Dear Chris:
The attached documents along with this letter shall constitute our formal submittal of the P.I.P. #86-6 amendment as revised per our discussions and agreements of
February 1, 1989. Based on Mike Holzmiller's confirmation that the approval of
the original P.I.P. #86-6 did include the Phase I1 portion of our project, it was
agreed that our amendment to P.I.P. #86-6 as submitted is approved. This approval
is subject to the conditions as outlined in Dennis Cornelius' letter to you dated
January 20, 1989 and resolved in our 8:OO a.m. meeting of February 1, 1989. These
conditions as agreed are as follows:
1. Building corners were plotted by a surveyor to observe relationship
with daylight line and concluded to be in compliance with the
setback requirement.
2. A copy of the letter from the City of Carlsbad approving 15'-0"
average setback was provided and acknowledged by yourself.
3. A cross section of the retaining wall along the South was provided showing the top of the wall to be flush with the daylight lineand is
in corporated in our revised submittal.
4. Confirmation of building square footage was provided and
verification of adequate parking was demonstrated in the changes
made to the plans.
5. The parking stall located in the Southwest corner of the parking lot
has been re-positioned to allow a 5'-0" backup space. The adjacent
stall facing South cannot be re-positioned due to overall dimension
constraints. Because of this it was agreed that this stall would be designated as an assigned parking space.
6. It was determined from a detailed study that our parking lot could
not be re-positioned to yield a minimum 15'-0" setback from the
South daylight line without major site and building modifications.
Due to the previous approval allowing an average setback of 15'-0"
and our conformance to that stipulation this request was dropped.
7. It was demonstrated that the present location of the garbage enclosure is the most advantageous in servicing both buildings.

The turning radius of the truck path was corrected and is in
conformance with requirements.
Berming at no greater than 2:l and a retaining wall will be provided
along the South daylight line to effectively screen parked cars from
Palomar Airport Road.
Verification of not exceeding the 25% maximum number of compact
stalls is provided.
Specimen Landscaping selected by the landscape architect will be
provided at a rate of 4 trees for every one removed during the
construction process. It was identified that only three (3) scrub trees,
two (2) lemonberry trees, and one (1) unidentified schrub will be
removed during construction.
All options of moving building back from daylight line were studied
and found not feasible. Present location is approved based on
original design guidelines allowed in P.I.P. #86-6.
Utilities and Maintenance, Fire Department and Building Department
approvals have been granted for Phase I1 and will be verified by
yourself. (See improvement plan for P.I.P. #86-6 Fire Service Water
and Sewer Line Project No. PD302, DWG No. 289-1, C.R.MW.D. 88-
C.244, approved August 25, 1988).
Haul permit approval will be required prior to issuance of grading
permit. P.I.P. amendment approval is not affected and is granted
under the condition that a haul route disposal site will be approved.
A lunch area will not be required considering the building is within
1000’ from an established park.
With regard to the existing stockpile, it is our understanding that a
letter will be issued by engineering advising that the official grading
permit will be issued within five (5) days of removal of the
stockpile. The haul permit for Phase I1 will include the stockpile to
avoid violation of haul permit requirements.
Compact parking adjacent to the North side of the parking lot has
been approved as submitted. Limited area along the compact row
does not allow addition of standard stalls without impacting entire
parking count.
It is our understanding from discussions on February 1, 1989 that you will prepare a Conditional Letter of Approval for submission to Mike Holzmiller on Friday,
February 3, 1989. Mr. Holzmiller’s signature on this letter will formally document
our agreed approval. The engineering department however is proceeding with the
approval process for our grading permit based on our verbal approval given
Wednesday, February 1, 1989.
