The Subdivi~ion Map Act and the Carlsbad Municipal Code sets a
fifty (50) day t;ime.restriction on Planning Commission processing
of Tentative-Maps ,and a thirty (30) day time limit for 'City
Council action. These time :Limi;ts can only be extended by the
mutual concurrence of the applicant and the City. By acc~pting
applications for Tentative Maps concurre~tly with applications
for other approvals which are prerequisites to the map; i.e.,
Environmental Assessment, Environmental Impg.ct Report, Co.n<iominiurh
Plan, Planned Unit D'evelopment, etc., the fifty (50) day time
limit,~ and the thirty (3-0) day time l;i.mits are often exceeded.,
If you wish to have your application processed 'concurrently,
this agreement must be signed by the applicant or b,is agent. If
you choose not to sign the statement, the City will not accept
your app~ication for the Tentative Map until all prior-necessary
entitlem~nts have been processed a:nd approved.
The' un<iersigned understands that the processing time required by
the'City may exceed the time limits, therefore the Undersigned
agrees to extend the time limits ,for Planning Commission and
City Council action and fully CDncurs with any extensions of

WHEREAS, the Public Facilities Element of the CityGener~l Pla~
requires that the City Council find that all public faciliti~s
necessary to serve a development will be a.ailable concu~tent with
need or such development shall not be approved (said element: is on
file with the City Clerk and is incorporated by this re~*re~c.); add
WHEREAS, Developer and City recognize the cor,rectne'ss of Councii
Policy No. 17, dated April 2, 1982, in file with th,eCity Cler-ic and
incorporated by this reference, and that ~he City's public facilities
and serVlces are at capacity and, will not be av'ailable to accommodate
the additional need for public fa c iIi tie's an,d se r vic e sr e s u 1 t i it g from
the proposed Development; and
WHEREAS, Developer has asked the City to fin~ that public
facilities and services will be available to meet the futute needs of
the Development as it is presently proposed; but the'D~ve~oper is
aware that the City cannot and will not be able to make a~y such
finding without financial assistance to pay for ~u~h sarvice~ and
facilities; and therefore, Developer propo~es to h~lp satisfy the
Ge~eral Plan as implemented by C~uncil Policy No. 17 by p~imentof a
public faciliiies fee.

• NOW, THEREFORE, in consideration of the recitala and ~he
~ovenants contained herein, the parties agree ~s follows:
1. The Developer shall pay to the .Ci,ty a public facilities fee
in an amount not to 'exceed 2% o~ the building pe,rmit, v~lu·a,tion of the
building or structures to be construct.d i,~ ~he Development purauant
to the Request. ·The fee shall be paid prior to,t,he issu:a,n~e of
bu i ld ing or other cons true t ion permi t s for th e 'deve loptl'ent and sha 11
be based on the valuation at that time. this fe~ *hall be in
addition to any fees, dedications or.improvements required purs,uant
to Titles 18, 20 or 21 of th'e Carlsb'ad Munic,ip.l Code. Developer
shall pay a fee for conversion 0 f existing building or str~ctures
into condominiums in an amount not to exceed 2% of the building
permit v~luation at tbe time of conversion. The fee for a
condominium conversion sball be paid prior to the ~ssuance of a
condominium conversion permit as provided in Chapter 21.47 of the
Carlsbad Municipal Code. Condominium ahall include community
apartment or stock cooperative. The term's "other construction

development is intended. Developer shall pay to City a public
facilities fee in the sum of $1,150 for eachmobilehome space ,to ~e
constructed pursuant to the Request. The fee shall be paid ptior to
the issuance of building or other constructiQnper.its for th~
development. This fee shall be in.addition to any fee;:, de.~iications
or impro~ementl required according to Titles 18, 20 or 21 of the
Carlsbad Municipal Code.

3. Th is agreement and the fee paid pursuant hereto are requi.re~
to ensure the consistency of the Development with the City's General
Plan. If the fee' is not paid as provide.d he~e~n, the City will not
have the funds to provide public facilitiesandser·vice., and t~e
development will not be c~naistent ~ith the Gene~al. Plan ~nd any'
approval or permit for the Develo~ment shall be void. Nobui ld ing or·
other construction permit or entitlement for use shall be i,ssued

address as may have been designated, postage prepaid and c.4;!rtified .•
8. This agreement shall be binding upon and shall 'inureto the
benefit· of, and shall apply to, th·e respective su.cces·sors and assigns
of Developer and the City, and references to oeve.lo·per. or dity .herein
shall be deemed to be reference to an~ include their respective
successors and assigns without specific me·ntion of sU'ch succj!ssots

and assigns. If Developer should cease to have any inter~st in the
Property, all obligations of Developer hereundersh~ll terminater
provided, however, that any successor of Developer's i~terest in the
