This time limit can only be extended by the mutual concurrence of the Applicant and the City. By accepting applications for Tentative Parcel Maps concurrently with applications for other approvals which are prerequisites to the Map (i.e., Environmental Assessment, Environmental Impact Report, Condominium Plan, Planned Unit Development, etc.)» the fifty (50) day time limits are often exceeded. If you wish to have your application processed concurrently, this agreement must be signed by the Applicant or his agent. This project is also approved under the express condition that the appHcant pay the additional pubUc facihties fee adopted by the City Coimcil on April 22, 1986, and any development fees estabhshed by me City Council pursuant to (Drdinance No. 9791 or subsequent ordinance adopted to implement a growth or development management system or public facilities phasing plan to fulfill the subdividefs agreement to pay the public facilities fee dated May 30, 1989, a copy of which is on file vvith the City Clerk and is incorporated by this reference. If the fees are not paid, this application will not be consistent with the General Plan and approval for this project shall be void. 11. The developer shall submit approval of the Califomia State Coastal Commission prior to parcel map approval. 12. The developer shall enter into an agreement to pay fees for undergrounding of all existing overhead utihty lines along the boundaty of the subdivision prior to final parcel map approval. 13. This project has been reviewed for conformancy with the grading ordinance and found to be a project for which a grading permit is required. Prior to any building permits being issued for the site a gradmg plan in conformance with City Standards and Section 11.06 of the Carlsbad Mmucipal Code must be submitted, approved and grading work must be completed to the satisfaction of the City Engineer. The developer shaU obtain a grading pennit prior to the commencement of any clearing or grading of the site. 15. The grading for this project is defined as "controUed grading" by Section 11.06.170(a) of the Carlsbad Municipal Code. Grading shaU be performed under the observation of a civU engineer whose responsibiUty it shaU be to coordinate site inspection and testing to ensure compUance of the work with the approved grading plan, submit required reports to the City Engineer and verify compUance with Chapter 11.06 of the Carlsbad Mumcipal Code. 16. A separate grading plan shaU be submitted and approved and a separate grading permit issued for tne bonow or disposal site if located within the city limits. 17. Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shaU submit to and receive approval form the City Engineer for the proposed haul route. The developer shaU comply with cdl conditions and requirements the City Engineer may impose with regards to the hauling operation. 18. Additional drainage easements and drainage structures shaU be provided or instaUed as may be required by the City Engineer. 19. SDP 89-5, TO DEVELOP A FOUR UNIT CONDOMINIUM PROJECT ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF HEMLOCK AVENUE BETWEEN GARFIELD STREET AND THE AT&SF RAILWAY. APPLICANT: HEMLOCK I CASE NO; SDP 89-5 WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Planning Ccmmission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Planning Commission did, on the 18th day of October, 1989, consider said request on property described as: The southerly 105 feet of lot 2, clock "R" of Palisades No. 2 and the northeasterly 50 feet of the southeasterly 115 feet of lot 1 in block "R" of Palisades No. 2, in the City of Carlsbad, County of San Diego, State of California, according to the Map No. 1803, filed August 25, 1924. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to SDP 89-5. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission APPROVES SDP 89-89-5, based on the following findings and subject to the following conditions: Findings: 1. As discussed in the Staff Report, the project is in compliance with the development standards of the R-3 Zone, the Beach Area Overlay Zone and the Planned Development Ordinance. 9 2. As discussed in the Staff Report, the project is in compliance with the design criteria of the North Beach Study and the Planned Development Ordinance. 3. The project is in compliance with the Mello II Local Coastal Program, as discussed in the Staff Report. 4. The project is consistent with the City's General Plan since the proposed density of 12.9 du's/acre is below the density range of 15-23 du's/acre specified for the site as indicated on the Land Use Element of the General Plan, and is below the growth control point of 19.0. 5. The site is physically suitable for the type and density of the development since the site is adequate in size and shape to accommodate residential development at the density proposed. 6. The Planning Commission has, by inclusion of an appropriate condition to this project, ensured building permits will not be issued for a project unless the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service is available, and building cannot occur within the project unless sewer service remains available, and the Planning Commission is satisfied that the requirements of the Public Facilities Element of the General Plan have been met insofar as they apply to sewer service for this project. 7. School fees will be paid to ensure the availability of school facilities in the Carlsbad School District. 8. Park-in-lieu fees are required as a condition of approval. 9. All necessary public improvements have been provided or will be required as conditions of approval. 10. The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General Plan. 11. The proposed project is consistent with the City's Planned Development Ordinance and also complies with the Design Guidelines Manual. 12. The proposed project is compatible with the surrounding future land uses since surrounding properties are designated for residential development on the General Plan. 13. This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Planning Director on July 26, 1989 and approved by the Planning Commission on October 18, 1989. In approving this Negative Declaration the Planning Commission has considered the initial study, the staff analysis, all required mitigation measures and any written comments received regarding the significant effects this project could have on the environment. If the fees are not paid this application will not be consistent with the General Plan and approval for this project will be void. The applicant shall pay park-in-lieu fees to the City, prior to the approval of the final parcel map as required by Chapter 20.44 of the Carlsbad Municipal Code. The applicant shall provide school fees to mitigate conditions of overcrowding as part of building permit application. These fees shall be based on the fee schedule in effect at the time of building permit application. Water shall be provided to this project pursuant to the Water Service agreement between the City of Carlsbad and the Carlsbad Municipal Water District, dated May 25, 1983. This project shall comply with all conditions and mitigation required by the Zone 1 Local Facilities Management Plan approved by the City Council on September 1, 1988, incorporated herein and on file in the Planning Department and any future amendments to the Plan made prior to the issuance of building permits.
