Subject: Vista Carlsbad Sewer Interceptor Phase III
Dear Anne:
To begin, please forgive me for not responding to your letter
more quickly. I regret the delay in this response.
Based upon our understanding of the proposed sewer replacement
project, it is still our determination that a coastal
development permit is required. The Commission has adopted
interpretive guidelines on categorical exclusions from permit
requirements for a number of categories of repair and
replacement of public facilities and utilities, but.
unfortunately, the proposed sewer replacement does not fall into
any excluded category of development.
These guidelines exempt sewer projects that will not result in
any alteration of service capacity. Typically, a replacement
project would be considered to alter service capacity if the
proposed project were to include a change in the size of sewer
proposed. It is our understanding that the subject proposal
involves an increase sewer size from 36 inches to 48 inches.
Based upon this increase in capacity, a coastal development
permit would be required for this replacement project. Please
note that this does not speak to growth inducement, but rather
to the physical capacity of the existing and proposed
structures. Growth inducement is an entirely separate issue
that may be examined in the context of the permit process.
Given that the City has certified Land Use Plans for each of its
segments, it is not likely that growth inducement will be a
significant issues in review of the permit application.
I have enclosed a coastal development permit application. The
application process may be a bit more complicated in this
project than is typical, in that the project is located both in
the Village Redevelopment Ar-ea, for which the City has permit

jurisdiction, and in the area where the Commission retains
jurisdiction under the Mello I Local Coastal Program (LCP). If
you have any questions regarding processing applications'for a
project that lies under both jurisdictions or permit processing

PERMITS IN THE REDEVELOPMENT AREA - G.W. 1/15/91
In the redevelopment area all required permits are to be
consolidated into a single redevelopment permit, including
Planning Commision Determinations (PCD), with the exception of
Coastal Permits which shall be filed concurrently with the
redevelopment permit if the property is within the coastal zone.
