent or temporary work which would create a hazard to life, health, property
or public welfare, and may include, but are not limited to:
(1) Selecting the methods, procedures, and accuracies of field work. Determining calculation and adjustment methods.
(2) Specifying the format and information to be shown on maps or documents fumished in connection with land
surveying. Reviewing the sufficiency and accuracy of the work product.
(c) Responsible Charge Criteria. As a test to evaluate whether a person authorized to practice land surveying is
in nssponsible charge, the following must be considered: The land surveyor who signs surveying documents must be
capable of answering questions asked by equally qualified land surveyors. These questions would be relevant to the
decisions made during the individual's participation in the project, and in sufficient detail to leave little question as to
the land surveyor's technical knowledge of the work performed. It is not necessary to defend decisions as in an adversary
situation, but only to demonstrate that the individual in responsible charge made them and possessed sufficient
knowledge of the project to make them.
Examples of questions to be answered by the land surveyor could relate to criteria for design, methods of analysis
and conclusions made including, but not limited to, the retracement of govemment surveys, interpretation and constmction
of deeds, application of proportion methods and analysis of evidence related to unwritten property rights. The individual
shall be able to clearly define the span or degree of control and how it is exercised both within the organization and
geographically and to demonstrate that the land surveyor is answerable within said span or degree of control.
405. Delegation of Certain Functions.
(a) Whenever it is stated in these rules that the "boara" may or shall exercise or discharge any power, duty, purpose,
function, or jurisdiction, the state Board of Registration for Professional Engineers specifically has reserved the same
for its own, exclusive action.
(b) Whenever it is stated the "executive secretary" may or shall exercise or discharge any power, duty, purpose,
function, or jurisdiction, the executive secretary of the State Board of Registration for Professional Engineers has the
authority to act thereon.
(c) Any party in interest may appeal to the State Board of Registration for Professional Engineers for review of
the actions and decisions of the executive secretaiy.
(d) Nothing herein prohibits the executive secretary from redclegating to his/her subordinates as provided in
Section 18572 of the Govemment Code.
(e) The power of discretion confenred by iaw upon the Board to receive and file accusations; issue notices of
hearing, statements to respondent and statements of issues; receive and file notices of defense; determine the time and
piace of hearings under Section 11508 of the Govemment Code, issue subpoenas and subpoenas duces tecum, set and
calendar cases for hearing and perform other functions necessary to the businesslike dispatch of the business of the

ARTICLE 2.3. LAND SURVEYORS REVIEW COMMITTEES
8720. Review committees.
The board, when it deems necessary, may establish land surveyors review committees to hear all matters assigned
by the board, including, but not limited to, any contested case which is assigned by the board. Each committee shall
exist so long as the board deems that it is necessary.
8720.L Committee appointments; qualifications.
Each review committee shall consist of no fewer than three licensed land surveyors appointed by the board. Each
member of a committee shall have the same qualifications and shall be subject to the same rules and regulations as if
he were a member of the board.
8720.2, Committee members; per diem and expenses.
Each member of a committee shall receive a per diem and expenses as provided in Section 103.
87203. Conduct of hearings; presence of hearing ofTicer.
Except as otherwise provided in this article, all hearings which are conducted by a committee shall be conducted
in accordance with the provisions of Chapter 5 (commencing with Section 11500), Part 1, Division 3, Title 2 of the
Govemment Code.
If a contested case is heard by a committee, the hearing officer who presided at the hearing shall be present during
the committee's consideration of the case and, if requested, shall assist and advise the committee.
8720.4. Committee proposed decisions; transmittal to board.
At the conclusion of any hearing which is conducted by a committee, the committee shaU prepare a proposed
decision, in such form that it may be adopted by the board as the decision in the case, and shall transmit it to the board.
The proposed decision shall be subject to the same procedure as the proposed decision of a hearing officer under
subdivision (b) and (c) of Section 11517 of the Govemment Code.
8720.5. Rules and regulations.
The board may adopt, amend, or repeal, in accordance with the provisions of Chapter 4.5 (commencing with Section
11371), Part 1, Division 3, Title 2 of the Govemment Code, such mles and regulations as are necessary to implement
the provisions of this article.
8720.6. Committee immunity.
Each member of a land surveyors review committee or other board-appointed committee and any board-appointed
representative of the board shall be granted the same immunity as is granted to a public employee pursuant to Article 3
(commencing with Section 820) of Chapter 1 of Part 2 of Division 3.6 of Title 1 of the Govemment Code.

ARTICLE 3. APPLICATION OF THE CHAPTER
8725. Necessity of license.
Any person practicing, or offering to practice, land surveying in this State shall submit evidence that he or she is
qualified to practice and shall be licensed under this chapter.
It is unlawful for any person to practice, offer to practice, or represent himself or herself, as a land surveyor in this
state, or to set, reset, replace, or remove any survey monument on land in which he or she has no legal interest, unless
he or she has been licensed or specifically exempted from licensing under this chapta.

8726. Land surveying defined.
A person, including any person employed by the state or by a city, county, or city and county within the state,
practices land surveying within the meaning of this chapter who, either in a public or private capacity, does or offers to
do any one or more of the following:

(a) Locates, relocates, establishes, reestablishes, or retraces the alignment or elevation for any of the fixed works
embraced within the practice of civil engineering, as described in Section 6731.
(b) Determines the configuration or contour of the earth's surface, or the position of fixed objects thereon or
related thereto, by means of measuring lines and angles, and applying the principles of trigonometry or photogrammetry.
(c) Locates, relocates, establishes, reestablishes, or retraces any property line or boundary of any parcel of land,
right-of-way, easement, or alignment of those lines or boundaries.
(d) Makes any survey for the subdivision or resubdivision of any tract of land. For the purposes of this subdivision,
the term "subdivision" or "resubdivision" shall be defined to include, but not limited to, the definition in the Subdivision
Map Act (Division 2 (commencing with Section 66410) of Title 7 of the Govemment Code) or the Subdivided Lands
Law (Chapter 1 (commencing with Section 1 IOOO) of Part 2 of Division 4 of the Business and Professions Code).
(e) By the use of the principles of land surveying determines the position for any monument or reference point
which marks a property line, boundary or comer, or sets, resets, or replaces any such monument or reference point.
(f) Geodetic or cadastral surveying.
(g) Determines the information shown or to be shown on any map or document prepared or fumished in connection
with any one or more of the functions described in subdivisions (a), (b), (c), (d), (e), and (Q.
(h) Indicates, in any capacity or in any manner, by the use of the title "land surveyor" or by any other title or by
any other representation that he or she practices or offers to practice land surveying in any of its branches.
(i) Procures or offers to procure land surveying work for himself, herself, or others.
(j) Manages, or conducts as manager, proprietor, or agent, any place of business from which land surveying work
is solicited, performed or practiced.
(k) Coordination of the work of professional, technical, or special consultants in connection with the activities
authorized by this chapter.
(1) Determines the information shown or to be shown within the description of any deed, tmst deed, or other title
document prepared for the purpose of describing the limit of real property in connection with any one or more of the
functions described in subdivisions (a) to (f), inclusive.
(m)' Creates, prepares, or modifies electronic or computerized data in lhe performance ofthe activities described
in subdivisions (a), (b). (c). (d). (e). (f). (k) and (I).
Any department or agency of the state or any city, county, or city and county which has an unregistered person in
responsible charge of land surveying work on the effective date of the amendments made to this section at the 1984-85
Regular Session of the Legislature shall be exempt from the requirement that the person be licensed as a land surveyor
until such time as the person currently in responsible charge is replaced.
The review, approval, or examination by a govemmental entity of documents prepared or performed pursuant to
this section shall be done by, or under the direct supervision of, a person authorized to practice land surveying.

8726.1. Licensed Land Surveyor; incidental civil engineering work; restrictions.
Any licensed land surveyor may offer to practice, procure, and offer to procure civil engineering work incidental
to his or her land surveying practice, even though he or she is not authorized to perform such work, provided all such
civil engineering work is performed by or under the direction of a registered civil engineer. Further, any licensed land
surveyor may manage or conduct as manager, proprietor, or agent, a land surveying practice v/hich offers to practice,
procure, and offers to procure, such incidental civil engineering work.
8726.2. Authority to perform land planning
A licensed land surveyor may also perform land planning in connection with the land surveying activities authorized
by this chapter.

8727. Geologic or Landscape surveys excepted.
Surveys made exclusively for geological or land.scaping purposes, which do not involve the detemiination of any
property line do not constitute surveying wiihin the meaning of this chapter.
8728. Restriction on design.
Surveys authorized under this chapter do not include the design, either in whole or in part, ofany stmcture or fixed
works embraced within the practice of civil engineering.

(b) The county surveyor or the city engineer, as the case may be, or other public official or employee qualified
and authorized to perform the functions of either, shall complete and file with his or her legislative body his or her
certificate or statement, as required by this section, within 20 days from the time the final map is submitted to him or
her by the subdivider for approval.

66443. Other certificates and acknowledgements required by local ordinance
In addition to the certificates, statements and acknowledgments required herein for final maps, the maps shall
contain other certificates and acknowledgments as are required by local ordinance.

ARTICLES. PARCEL MAPS
66444. Content and form of parcel maps
The content and form of parcel maps shall be govemed by the provisions of this article.
66445. Persons qualified and standards for preparation of parcel maps
The parcel map shall be prepared by, or under the direction of. a registered civil engineer or licensed land surveyor,
shall show the location of streets and property lines bounding the property, and shall conform to all of the following
provisions:
(a) It shall be legibly drawn, printed or reproduced by a process guaranteeing a permanent record in black on
tracing cloth or polyester base film. Certificates or statements, affidavits, and acknowledgments may be legibly stamped
or printed upon the map with opaque ink. If ink is used on polyester base film, the ink surface shall be coated with a
suitable substance to assure permanent legibility.
(b) The size of each sheet shall be 18 x 26 inches. A marginal line shall be drawn completely around each sheet,
leaving an entirely blank margin of one inch. The scale of the map shall be large enough to show all details clearly and
enough sheets shall be used to accomplish this end. The particular number of the sheet and the total number of sheets
comprising the map shall be stated on each of the sheets, and its relation to each adjoining sheet shall be clearly shown.
(c) Each parcel shall be numbered and each block may be numbered or lettered. Each street shall be named or
otherwise designated.
(d) (1) The exterior boundary of the land included within the subdivision shall be indicated by distinctive
symbols and clearly so designated.
(2) The map shall show the location of each parcel and its relation to siirrounding surveys. If the map includes a
"designated remainder" parcel or similar parcel, and the gross area of the "designated remainder" parcel or similar parcel
is five acres or more, that remainder parcel need not be shown on the map and its location need not be indicated as a
matter or survey, but only by deed reference to the existing boundaries of the remainder parcel.
(3) A parcel designated as "not a part" shall be deemed to be a "designated remainder" for purposes of this section.
(e) Subject to the provisions of Section 66436, a statement, signed and acknowledged by all parties having any
record title interest in the real property subdivided, consenting to the preparation and recordation of the parcel map is
required, excepl that less inclusive requiremenls may Ix' provided by local ordinance.
With respect to a division of land into four or fewer parcels, where dedications or offers of dedications are not
required, the statement shall be signed and acknowledged by the subdivider only. If the subdivider does not have a record
title ownership interest in the property to be divided, the local agency may require that the subdivider provide the local
agency with satisfactory evidence that the persons with record title ownership have consented to the proposed division.
For puiposes of this paragraph, "record title ownership" shall mean fee title of record unless a leasehold interest is to
be divided, in which case "record title ownership" shall mean ownership of record of the leasehold interest. "Record
title ownership" does not include ownership of mineral rights or other subsurface interests which have been severed
from ownership of the i^urface.
(0 Notwithstanding any other provision of ihis article, local agencies may require that those statements and
acknowledgments required pursuant to subdivision (e) be made by .separate instmment to be recorded concurrently with
the parcel map being filed for record.

additional pubUc faciUties fee adopted by the City Council on April 22, 1986, and any
development fees estabUshed by me City Council pursuant to (Drdinance No. 9791 or
subsequent ordinance adopted to implement a growth or development management system
or pubUc fadHties phasing plan to fulfill the subdivider's agreement to pay the pubUc
facflities fee dated May 30, 1989, a copy of which is on file with the City Clerk and is
incorporated by this reference. If the fees are not paid, this appUcation will not be
consistent with the General Plan and approval for this project shall be void.
