AGENDA OF: August 6, 2008 Application complete date: N/A Project Planner: Barbara Kennedy Project Engineer: N/A SUBJECT: PCD/GPC 08-02 - ROBERTSON RANCH PARK SITE/FIRE STATION SITE - Request for a Planning Commission Determination of General Plan Consistency for the City acquisition of 7.54 acres of property generally located northeast of El Camino Real and northwest of Cannon Road within portions of Planning Areas 12 and 13 in the Robertson Ranch Master Plan, in the City's Northeast Quadrant, and within Local Facilities Management Zone 13. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 6443, APPROVING Planning Commission Determination of General Plan Consistency PCD/GPC 08-02 based on the findings and subject to the conditions contained therein. II. INTRODUCTION The project involves the determination that the proposed acquisition of 7.54 acres of vacant property generally located northeast of El Camino Real and northwest of Cannon Road within portions of Planning Areas (PA) 12 and 13 in the Robertson Ranch Master Plan is consistent with the City's General Plan. Section 65402 of the California Government Code requires that any proposed acquisition of property for public purposes, except street dedications, shall be reviewed for consistency with the General Plan. Staff has no outstanding issues with the proposed consistency determination request. III. PROJECT DESCRIPTION AND BACKGROUND The Robertson Ranch Master Plan designates PA 12 as a public park site that would be developed in the future with three soccer fields. PA 12 contains 13.51 total acres, of which 7.97 acres will be dedicated to the City to satisfy the Parkland Dedication requirement of the Master Plan and the City has entered into a Parkland Purchase Agreement (Agreement) to purchase the remaining 5.54 acres. The Agreement also allows the City to purchase additional land in PA 13 in the event that the Carlsbad Unified School District (CUSD) declines to purchase and develop PA 13 with an Elementary School. Staff received confirmation that CUSD has declined to purchase PA 13 for development of an Elementary School. Therefore, the Master Plan's alternative residential uses, expansion of the PA 12 park site, or relocation of Fire Station No. 3 can be implemented, subject to a General Plan Amendment (GPA) to change the General Plan Land Use Designation from E to Medium Density Residential (RM) or OS. o PCD/GPC 08-02 - ROBERTSON RANCH PARK SITE/FIRE STATION SITE August 6, 2008 Page 2 The proposed property acquisition involves the purchase of a total of 7.54 acres of rough-graded, vacant land located within portions of PAs 12 and 13 of the Robertson Ranch Master Plan. The acquisition includes 5.54 acres (Purchase Area 1) located within PA 12 that is zoned Planned Community (P-C) with an underlying zone and General Plan Land Use Designation of Open Space (OS), and 2.0 acres (Purchase Area 2) located within PA 13 that is zoned P-C with an underlying zone of Multi-Family Residential (RD-M) and with a General Plan Land Use Designation of Elementary School (E). The additional 2.0 acres in Purchase Area 2 would be acquired for the purpose of providing additional flexibility for the layout of the future soccer fields and for the potential relocation of Fire Station Number 3, which is currently located at the southeast intersection of Chestnut Avenue and Catalina Drive. Any future use of the property for either a public park or fire station use would require approval of a Conditional Use Permit (CUP). The GPA required for Purchase Area 2 would be processed either prior to or concurrently with the required discretionary actions. IV. ANALYSIS General Plan Consistency The subject property includes 5.54 acres (Purchase Area 1) located within a portion of Planning Area (PA) 12 that is zoned Planned Community (P-C) with an underlying zone and General Plan Land Use Designation of Open Space (OS), and 2.0 acres (Purchase Area 2) located within a portion of PA 13 that is zoned Planned Community (P-C) with an underlying zone of Multi- Family Residential (RD-M) and a General Plan Land Use Designation of Elementary School (E). The Master Plan designates PA 12 as a public park site and PA 13 was designated as a potential location for an elementary school. However, the Carlsbad Unified School District has declined to purchase PA 13, and therefore, the alternative residential uses allowed by the Master Plan, expansion of the park site, or relocation of Fire Station No. 3 may be implemented, subject to a General Plan Amendment to change the General Plan Land Use Designation for PA 13 from E to RM and/or OS. The proposed property acquisition is consistent with the goals, objectives, polices, and implementation programs of the General Plan in that the property proposed for acquisition is intended to be used for a public use (i.e. development of a public park and fire station). Public uses such as schools, parks, fire stations, libraries, or other civic facilities are allowable in both the open space zone and residential zone subject to approval of a CUP. Therefore the project, and any potential public development on the subject site, is consistent with the General Plan. V. ENVIRONMENTAL REVIEW It has been determined that the project is exempt from the California Environmental Quality Act, pursuant to Section 15061(b)(3) of the CEQA Guidelines. Section 15061(b)(3) exempts projects or activities where it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment. Simple acquisition of the property, with no associated plan for development of that property, is such an activity. Should the City decide to pursue development of the site, an additional environmental review will be conducted at that time.
