The project involved is described as subdivision one 26,000 square foot residential lot into two residential lots. Final parcel map shall comply with the Land Use Planning Office interdepartmental memorandum for Minor Subdivision No. 815, dated July 18, 1989. (copy included) 0^ This project is approved upon the express condition that building permits will not ^ be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. All required fees and deposits shall be paid prior to final parcel map recordation. (See attached list.) 7. The tentative parcel map approval shall expire two (2) years from the date of the letter containing the final decision for tentative map approval. 8. The applicant may request a review of the conditions in writing within ten (10) days of the date of this approval. 9. All lots within this project shall conform to current Zoning Ordinance (Title 21) with respect to size, setbacks, and land use. 10. The developer shall pay the local Drainage Area Fee prior to approval of the final map. Area No. 7. ILy The applicant shall pay park-in-lieu fees to the City prior to the approval of the final map as required by Chapter 20.44 of the Carlsbad Municipal Code. Prior to approval of the parcel map the subdivider shall install, or agree to install and secure with appropriate security as provided by law, improvements shown on the tentative map and the following improvements to City Standards to the satisfaction of the City Engineer: A. James Drive 1/2 street plus 12' along this project frontage and extending north to existing improvements. B. Relocation of existing sewer lateral that services Parcel 1. C. Extension of watermain and other utilities to serve Parcel 2. Park Drive 1/2 width (34') along the project frontage, including offsite transitions. A note to this effect shall be placed on the parcel map. " •— ' 14. James Drive shall be dedicated by the developer along the subdivision frontage based on a full to right-of-way width of 60' feet and in conformance with City of Carlsbad Standards prior to occupancy of any buildings. The offer shall be made by a Certificate on the Parcel Map. All land so offered shall be granted to the City free and clear of all liens and encumbrances and without cost to the City. Streets that are already public are not required to be rededicated. 15. Prior to approval of the parcel map the strip of land along the westerly side of Parcel 2 shall be quitclaimed and incorporated into this subdivision. 16. This project is also approved under the express condition that the applicant pay the additional public facilities fee adopted by the City Council on April 22, 1986, and any development fees established by the City Council pursuant to Ordinance No. 9791 or subsequent ordinance adopted to implement a growth or development management system or public facilities phasing plan to fulfill the subdivider's agreement to pay the public facilities fee dated June 26, 1989, a copy of which is on file with the City Clerk and is incorporated by this reference. If the fees are not paid, this application will not be consistent with the General Plan and approval for this project shall be void. 17. Prior to approval of the final map the developer shall enter into an agreement with the City to pay any drainage area fees established as a result of the forthcoming Master Drainage Plan Update. 18. The developer shall enter into an agreement to pay fees for undergrounding of all existing overhead utility lines along the boundary of the subdivision prior to parcel map approval. 19. The owner of the subject property shall execute a hold harmless agreement regarding drainage across the adjacent property prior to approval of the parcel map for this project. Unless a standard variance has been issued, no variance from City Standards is authorized by virtue of approval of this parcel map. 21. The developer shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. 22. The subdivision of this property as proposed was part of the calculation for the dwelling unit limitation. 2) The density of the project complies with the dwelling unit projections of Zone 1 which demonstrated that sufficient developments in Zone 1 have been approved , below the density control points which are necessary to ensure compliance with the dwelling unit limitation of City Council Resolution No. 8703 and Proposition E. 3) Sufficient public facilities to serve the density of the project are being provided so that the City's public facilities plans will not adversely impacted. We find that an extension can be granted. Pursuant to Carlsbad Municipal Code Section 20.24.180 (b), the tentative parcel map, MS 815 shall not expire October 24, 1991 but shall be extended until October 24, 1992 subject to the original conditions of approval dated September 22,1989, as amended November 15,1989 and subject to the following additional condition: "Prior to approval of any grading or building permits for this project, the owner shall give written consent to the annexation of the area shown within the boundaries of the site plan into the existing City of Carlsbad Street Lighting and Landscaping District No. 1.
