The following are my comments for the draft staff reports for the DCC meeting of February 24,
1997, in the three matters currently scheduled:
1. LA COSTA HIGH COMMUNICATIONS (CUP 96-23
A. In Resolution No. 4050, second recital, please change the recital to be identical
to the second recital in Resolution No. 4054, and add a new third recital as follows:
"WHEREAS, the Planning Department has prepared a Negative
Declaration regarding said project, as provided by Chapter 19.04 of
the Carlsbad Municipal Code."
B. Please delete Condition No. 1 to the Negative Declaration resolution.
C. In Resolution No. 4054, please add a new Finding No. 9, utilizing standard
Finding No. 18, regarding use of the 1994 General Plan Update MEIR as a basis for
prior compliance and partial satisfaction of the Environmental Analysis for this project.
2. KNOWLES AVENUE MOVE-ON (PCD 97-01)
In the staff report, please clarify that the moving permit required by Carlsbad
Municipal Code Section 18.24.040 is issued by the Community Development Director,
not the Planning Commission, but that the Planning Commission's approval is a
prerequisite to the issuance of the permit by the Director.
Please explain how the Applicant will obtain approval for the additional single-car
garage of 352 square feet and the covered entry porch of 35 square feet, since they are
not part of the approval required by Carlsbad Municipal Code Section 18.24.040, and,
therefore, are not before the Planning Commission as this item is currently structured.
\^~- ,' C- ln Resolution No. 4069, page 1, line 17, in the second recital, please delete: "as
X A provided by the conditions of approval of PCD 97-01", and change the reference of
vK'Chapter 18.24" to "Section 18.24.040".
D. Are there other conditions not mentioned in the staff report or resolution, which
are proposed to be imposed by the Community Development Director on the issuance
of the moving permit, related to "protection of the general health, safety and welfare of
the citizens of the City" as to which the Director requests approval from the Planning
Commission? Will the building, after movement to the new site and attachment to a new
foundation, be in conformance with current codes in all respects, or is it a ^ ^^-
"nonconforming" building?
E. In Resolution No. 4069, please add the "Nollan/Dolan" finding as Finding No. 4,
since there are many extractions coming in the conditions listed thereafter. Please add
any new conditions related to the general health, safety and welfare of the citizens of the
City which are sought to be imposed by the Community Development Director in the
moveing permit, if they are not already all there.
3. SOUTH CARLSBAD LIBRARY (CUP 96-16/CDP 97-01)
A. Please add discussion in the staff report justifying the 10-year conditional use
permit and satisfaction of the City Council's policy with regard to 5-year versus 10-year
conditional use permits.
B. Please clarify the relationship between approval of this new conditional use
permit and the old site development plan SDP 83-11 (A). The discussion on pages two
and four of the staff report say that the site development plan requirement has already
been met, but that the Site Development Plan 83-11 (A) did not include all of the
information required for a site development plan for the library, but was provided by a
discussion item before the Planning Commission on December 5, 1990. It further states
that the discussion item was a follow-up to the conditional use permit, not to the site
development plan, and the conditional use permit has expired. Doesn't this mean that
the Site Development Plan 83-11 (A) now needs to be amended to reflect the content of
the final plans which we are here approving in the form of a conditional use permit?
C. On page two of the staff report, we state that the library will contain an
approximately 200-seat auditorium/production stage, in addition to all the other elements
of the library facility, but there is no discussion of parking. Page four states that the
existing site is still adequate with regard to parking with landscaping, but there is no
discussion of the number of spaces required and/or provided, nor of the traffic flow
interrelationship between the library and the adjacent shopping center. There should be
some factual discussion in the administrative record to support a finding that the
conditional use of the library is compatible with surrounding properties, particularly with
regard to traffic flow and parking.
D. On page five, in the Environmental Review discussion, we state that the library is
a "Subsequent Project that was described in the MEIR and within its scope." Please
correct that language to reflect that the MEIR is just an EIR being used as a basis for
prior compliance and utilize Finding No. 18 in the Resolution to track that discussion.
There is also discussion that all feasible mitigation/measures or project alternatives
identified in the previous Negative Declaration or MEIR 93-01 have been incorporated
into this project. However, neither the staff report nor the resolution describes any
applicable mitigations from either the Negative Declaration or MEIR 93-01, such as
additional sidewalks, bike trails, bus stops, or van pool parking which might have been
incorporated into the project design or added as conditions. There needs to be some
factual predicate in the staff report for Finding No. 6 in Resolution No. 4066, wherein the
Planning Commission finds that all feasible mitigation measures identified in the MEIR
which are appropriate to this project have, in fact been incorporated into this project.
E. In Resolution No. 4066, please delete Finding No. 5 and augment Finding No. 7
to reflect both use of the mitigated Negative Declaration and MEIR 93-01 as prior
environmental documents, not requiring any subsequent or supplemental EIR under
Guidelines 15162 or 15163 (unless the library was actually listed as a "Subsequent
Project" envisioned by MEIR 93-01).
F. In Resolution No. 4066, conditions 6, 7, 10 and 11 appear to be code reminders
or old versions of conditions prior to our preparation of preapproved standard findings.
Condition No. 9 appears to say substantially the same thing as Code Reminder No. 18.
Is it really necessary?
G. In Resolution No. 4066, is Condition No. 12 (the generic NPDS condition)
appropriate here? This is a brand new building and we should have assisted the
architect in designing "best management practices" into the design of the facility, which
design is now before the Planning Commission for approval. Are there post-
construction NPDS requirements that need to be set forth either as a condition or a code
reminder?
H. Please add an additional condition as follows:
"Developer shall construct, install, and stripe a parking lot for "#"
spaces as shown on Exhibit" ", to the satisfaction of the City
Engineer."

64. Prior to (APPROVAL OF THE FINAL MAP/ISSUANCE OF BUILDING PERMIT),
_ shall be dedicated by the owner along the project frontage based on a center line to
right-of-way width of _ feet and in conformance with City of Carlsbad Standards.
65. Prior to issuance of building permits, the applicant shall underground all existing overhead

69. Prior to approval of any grading or building permits for this project, the owner shall give
written consent to the annexation of the area shown within the boundaries of the site plan
into the existing City of Carlsbad Street Lighting and Landscaping District No. 1 on a form
provided by the City.
70. The drainage system shall be designed to ensure that runoff resulting from 10-year frequency
storms of 6 hours and 24 hours duration under developed conditions, are equal to or less than
the runoff from a storm of the same frequency and duration under existing developed
conditions. Both 6 hour and 24 hour storm durations shall be analyzed to determine the
detention basin capacities necessary to accomplish the desired results prior to (APPROVAL
OF THE FINAL MAP) issuance of building or grading permits whichever occurs first
71. The applicant shall comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permit The applicant shall provide best management practices,
to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Planning Commission Determination, application no. PCD
97-01, as to its completeness for processing.
The application is incomplete, as submitted. Attached is a list of information which must
be submitted to complete your application. This list of items must be submitted directly to
your staff planner by appointment. All list items must be submitted simultaneously and a
copy of this list must be included with your submittals. No processing of your application
can occur until the application is determined to be complete. When all required materials
are submitted the City has 30 days to make a determination of completeness. If the
application is determined to be complete, processing for a decision on the application will
be initiated. In addition, please note that you have six months from the date the
application was initially filed, January 3,1997, to either resubmit the application or submit
the required information. Failure to resubmit the application or to submit the materials
necessary to determine your application complete shall be deemed to constitute withdrawal
of the application. If an application is withdrawn or deemed withdrawn, a new application
must be submitted.

Engineering Department staff have completed a review of the above-referenced project for
application completeness and have determined that the application and plans submitted for the
project are incomplete and unsuitable for continued review due to the following
