HomeMy WebLinkAboutPIP 87-03; Madison Square Dev II; Planned Industrial Permit (PIP)2075 LAS PALMAS DRIVE ;ARLSBAD, CALIFORNIA 92009-4859 PLANNING DEPARTMENT (619) 438-1161 PLANNED INDUSTRIAL PERMIT October 21, 1987 Madison Square Development I I 4223 Ponderosa Avenue, Suite A San Diego, California 92123 SUBJECT: PIP 87-3 The City has completed a review of the application for a planned industrial permit for the development located on lots 9-19, inclusive of Carlsbad Tract 80-38 along Palomar Oaks Way and Paseo Del Lago. It is the Planning Director's determination that the project is consistent with the City's Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City ordinances and policies. The Planning Director, therefore, recommends approval of this request based on the following : Findings : The site indicated by the Planned Industrial Permit is adequate in size and shape 'to accommodate the proposed use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required by this chapter. The improvements indicated on the Planned Industrial Permit are located in such a manner to be related to existing and proposed streets and highways. The improvements as shown on the Planned Industrial Permit are consistent with the intent and purpose of this zone and all adopted development, design and performance standards as set forth in this chapter. Conditions : 1) Approval is granted for PIP 87-3 as shown on Exhibits "A" - 'IC'', dated October 7, 1987 and Exhibits I'D" - "K", dated June 15, 1987, on file in the Planning Department and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. Page 2 2) All uses established in this structure shall be consistent with Section 21.34.020 (Permitted Uses). and with the parking ratio established by Exhibit ltAul, dated October 7, 1987. Any future expansion shall be subject to the parking requirements as they exist at the time of the expansion. 3) All roof appurtenances shall be shielded from view and architecturally intergrated with the building design. 4) Unless otherwise stated, this industrial project shall comply with all applicable City Ordinances and requirements. 5) Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance. 6) The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first. 7) All parking lot trees shall be a minimum of 15 gallons in size. 8) A master plan of the existing onsite trees shall be provided to the Planning Director as part of the final grading plan to determine which trees shall be required to be preserved prior to the issuance of a grading permit or a building permit, whichever occurs first. 9) All landscaped areas shall be maintained in a healthy and thriving b condition, free from weeds, trash, and debris. 10) Any signs proposed for this development shall be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Planning Director prior to installation of such signs. 11) Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. 12) All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building.' 13) Building identification and/or addresses shall be placed on all new and existing building so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. Page 3 14) All required fire hydrants, water mains, and appurtenances shall be operational prior to combustible. building materials being located on the project site. 15) Additional public and on-site fire hydrants shall be required subject to the approval of the Fire Marshal. 16) This project is also approved under the express condition that the applicant pay the additional public facilities fee adopted by the City Council on April 22, 1986, and any development fees established by the City Council pursuant to Ordinance No. 9791 or subsequent ordinance adopted to implement a growth or development management system or public facilities phasing plan to fulfill the subdivider's agreement to pay the public facilities fee dated June 5, 1987, a copy of which is on file with the City Clerk and is incorporated by this reference. If the fees are not paid, this application will not be consistent with the General Plan and approval for this project shall be void. 17) The developer shall submit approval of the California State Coastal Commission prior to building permit issuance. 18) The developer shall pay an interim Traffic Impact Fee to be collected at the time of building permit issuance per City of Carlsbad Ordinance No. 8660. 19) This project is approved upon the express condition that building unless the City Engineer determines that sewer capacity i.s available at the time of application for such permits and will continue to be available until time of occupancy. (This note shall be placed on the final map.) b permits will not be issued for development of the subject property 20) The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. 21) The grading for this project is defined as "controlled grading" by Section 11.06.170(a) of the Carlsbad Municipal Code. Grading shall be performed under the observation of a civil engineer whose responsibility it shall be to coordinate site inspection and testing to ensure compliance of the work with the approved grading plan, submit required reports to the City Engineer and verify compliance with Chapter 11.06 of the Carlsbad Municipal Code. 22) All slopes within this project shall be no steeper than 2:l. 23) Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. ... Page 4 The developer shall exercise special care during the construction phase of this project to prevent, any offsite siltation. The developer shall provide erosion control measures and shall construct temporary desiltation/detention basins of type, size and location as approved by the City Engineer. The basins and erosion control measures shall be shown and specified on the grading plan and shall be constructed to the satisfaction of the City Engineer prior to the start of any other grading operations. Prior to the removal of any basins or facilities so constructed the area served shall be protected by additional drainage facilities, slope erosion control measures and other methods required or approved by the City Engineer. The developer shall maintain the temporary basins and erosion control measures for a period of time satisfactory to the City Engineer and shall guarantee their maintenance and satisfactory performance through cash deposit and bonding in amounts and types suitable to the City Engineer. Adjustment Plats must be submitted and a Certificate of Compliance recorded for consolidation of lots 9 and 11 and lots 12, 13, 14, 15 and 16 prior to building permit issuance. Oak trees within the project must be maintained in a healthy and thriving condition. No Oak trees will be allowed to be removed. An arborist will be employed to aid in the relocation and/or protection of all existing Oak trees. An Oak tree preservation/relocation plan shall be approved by the City Engineer and Planning Director prior to issuance of any building or grading permits, whichever occurs first, for the project. The westerly entrance shown on lot 16 from Palomar Oaks Way is specifically not approved. This entrance shall be redesigned to provide ingress only into the project. No egress shall be allowed at this location. Prior to approval of any building or grading permits for the project the applicant shall submit a detailed improvement plan showing the proposed entry together with an appropriate decelerationlturning lane and striping plan for the approval of the City Engineer. Normal City plan check and inspection fees shall accompany this submittal. Prior to approval of any building permits for this project the applicant shall submit an updated hydrologic study for the adjacent storm drain channel. The study shall be prepared by a registered Civil Engineer competent in the field of Hydrology and shall be based on the latest City Standard requirements. All building pad heights shall be made a minimum one foot higher than 100 year flood level. Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department. Additional public and/or on site fire hydrants shall be provided if deemed necessary by the Fire Marshal. The rest of letter is missing Erom file.
