MINOR SUBDIVISION NO. MS 99-07
Notice is hereby given that a Tentative Parcel Map has been filed on property generally
located on the north side of Navarra Drive west of Viejo Castilla Way and more particularly
described as Lot 56 of La Costa South Unit No. 1 in the County of San Diego, State of
California, according to the map thereof No. 6117, filed in the Office of the County
Recorder of San Diego County.
The project involved is described as a new 4-plex condominium.
APPLICANT: American United Development Corp., a California corporation
STATEMENT OF THE MATTER: This project is a minor subdivision (four units or less),
which by subdivision ordinance, does not require a public hearing. A minor subdivision is
processed by the City staff and must comply with all applicable codes, regulations, and
zoning.
Each property owner may request, in writing, the opportunity to be heard on the Tentative
Parcel Map. Such written request must be filed with the City Engineer within fifteen (15)
days of this notice. Failure to so file shall be deemed a waiver of your rights with regard to

Whereas no review of the conditions of the preliminary approval letter was requested by
the appropriate date; and whereas the requirements of the California Environmental
Quality Act and the City of Carlsbad Environmental Protection Ordinance of 1973

SUBJECT: NAVARRA MINOR SUBDIVISION (MS 99-07)
The City has completed a review of the application for a 4-unit condominium
development on Navarra Drive (APN 216-170-35).
The City Engineer has made a preliminary decision pursuant to Section 20.24.120 of
the City of Carlsbad Municipal Code, to approve the tentative parcel map of the
proposed minor subdivision, subject to conditions that follow in this letter.
Below we have summarized the findings and conditions for the above project:
FINDINGS
1. That the Planning Director has determined that theproject belongs to a class of
projects that the State Secretary for Resources has found do not have a significant
impact on the environment, and that it is therefore categorically exempt from the
requirement for the preparation of environmental documents pursuant to Section
15303(b) - New Construction or Conversion of small structures - of the state
CEQA Guidelines. In making this determination the Planning Director has found
that the exceptions listed in Section 15300.2 of the State CEQA Guidelines do not
apply to this project.
2. Whereas the City Engineer has found that the proposed map and the proposed
design and improvement of the subdivision as conditioned, is consistent with and
satisfies all requirements of the General Plan, any applicable specific plans, Titles
20 and 21 of the Carlsbad Municipal Code and the State Subdivision Map Act, and
will not cause serious public health problems, in that the 4-unit condominium is
consistent with the surrounding development of multi-family apartment and
condominium projects; that the site is physically suitable for the type and density
of the development since the site is adequate in size and shape to accommodate
residential development at the density proposed, in that the project is consistent
with the Residential High (RH) land use designation, and the project is
consistent with the Housing Element; that the design of the subdivision or the
type of improvements will not conflict with easements of record or easements
established by court judgment, or acquired by the public at large, for access through

or use of property within the proposed subdivision, in that no easements of record
were listed on the preliminary title report on the project; that the discharge of
waste from the subdivision will not result in violation of existing California Regional
Water Quality Control Board requirements, in that the project is required to
comply with the conditions related to the discharge of pollutants.
Therefore, the City Engineer hereby approves the proposed tentative parcel map
subject to the conditions set forth in the preliminary approval letter.
CONDITIONS
Unless specifically stated in the condition, all of the following conditions,
upon the approval of this tentative parcel map, must be met prior to
approval of a final parcel map, building permit, or grading permit.
General
1. This approval is granted, provided the applicant complies with all conditions
pursuant to CP 99-13.
2. Prior to hauling dirt or construction materials to or from any proposed
construction site within this project, Developer shall apply for and obtain approval
from, the City Engineer for the proposed haul route.
3. Prior to issuance of any building permit, Developer shall comply with the
requirements of the City's anti-graffiti program for wall treatments if and when
such a program is formally established by the City.
4. Developer shall submit to the City Engineer, a reproducible 24" x 36", mylar copy
of the tentative map reflecting the conditions approved by the final decision
making body (including any applicable Coastal Commission approvals). The
reproducible shall be submitted to the City engineer, reviewed and, if acceptable,
signed by the City's project engineer and project planner prior to submittal of the
building plans, final map, improvement or grading plans, whichever occurs first.
5. Developer shall and does hereby agree to indemnify, protect, defend and hold
harmless the City of Carlsbad, its Council members, agents, officers, and
representatives, from and against any and all liabilities, losses, damages,
demands, claim and costs, including court costs and attorney's fees incurred by
the City arising, directly or indirectly, from (a) City's approval and issuance of this
tentative parcel map, (b) City's approval or issuance of any permit or action,
whether discretionary or non-discretionary, in connection with the use
contemplated herein, including an action filed within the time period specified in
Government Code Section 66499.37 and (c) Developer's installation and
operation of the facility permitted hereby, including without limitation, any and all
liabilities arising from the emission by the facility of electromagnetic fields or
other energy waves or emissions.

6. Developer shall provide to the City Engineer, an acceptable means via CC&Rs
and/or other recorded document, for maintaining the private easements within
the subdivision and all the private improvements: driveways, sidewalks, and
storm drain facilities located therein and to distribute the costs of such
maintenance in an equitable manner among the owners of the properties within
the subdivision.
7. Prior to occupancy, Developer shall install rain gutters to convey roof drainage to
an approved drainage course or street to the satisfaction of the City Engineer.
8. There shall be one Final Parcel Map recorded for this project.
Fees/Agreements
9. Developer shall cause property owner to execute and submit to the City Engineer
for recordation, the City's standard form Geologic Failure Hold Harmless
Agreement.
10. Developer shall cause property owner to execute and submit to the City Engineer
for recordation the City's standard form Drainage Hold Harmless Agreement
regarding drainage across the adjacent property.
11. Prior to approval of any grading or building permits for this project, Developer
shall cause Owner to give written consent to the City Engineer to the annexation
of the area shown within the boundaries of the subdivision into the existing City
of Carlsbad Street Lighting and Landscaping District No. 1, on a form provided
by the City Engineer.
Dedications/Improvements
12. Developer shall comply with the City's requirements of the National Pollutant
Discharge Elimination System (NPDES) permit. Developer shall provide
improvements constructed pursuant to best management practices as
referenced in the "California Storm Water Best Management Practices
Handbook" to reduce surface pollutants to an acceptable level prior to discharge
to sensitive areas. Plans for such improvements shall be submitted to and
subject to the approval of the City Engineer. Said plans shall include, but not be
limited to notifying prospective owners and tenants of the following:
A. All owners and tenants shall coordinate efforts to establish or work with
established disposal programs to remove and properly dispose of toxic
and hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other
such fluids shall not be discharged into any street, public or private, or into
storm drain or storm water conveyance systems. Use and disposal of

pesticides, fungicides, herbicides, insecticides, fertilizers and other such
chemical treatments shall meet Federal, State, County and City
requirements as prescribed in their respective containers.
C. Best Management Practices shall be used to eliminate or reduce surface
pollutants when planning any changes to the landscaping and surface
improvements.
Final Map Notes
13. Developer shall show the net developable acres for each parcel on Final Parcel
Map.
14. Note(s) to the following effect(s) shall be placed on the map as non-mapping
data:
A. Building permits will not be issued for development of the subject property
unless the appropriate agency determines that sewer and water facilities
are available.
B. Geotechnical Caution:
1. Slopes steeper than two parts horizontal to one part vertical exist
within the boundaries of this subdivision.
2. The owner of this property on behalf of itself and all of its
successors in interest has agreed to hold harmless and indemnify
the City of Carlsbad from any action that may arise through any
geological failure, ground water seepage or land subsidence and
subsequent damage that may occur on, or adjacent to, this
subdivision due to its construction, operation or maintenance.
Water
15. Prior to Final Map approval, Developer shall install a total of 5 water meters
for the project. Separate meters shall be provide for each unit (4 total), and
1 meter shall be to irrigate the common areas (Homeowner's Association).
A common water service line with a manifold to the 5 meters (as shown on
the Tentative Map) may be permitted if the existing service line is at least 2-
inches. If the service is not at least 2-inches, then additional service lines
shall be installed to the satisfaction of the District Engineer.
16. Water and sewer laterals shall not be located in driveways, unless
specifically approved by the City Engineer or District Engineer.

17. Prior to issuance of building permits or Final Parcel Map approval,
Developer shall provide evidence from the Leucadia County Water District
that adequate sewer services have been provided to each unit proposed by
this Tentative Map. Such evidence shall be provided to the satisfaction of
the City Engineer.
Code Reminder
The project is subject to all applicable provisions of local ordinances, including but not
limited to the following:
18. The tentative map shall expire twenty-four (24) months from the date this
tentative map approval becomes final.
19. Developer shall exercise special care during the construction phase of this
project to prevent offsite siltation. Planting and erosion control shall be provided
in accordance with Carlsbad Municipal Code Chapter 15.16 (the Grading
Ordinance) to the satisfaction of the City Engineer.
Developer may request a review of this preliminary decision with the City Engineer in
writing within ten (10) days of the date of this letter. Upon receipt of such written
request, the City Engineer shall arrange a time and place with Developer for such
review.
The City Engineer has reviewed each of the exactions imposed on Developer contained
in these conditions of approval, and hereby finds, in this case, that the exactions are
imposed to mitigate impacts caused by or reasonably related to the project, and the
extent and degree of the exaction is in rough proportionality to the impact caused by the
project.

NAVARRA MINOR SUBDIVISION (MS 99-07)
Dear Mr. Jacinto:
Prior to final determination by the City Engineer, please address the following
issue:
1. Revise the tentative map to reflect three (3) proposed water and sewer
laterals to be installed for the 4 units. The plan currently reflects one (1)
existing sewer and water laterals. Please note that water and sewer
laterals are not to be located in driveways.
2. Add the record information of the existing drainage and access easement
to the tentative map as noted on the document.
3. Revise the Tentative Map to reflect the edge of the driveway flares located
at least 3-feet from the property line, in accordance with City Standards,
as noted on the document.
Once the above has been completed, provide 3 revised blue-line copies of the
Tentative Map to complete our review and make a final determination. Thank

I apologize for the misunderstanding regarding my October 1, 1999
submittal responding to your September 15, 1999 comments. Apparently all
those documents went to the Planning Department who approved this project
on October 18, 1999. In any event, I am providing two additional copies of
the map for your review and comment as well as additional back up
information. If I may, I'd like to respond to each individual item listed in
your September 15, 1999 letter:
Response to Incomplete Items
1. I provided a copy of the drainage and access easement from Lot 57 for
the benefit of Lot 56.
2. I have also provided an updated tentative map time waiver letter dated
March 6, 2000.
3. The public facility agreement is no longer required.
4. The set back dimensions for the structure is included in the tentative map

Engineering Issues
1. MS 99-07 is shown on the upper right corner of the map.
2. The storm drain/inlet system and size is shown as proposed on the
tentative map.
3. The attached private easement allows for drainage from Lot 56 onto Lot
57 as referenced on the tentative map.
4. Roof downspouts will be tied in to the drainage system and will be
drained to the rear of the property as referenced in the attached hydrology
study prepared by Dudek Engineering and previously reviewed and
approved by Frank Jimeno. A copy should also be included in the file.
5. The drainage swale and rip rap pad on the easterly property is proposed
and it is within the easement limits as shown on the tentative map and the
site plan attached to the drainage letter.
6. The driveway issue was discussed with Planning and the tentative map
includes a median separating the two driveways as approved by Planning.
7. The street light is to remain within the limits of the landscaped area as
shown on the plan.
8. The original red lined print was returned in October when this package
was resubmitted and processed through Planning. Frankly, I don't recall
any significant comments on the plan itself.

We hereby certify that the onsite drainage system for these proposed condominiums have been
designed in accordance with City of Carlsbad and requirements for a 100 year storm event. We
do not anticipate any negative consequences to the La Costa Golf Course which is the outlet to
the onsite flows. A rip rap dissapator is proposed to prevent erosion at the outlet of the concrete
brow ditch.
For our calculations we used a 10 minute time of concentration, a "C" value of 0.70, and a 100
year intensity of 4.72 inches per hour which is consistent with a P6 value of 2.8 inches per hour.
Each lot conveys a flow of 0.95 cfs for a total of 1 .90 cfs in the proposed brow ditch.

Thank you for applying for Land Use Permits within the City of Carlsbad. Engineering
Department staff has reviewed the tentative parcel map, application No. MS 99-07, as to its
completeness for processing. The application and submittal package are considered
incomplete. Staff may, in the course of processing the application, request that you clarify,
amplify, correct, or otherwise supplement the basic information required for the application. In
addition, design issues exist which must be resolved or adequately addressed prior to staff
making a determination to approve or deny the project. The incomplete items and issues of
concern are provided as follows:

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Condominium Permit, application no. CP 99-13, as to its
completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is
information which must be submitted to complete your application. This list of items
must be submitted directly to your staff planner by appointment. All list items must be
submitted simultaneously and a copy of this list must be included with your submittals.

Planning:
1. Please submit a Public Facilities Fee Agreement and $50.00 filing fee.
2. The architectural site plan needs to be revised to include dimensions. Show
setbacks, overall building dimensions, width of planters, width of driveways, etc.
Please revise sheet 2 to show dimensions, unit sizes, and provide a clear
delineation between the units. Show a 20' x 20' clear interior dimension for the
garages. Sheets 3, 4, 5, and 6 may be omitted since most of this information can
be shown on sheet 2.
3. Show the height of the buildings on the elevations (sheets 7 and 8).
4. Show the adjacent structure (to the east) and the path of access to the joint use
stairway.
5. The engineer's plan needs to be revised to show the guest parking spaces as 12' x
20'.

ISSUES OF CONCERN
Planning:
1. The landscape plan needs to be revised to show the locations of proposed fences
and gates. The walkway in the common area should be constructed of concrete.
The concrete pad should be enlarged to accommodate a larger recreational area.
Perhaps you could include a picnic table and bbq area.
2. A joint access and maintenance agreement for common use of the stairway and
driveways will be required as a condition of approval for the project.
3. Joint access between this project and the identical project to the east will not be
approved unless the driveways are revised as one common 30 foot wide driveway.
The 16 foot wide driveway for the Monterrey condominiums was permitted
because it served only two units. The proposed joint access driveways would
1 serve 4 units and therefore would need to meet the minimum driveway width of 30
feet.
