Subject: Carlsbad Boulevard Whale Watch Fence Replacement
Dear Mr. Entezari:
This is to certify that the replacement of an existing
deteriorated wooden fence along Carlsbad Blvd. between Cherry
and Redwood Avenues with an adonized aluminum fence has been
reviewed by the Staff of the San Diego Area Office of the
California Coastal Commission. A coastal development permit is
not necessary because the proposed project has been determined
to be a repair or maintenance activity not resultin in an
addition to or enlargement or expansion of the existing fence.
It is our understanding that the fence will be constructed in
the same alignment as the existing fence and will constitute
simply a replacement of the existing fence. No additional paved
area will be constructed as a result of the proposed fence
replacement, and no additional landscaping has been either
proposed or approved.
This certification is based on information provided in you
letter of January 15. 1991 and undated plans that accompanied
the letter. If. at a later date, this information is found to
be incorrect, this letter becomes invalid, and any development
occuring must cease until a coastal development permit is
obtained. Please contact me if you have any questions regarding
this matter.

WHALE WATCH FENCE REPLACEMENT PROJECT
This is in response to your comments regarding the whale watch fence.
1. You had suggested that a different fence design would be more appropriate for the
location, and would also blend better with the ocean background.
The purpose of the proposed design is three-fold:
• To replace the existing unsightly and deteriorated fence.
• To install a fence that would endure the beach environment and corrosive salt
air with minimum or no maintenance.
To match and blend with the ocean background.
Based on the above three factors, the fencing color and material was selected.
However, If you have any suggestions, we will be happy to look into it.
2. Your suggestion to install a new and attractive trash enclosure is a good suggestion,
but since we only have $155,000 for this project, we should consider it after the bids
are in. Then, if we have money left over, we would order new trash enclosures.
3. Only one concrete bench at the southern end of the project may be too close to the
fence. This bench could be removed and reinstalled during construction.
4. Revegetation and re-landscaping of the State Park as is suggested was never
authorized by the City Council and is beyond the financing and scope of the fence
replacement project. Additionally, the Coastal Permit specifically prohibits the
installation or landscaping of any kind (see attached Coastal Commission Letter of
Exemption). However, your proposed landscaping skeem could be accomplished by
a new project funded and permitted separately.
5. The existing erosion of slopes are mainly caused by poor drainage of the park site
and the large population of squirrels which burrow through the slopes. This situation
could be alleviated by initiation of another project to enhance the property of the
State Park.

SUBJECT: Whale Watch Fence Replacement - PCD/GPC 90-11
On a visit to the site of the above referenced project, a number of potential issues were
noted as follows:
o The project site is somewhat different from the other areas north and south
along Carlsbad Boulevard in that it has the wide landscaped areas,
benches, etc. Because this area is more scenic and sees more pedestrian
activity, it would seem appropriate to provide fencing that enhances the
area and helps distinguish it -- perhaps a different fence design which
would be more interesting and would break up the pattern of the existing
fencing to the north and south. It would also be desirable to design the
fence (materials and color) so that it does not interfere with the ocean view.
o New and more attractive trash enclosures should be provided.
o The plans do not show the relocation of any of the concrete tables and
benches at the southern end of the site. However, they appear to be
located near enough to the existing fence as to necessitate their relocation.
o The existing planter areas exhibit several problems. The existing plantings
are fast-growing, short-lived shrubs. Other plantings might be more
appropriate and attractive. One possibility might be the use of palms being
removed in the widening of Tamarack. The irrigation system should be
revised to better suit the plans. Overspray from the existing system may
account for the planters being overwashed. Increasing the amount of
landscaping might mitigate the loss of open space resulting from the
project.
o The existing sidewalk and fence area shows signs of undercut erosion in
some areas. Would the use of different fence footings lessen this problem
in future? Is the current irrigation system contributing to this problem?
The Planning staff feels it may be appropriate to treat this project area as a special scenic
area, along with the proposed Tamarack Avenue project. We would appreciate your
response to the questions raised and any suggestions or recommendations you may
have on how these issues can be addressed.

information is needed in order to proceed. The following items need clarification or

1. Is this project part of an approved CIP?
2. Why is the project being done? Is there a particular reason for the timing of the
project (e.g., immediate safety problem, etc.?). The EIA Part I indicates that the
project is an exempt "Repair and Maintenance" project.
3. How does the project as proposed affect the existing landscaped areas?
4. Your submittals include conflicting information regarding the extent of the project.
The application and the EIA Part I say "between Cherry Avenue and Tamarack
Avenue." The small map with the application highlights the area between Cherry
Avenue and Sequoia Avenue. The 24' x 36' plan shows the area between Cherry
Avenue and Redwood Avenue. Please provide the correct project area and extent
of the full project.

2. Based on the completed Environmental Initial Study, the City of Carlsbad Planning
Department finds that the proposed project will not encroach upon wildlife habitat
area, will have no potential adverse individual or cumulative effects on wildlife
resources, and requires no mitigation measures to be incorporated into the proposed
project which would affect fish or wildlife.

SUBJECT: PCD/GPC 90-11 - WHALEWATCH FENCE REPLACEMENT - Request for a
determination of General Plan consistency for the replacement of a section
of fence and additional sidewalk paving along the coastal blufftop paralleling
Carlsbad Boulevard between Cherry Avenue and Tamarack Avenue in Local
Facilities Management Zone 1.
RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 3257
APPROVING PCD/GPC 90-11 based upon the findings and subject to the conditions
contained therein.
II.PROJECT DESCRIPTION AND BACKGROUND
The Municipal Projects division of the Engineering Department is proposing to replace the
existing fence along the coastal blufftop adjacent to Carlsbad Boulevard between Cherry
Avenue and Tamarack Avenue The project will also include an increase in the amount of
paved area adjacent to the fence. The existing fence post foundations along the blufftop
are eroded, creating potential safety problems. The proposed replacement fence is of
anodized aluminum and will match other aluminum fencing along the blufftop.
The proposed fence replacement will necessitate the creation of additional six-foot wide
sidewalks in some sections along the blufftop to support the new fence posts. The new
fence will be installed on the sidewalk. The new sidewalks will be located in three areas
along the bluff top: 1) directly across from the Juniper Avenue intersection, 2) just north
of the Hemlock Avenue intersection, and 3) between Hemlock Avenue and Redwood
Avenue. These areas presently contain small islands of grass which will be reduced by the
addition of more paving. No new landscaping is being proposed for the site. The addition
of new sidewalks will also necessitate the relocation of existing bike racks and one concrete
bench at the south end of the project area.

III. ANALYSIS
Planning Issues
1. Are the proposed improvements consistent with the various elements of the General
Plan?
2. Are the proposed improvements consistent with the regulations of the Mello II zone
of the Coastal Management Program?
DISCUSSION
General Plan Consistency
One of the goals of the Public Safety Element is to maximize public safety. The Municipal
Projects Division has identified the existing wooden fence as a potential threat to public
safety because of its deteriorated condition. The project area receives a high level of
pedestrian use. Visitors make use of the benches and grassy areas and walk or jog along
the sidewalks. The new fence would provide added protection. Thus, the replacement of
the fence is consistent with the General Plan.
IV. ENVIRONMENTAL REVIEW
A Notice of Categorical Exemption was issued for this project on October 14, 1990, on the
basis that the project is a replacement structure to be located on the same site and for the
same purpose as the existing structure.
The proposed project is in the Mello II zone of the Coastal Management Program and
complies with all regulations for that zone.
