CARLSBAD, CA. 92009 RE: P.I.P. 87-3 AMENDMENT/BOUN IDAR' Y ADJUSTM E NT THE AMENDMENT REFERENCED ABOVE IS BEING REQUESTED TO PERMIT FINAL PROCESSING OF BOUNDARY ADJUSTMENT 357 WHICH IS ON HOLD DUE TO NON CON- FORMANCE WITH THE WORDING OF CONDITION #25 OF THE ORIGINAL RESOLUTION APPROVING P.I.P. 87-3. THE EXISTING WORDING DOES NOT ADEQUATELY CONVEY THE ORIGINAL INTENT OF EITHER THE CITY OR THE DEVELOPER IN ELIMINATING EXISTING LOT LINES AND PROVIDING FOR FUTURE CONSTRUCTION. WE PROPOSE TO REVISE THE WORDING AS FOLLOWS: 'I ADJUSTMENT PLATS MUST BE SUBMITTED AND A CERTIFICATE OF COMPLIANCE RECORDED FOR CONSOLIDATION OF LOTS 9, 10 E 11 AS ONE LOT, LOTS 12, 13, 14 E 15 AS ONE LOT, AND REVISION OF BOUNDARY BETWEEN LOTS 15 AND 16 TO ADJUST AREA OF LOT 16. THIS WORDING WILL ALLOW FOR LOT 16 AND FUTURE BUILDING 8 TO BE MARKETED, FINANCED, CONSTRUCTED AND SOLD AS A SEPARATE LEGAL PARCEL. THE EXISTING RECORDED CC&RIS PROVIDE FOR COMMON USE OF DRIVEWAYS ACROSS ALL PARCELS, AND FOR PARTICIPATION IN MAINTENANCE OF COMMON AREAS. S I NCERELY, HENRY L.
