Jones 4199 Campus Drive #830 Irvine, California 92715 SUBJECT: PIP 87-5 The City has completed a review of the application for a Planned Industrial Permit for development located at Lot 14, CT 74-21 at ,Loker Avenue and El Fuerte Street. It is the Planning Director's determination that the project is consistent with the City's Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City ordinances and policies. The Planning Director, therefore, recommends approval of this request based on the following: Findinss: The site indicated by the Planned Industrial Permit is adequate in size and shape to accommodate the proposed use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required by this chapter. The improvements indicated on the Planned Industrial Permit are located in such a manner to be related to existing and proposed streets and highways. The improvements as shown on the Planned Industrial Permit are consistent with the intent and purpose of this zone and all adopted development, design, and performance standards as set forth in this chapter. Conditions: 1) Approval is granted for PIP 87-5 as shown on Exhibits '*AIt - *'J", dated January 14, 1988, on file in the Page 2 Planning Department and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. All uses established in this structure shall be Consistent with Section 21.34.020 (Permitted Uses) and with the parking ratio established by Exhibit "A'@, dated January 14, 1988, attached hereto and incorporated herein. Any future expansion or use change shall be subject to the parking requirements as they exist at that time. In accordance with Planning Policy No. 14, the applicant shall prepare a deed restriction indicating that manufacturing use shall be maintained on the property and no other type uses creating a need for additional parking will be permitted unless more parking area is provided to meet City standards. The deed restriction shall be approved by Planning Department and recorded prior to issuance of building permits. The applicant shall prepare a 24'' x 36" reproducible mylar of the final site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approved by the Planning Director prior to the issuance of building permits. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first. All parking lot trees shall be a minimum of 15 gallons in size. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Any signs proposBd for this development shall be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Planning Director prior to installation of such signs. Trash receptacle areas shall be enclosed by a SiX-fOOt high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. Page 3 All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and Streets, pursuant to Building Department Policy No. 80- 6, to the satisfaction of the Directors of Planning and Building. This project shall be consistent with all standards identified in Title 21 of the Carlsbad Municipal Code and all standards and conditions identified in Specific Plan, SP-200. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director. This project is also approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on July 28, 1987 and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or facilities and improvement plan and to fulfill the subdivider's agreement to pay the public facilities fee dated September 15, 1987, and the agreement to pay the Growth Management Fee dated September 15, 1987, copies of which are on file with the City Clerk and are incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this project shall be void. A minimum of 300 square feet of outdoor eating area shall be provided for each 5000 square feet of building area. Credit towards the required amount of square footage will be given for indoor eating facilities on a 1:l basis, as determined by the Planning Director. The area shall be easily accessible and located that a sense of privacy is apparent. -. Page 4 Fire Conditions: prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department. Additional public and/or onsite fire hydrants shall be provided if deemed necessary by the Fire Marshal. An all-weather access road shall be maintained throughout construction. All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site. Proposed security gate systems shall be provided with vtKnoxlv key operated override switch, as specified by the Fire Department. All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval prior to construction. All roof-top appurtenances shall be architecturally integrated into the design of the building and shielding to prevent noise and visual impacts, subject to approval before issuance of permit. Building exceeding 10,000 sq. ft. aggregate floor area shall be sprinklered or have four-hour fire walls with no openings therein which shall split the building into 10,000 sq. ft. (or less) areas. Enqineerinq Conditions: This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer capacity is available at the time of application for such permits and will continue to be available until time of occupancy. (This note will be placed on the final map.) The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. The grading for this project is defined as Itregular gradingvt by Section 11.06.170(a) of the Carlsbad Page 5 Municipal Code. The developer shall submit a grading plan for approval which shall include all required drainage structures and any required erosion control measures. The developer shall also submit soils, geologic or compaction reports if required and shall comply with all provisions of Chapter 11.06 of the Carlsbad Municipal Code. A separate grading plan shall be submitted and approved and a separate grading permit issued for the borrow or disposal site if located within the City limits. All slopes within this project shall be no steeper than 2:l. Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. Research & Development - One space per 250 square feet of gross floor a rea. 2. Manufacturinq - One space per 400 square feet of gross floor area plus one stall for each vehicle used in conjunction with the use. 3. Warehouse - One space per 1,000 square feet of gross floor area plus one stall for each vehicle used in conjunction with the use. Policy : All "shell'1 type or Irspecl' buildings in the industrial zones shall be required to provide one space for every 250 square feet of gross floor area. Projects which wish to have parking at manufacturing standards or at warehouse standards must have a deed restriction placed on the property indicating that these uses on the property will be retained and no other type uses creating a need for additional parking will be permitted unless more parking area is provided to meet City standards. This policy shall not apply to existing shetl buildings that met all parking standards at the time of building permit issuance.
