The project is the construction of a standard 10-foot tennis court fence around the perimeter of a tennis court. This is to be accomplished in accordance with the Carlsbad City specifications on tennis court fencing (see specifications sheet contained in this package). 2. Problem. Of the 348 feet of fencing required, approximately 75 feet will be in the rear setback. This will exceed the 6-foot fence height restriction in setbacks. Unfortunately, the layout and location of the tennis court is constrained to be exactly as shown because of two factors: sewer and sun. A. Sewer. Overlaying the sewer line that divides our yard between east and west is not an option. In the event sewer excavation were required, the expense to repair the court and return it to its former smooth surface would be prohibitive. B. Sun. The United States Tennis Association and the United States Tennis Court and Track Builders Association recommend that courts at this latitude face 338 degrees true. A true northerly heading is acceptable, but any further rotation easterly would make late afternoon play extremely difficult for the player on the north end of the court. This is the time of day, after work, that most play is likely. Hence, in order for the court to be playable and not overlay the sewer line, the layout and location shown is the only acceptable positioning. There is no way to avoid a corner of the court being in the rear setback. If we constructed a 10-foot fence for most of the perimeter and went to a lower height in the setback, both the function of the fence and the aesthetics of the court would suffer. This would detract from the value and the desirability of the court for us and our neighbors. 3. Mitigating Circumstances. A. Open Space. The area to the east of our property, upon which the rear of our lot borders, is owned by Fieldstone Developers and has been designated open space for the city. Mike Stewart, project manager of Fieldstone Properties in this area, conducted an onsite review of the tennis court plans and could see no way that the Cima tennis court fence will adversely affect this open space area (see letter contained in this package). B. Neighbor Preferences. Neighbors on both sides of our property, to the North and South, desire that a fully functional court and fence be constructed, as this will contribute the most to the aesthetics and to property values. Further, because the court elevation will be 8 feet below the existing grade at the Northwest corner, neither of their views will be obstructed in any way (see letters contained in this package). 4. Request. All projects must evaluate their potential impacts on the regional transportation system, including the costs of mitigating the associated impacts, as required by the SANDAG Congestion Management Program (CMP). For projects with an average daily traffic (ADT) generation rate greater than 500 vehicles per day or 200 or more peak-hour vehicle trips: Submit two (2) copies of a Circulation Impact Analysis for the project. The analysis must be prepared by a Registered Traffic Engineer or Registered Civil Engineer. The analysis must show project impacts to all intersections and road segments identified as impacted within the included Local Facilities Management Plan or as otherwise determined in discussions with staff. The following minimum information should be included with the study: a) 8 1/2" x 11" or 8 1/2" x 14" plats showing zone impacted roads, background and project AM and PM peak hour impacts and traffic distribution. b) Project traffic generation rates and traffic assignment c) Necessary calculations and/or analysis to determine intersection and road segment levels of service. d) Any proposed mitigation requirements to maintain the public facility standards. e) On Collector streets and above, an analysis of the need for a traffic signal will be required. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 3611, APPROVING PCD 93-02, based upon the findings contained therein. II. PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting that the Planning Commission permit a 10 foot high chain-link fence on top of a 6 foot high retaining wall in the 20 foot rear yard setback on property located at 2909 Candil Place. The wall and fence would be used to accommodate a tennis court. Of the 348 lineal feet of fencing needed to enclose the court, 75 lineal feet would be in the rear yard setback. Pursuant to Section 21.46.130 of the Zoning Ordinance, neither fences nor walls may exceed 6 feet in height within a rear yard setback. Administrative Policy No. 21 further states that the total combined wall and fence height shall not exceed 6 feet within a rear yard setback. Because the wall would be 6 feet high and the fence would be 10 feet high, the total proposed height is considered 16 feet. Pursuant to Section 21.46.130, however, a fence or wall may exceed 6 feet in any "R" Zone, if the Planning Commission determines that a higher fence or wall is necessary for a special use or circumstance. Although the subject property is located within the PC (Planned Community) Zone rather than an "R" zone, this provision of the code may be applied to the subject property because the applicable specific plan (SP 169) indicates that all development shall comply with the provisions of the R-l Zone. The property currently contains a single family home located in a low density residential neighborhood. The property abuts a vacant lot to the north, a single family home to the south, and the San Marcos Creek and Canyon to the east which are designated as Open Space on the City's land use map. Six hundred forty (640) cubic yards of cut and fill will be graded for the tennis court upon approval of a grading plan. The finished surface of the PCD 93-02 - CIMA TENNIS COURT FENCE JANUARY 19, 1994 PAGE 2 court ranges from 370.75 foot elevation to 371.25 foot elevation. Because the property contains slopes at less than 15% grade, this property is not subject to the Hillside Development Ordinance. No court lights are proposed. This project has been conditioned to prevent light or glare from reflecting outside the tennis court if any lights were to be added in the future. III. ANALYSIS 1. Is the proposed fence height necessary for a special use or circumstance on the property? 2. Will the proposed fence be detrimental to the health, safety, or welfare of the surrounding neighborhood? The proposed 10 foot high fence would be necessary in order to keep the balls within the tennis court and to support a wind breaker. The retaining wall would be necessary in order to provide a level court surface. The court would be positioned as proposed due to a sewer line easement and the impacts of the sun. At this location, which is the only location that will accommodate these two factors, the court would encroach into the rear yard setback. The court would be positioned outside of the sewer easement in order to maintain unobstructed accessibility to the sewer line, as well as to prevent damage to the court in the case of sewer excavation. The length of the court would be angled at 358 degrees, which is a nearly north and south direction, in order to minimize the sun's impact on the north player during late afternoon play. The United States Tennis Association and the United States Tennis Court and Track Builders Association recommend that courts face 338 degrees true at this latitude. At 358 degrees, the court would be angled as close as possible to 338 degrees without encroaching into the sewer easement or extending beyond the rear property line. Extending the fence height in the rear yard setback would not impose any detrimental impacts to the surrounding neighborhood. No portion of the fence encroaches closer than 35 feet to the property to the south, nor closer than 10 feet to the property to the north. These distances are adequate, as structures on the subject property must be setback a minimum of 10 feet from the side property lines. No impacts to the property to the east are anticipated, as this undeveloped property is designated as permanent open space. IV. ENVIRONMENTAL The proposed project is exempt from environmental review per Section 15303(e) of the California Environmental Quality Act.
