NOTICE OF FILING OF TENTATIVE PARCEL MAP
MINOR SUBDIVISION NO. MS 99-06
Notice is hereby given that a Tentative Parcel Map has been filed on property generally located
at 3210 Highland Drive and more particularly described as that portion of Lot 25 of Patterson's
Addition, in the City of Carlsbad, County of San Diego, State of California, according to map
thereof No. 565, filed in the Office of the County Recorder of San Diego County, September
22, 1888, described as follows: Commencing at the northwesterly corner of Tract 123 of
Carlsbad Lands, in the City of Carlsbad, County of San Diego, State of California, running
thence northerly on the easterly boundary line of Highland Street a distance of 60 feet to the
true point of beginning; continuing thence northerly along said easterly boundary line of said
Highland Street a distance of 60 feet to the true point of beginning; continuing thence northerly
along said easterly boundary line of said Highland Street a distance of 60 feet to a point:
thence easterly in a line parallel with the northerly line of said Tract 123 a distance of 400 feet
to a point; thence southerly in a line parallel with the easterly boundary line of said Highland
Street a distance of 60 feet to a point; thence westerly in a line parallel with the northerly
boundary line of said Tract 123 a distance of 400 feet to the true point of beginning.
The project involved is described as a subdivision of a 24,000 square foot lot into two lots. One
lot will front Highland Drive, the other James Drive.

STATEMENT OF THE MATTER: This project is a minor subdivision (four units or less), which
by subdivision ordinance, does not require a public hearing. A minor subdivision is processed
by the City staff and must comply with all applicable codes, regulations, and zoning.
Each property owner may request, in writing, the opportunity to be heard on the Tentative
Parcel Map. Such written request must be filed with the City Engineer within fifteen (1 5) days
of this notice. Failure to so file shall be deemed a waiver of your rights with regard to this
matter. Your comments and suggestions are appreciated.

PROPOSED MINOR SUBDIVISION NO. MS 99-06, POORE MINOR SUBDIVISION
A preliminary decision has been made, pursuant to Section 20.24.120 of the City of Carlsbad
Municipal Code, to approve the tentative parcel map of the proposed minor subdivision subject
to conditions that follow in this letter.
Unless specifically stated in the condition, all of the following conditions, upon the approval of
this tentative parcel map, must be met prior to approval of a final parcel map.
1. Prior to issuance of any building permit, the developer shall comply with the
requirements of the City's anti-graffiti program for wall treatments if and when such a
program is formerly established by the City.
2. The owner shall enter into a lien contract with the City for the future public improvement
of Highland Drive along the subdivision frontage for a half street width of thirty feet.
Public improvements shall include but not be limited to paving, base, sidewalks, curbs
and gutters, medians, grading, clearing and grubbing, undergrounding or relocation of
utilities, sewer, water, fire hydrants, street lights and retaining walls.
3. The developer shall provide the City with the approved tentative parcel map. The map
shall be to scale on a reproducible 24" x 36" xerox mylar or photo mylar. It shall reflect
the conditions of approval by the City. The reproducible shall be submitted to the City
Engineer, reviewed and signed by the City's project engineer and project planner prior to
submittal of the building plans, final map, improvement or grading plans, whichever
occurs first
4. The developer shall defend, indemnify and hold harmless the City and its agents, officers,
and employees from any claim, action or proceeding against the City or its agents,
officers, or employees to attack, set aside, void or null an approval of the City, the
Planning Commission or City Engineer which has been brought against the City within
the time period provided for by Section 66499.37 of the Subdivision Map Act.
5. The net developable acres shall be shown for each parcel.

6. The developer shall pay all current fees and deposits required.
7. The owner of the subject property shall execute an agreement holding the City harmless
regarding drainage across the adjacent property.
8. Prior to approval of any grading or building permits for this project, the owner shall give
written consent to the annexation of the area shown within the boundaries of the
subdivision into the existing City of Carlsbad Street Lighting and Landscaping District
No. 1 on a form provided by the City.
9. Additional drainage easements may be required. Drainage structures shall be provided or
installed prior to or concurrent with any grading or building permit as may be required by
the City Engineer.
10. The owner shall grant a covenant of easement for the 5 foot wide drainage easement as
shown on the tentative parcel map. The covenant of easement shall be shown and
recording information called out on the parcel map.
Parcel Map Notes
11. Note(s) to the following effect(s) shall be placed on the parcel map as non-mapping data:
12a. Building permits will not be issued for development of the subject property unless
the District Engineer determines that sewer facilities are available.
Code Reminder
12. The tentative parcel map approval shall expire twenty-four (24) months from the date of
the letter containing the final decision for tentative parcel map approval.
Planning
13. The Developer shall pay his fair share for the "short-term improvements" to the El
Camino Real/Palomar Airport Road intersection prior to the issuance of a building
permit. The amount shall be determined by the methodology ultimately selected by
Council, including but not limited to, an increase in the city-wide traffic impact fee; an
increased or new Zone 1 LFMP fee; the creation of a fee or assessment district; or
incorporation into a Mello-Roos taxing district.
Water District
14. The developer/owner shall meet with the District's Project Engineer to discuss potable
water meter and sewer lateral locations. These improvements must be shown on an
approved set of design plans to be signed by the District Engineer.

15. The developer/owner must establish in cooperation with the District the areas required to
be irrigated with recycled water, if any.
The developer may request a review of the preliminary decision with the City Engineer in
writing within ten (10) days of the date of this letter. Upon such written request the City
Engineer shall arrange a time and place with the developer for such review.
The City Engineer has reviewed each of the exactions imposed on the developer contained in
these conditions of approval, and hereby finds, in this case, that the exactions are imposed to
mitigate impacts caused by or reasonably related to the project, and the extent and degree of the
exaction is in rough proportionality to the impact caused by the project.

Whereas no review of the conditions of the letter of preliminary approval was requested
by the appropriate date; and whereas the requirements of the California Environmental
Quality Act and the City of Carlsbad Environmental Protection Ordinance of 1973
relating to the subject proposed parcel map have been examined by the Planning
Director and declared to have a non-significant impact upon the environment; and
whereas negative findings delineated by Section 20.24.130 of the Carlsbad Municipal
Code have not been made; and whereas this minor subdivision is found to be in
conformity with the General Plan of the City of Carlsbad; therefore, a final decision has

Per the property owner's request, attached is a proposed alteration to form clarifying the
reason for releasing the lien for future public improvements. There are various ways in
which such a lien can be satisfied. Payment in cash to the City for the lien amount,
installation of the improvements, replacing the Contract for Future Public Improvements
with a Neighborhood Improvement Agreement, or abandoning requirements for street
improvements are the more common ways. The property owner would like to add the
reason for the release since the recorded document has greater security than file
documents as file documents are more prone to being lost. A recorded document also
provides adequate disclosure to prospective buyers of the property.
This change, shown in highlight, is only being proposed on this particular release to
satisfy the owners' concern. Please let David Rick know if there is any issue with the
proposed changes.

Did you receive my voice mail? The "Release Of Lien" is sufficient for the
Title Company Underwriter, but is a little lacking for us. Is it possible to
get a document recorded that is more specific as to the condition of release?
One that would specify that a FEE OF $13,000.00 WAS PAID, BY THE RUTH GILL
BARKER LIVING TRUST, ON DECEMBER 24, 2001, TO THE CITY OF CARLSBAD FOR FUTURE
CONSTRUCTION OF SIDEWALK, CURB AND GUTTER ALONG WITH ASSOCIATED PAVING TO 60
FEET OF FRONTAGE OF 3210 HIGHLAND DRIVE, CARLSBAD, CALIFORNIA. As it is
written and recorded now, one does not know whether improvement have been

Dear Ms. Poore:
We received your request to record a second document on the property title to address
the issues outlined in your letter. After reviewing the language in the original "Contract
for Future Public Improvement Agreement (FIA)" and "Notice of Release of Lien for
Future Public Improvement" agreement, we concluded that there is no need to establish
a new document for recordation as the issues listed have already been addressed. The
release document (unsigned copy enclosed) refers to the original document and states
that it "has been satisfied and is hereby released". Regardless of how the FIA has been
satisfied, the fact that the FIA as been satisfied and is released precludes the City from
obtaining additional money or requiring installation of frontage improvements on
Highland Drive at anytime in the future. Two documents will appear on the property title
providing a clear "paper trail" of the release: the original FIA and the "Notice of Release
of Lien for Future Public Improvements". A copy of the receipt of payment along with the
payer name and finance department receipt number and date will remain on file in the
City.
In addition, the old APN and new APN is listed on the Notice of Release of Lien.
Furthermore, the legal description of the original parcel is a part of the referenced FIA.
By default, the FIA applies to both Parcel A and B created by the map (MS 99-06)
recorded subsequent to recordation of the FIA.
I placed a note to the City Clerk to contact your Title Officer to hand deliver the lien
release to the County Recorders Office. Having your title officer deliver the document
