In response to your request, the City Engineer has agreed to defer some of the frontage
improvements required of the Golf Practice Facility. This deferral extends only to the
street widening along the property frontage with Haymar Drive west of the Haymar bridge
and the street light proposed at station 124+50 on the improvement plans: The
improvements east of the bridge and the streetlight just west of the bridge are still
required to be installed at this time. The property owner will be required to enter into our
standard Contract for Future Public Improvements for the deferred improvements prior
to our releaseon the project.,
With regard to the Buena Vista Creek maintenance, the City does not concur with your,
conclusion that the sediment and accumulated growth within the channel resulted in the
flooding of the Golf Practice(Facility site The project site is- located entirely within the
floodway for the Buena Vista Creek..It was clearly projected by this Department and your
engineering consultants that the site would frequently be inundated during medium to
heavy storm events'..It was for this reason that the .structures on the site were required
to incorporate flood protection construction measures.
The hydraulic analysis done for the Buena Vista Creek, and validated by the hydraulic
studies done for the project, identified the bridge as the controlling factor for the
upstream water elevation and, not the geometrics or condition of" the 'dównstréam
channel. The channel condition was clearly evident prior to the construction of your
clients project. If the condition of the channel was a major factor in the hydauIics of the
site, then your clients consultant engineer 'should have made such identification and
incorporated appropriate mitigation recommendations into the hydrology report
With that said, the City does not object to your client removing any accumulated
sediment, debris or vegetation from the channel immediately west of the Haymar bridge
provided your client complies with the following requirements:

Submit aright-of-way permit application and receive approval* from the City, prior
to initiation of the maintenance activities. All normal City insurance requirements
must be complied with prior to City issuance of the permit
Submit written permission from the State Fish and Game Department and the.
Federal Fish and Wildlife Agency. The permission should include a description of
the work, a sketch or areferenceto a sketch which clearly describes the work fbr
which they are giving their permission
Upon cpmpletioftof the actions noted above, the City will grant authorization to perform
the channel maintenance vvork The channel maintenance work will be cbnsidered an
extension of the existing grading work done on the project site. The work will thus be
secured under the existing grading and erosion control agreement. As such, the grading
bonds and cash security held on the project will not be released until the City determines
that the channel maintenance' work is completed in compliance with the City and

Think you for the time that you and Lloyd spent with us at the above captioned
site In relation to the unresolved issues, we would offer, the following

conditions of approval.

Street Lighting: As we explained, it is our belief and that, of our lighting engineer,
there is sufficient ambient light from the course lighting to illuminate Haymar Drive to
City of Carlsbad standards. However, after our nieting and wherein you expressed your
desire to have lighting in the bridge, we discussed this matter with SDG&E. We were
informed SDG&E could readily install a Street light along Haymar Drive at the Buena
Vista Creek crossing. This would illuminate the bridge and most of the street to the
property line. SDG&E does not feel it is feasible to place a light standard further east
than the bridge due to the contour of the hill on the one side, and the location of the creek
on the other.-,We would however, stipulate through 'a Non-dispute Letter that we would
mstall the second light standard at whatever time the road is improved
