It is the Planning Director's determination that the project is consistent with the City's Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City ordinances and policies. The Planning Director, therefore, recommends APPROVAL of this request based on the following: Findinqs: The site indicated by the Planned Industrial Permit 88-5 is adequate in size and shape to accommodate the proposed use, and all yards, spaces, wall s, fences, parking, loading, 1 andscaping, and other features required by this chapter. The improvements indicated on the Planned Industrial Permit 88-5 are located in such a manner to be related to existing and proposed streets and highways. The improvements as shown on the Planned Industrial Permit 88-5 are consistent with the intent and purpose of this zone and all adopted development, design, and performance standards as set forth in this chapter. The environmental effects of the proposed project have already been considered in conjunction with previously certified environmental documents. In accordance, the Planning Director has issued a Notice of Prior Compliance on December 30, 1988. Conditions: 1) Approvzl is granted for PIP 88-5 as shown in Exhibits "A" - "H", dated December 6, 1988, on fi 1 e in the P1 anning Department and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. L . Page 2 2) All uses established in this structure shall be consistent with Section 21.34.020 (Permitted Uses), and with the parking established on Exhibit "B" dated December 6, 1988. Any future expansion or use change shall be subject to the parking requirements as they exist at that time. 3) This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final map. 4) This project is a1 so approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on July 28, 1987 and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or facilities and improvement plan and to fulfill the subdivider's agreement to pay the public facilities fee dated June 21, 1988, and the agreement to pay the Growth Management Fee dated June 21, 1988, copies of which are on file with the City Clerk and are incorporated by this reference. If the fees 'are not paid this application will not be consistent with the General Plan and approval for this project shall be void. 5) The applicant shall provide school fees to mitigate conditions of overcrowding as part of building permit application. These fees shall be based on the fee schedule in effect at the time of building permit application. 6) Water shall be provided to this project pursuant to the Water Service agreement between the City of Carlsbad and the Costa Real Water District, dated May 25, 1983. 7) This project shall conlply with all conditions and mitigation required by the Zone 5 Local Facilities Management Plan approved by the City Council on August 4, 1987, incorporated herein and on file in the Planning Department and any future amendments to the Plan made prior to the issuance of building permits. 8) If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 65913.5. If any such condition is determined to be inva1i.d this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. " Page 3 9) Approval of this request shall not excuse compl iance with a1 1 sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance. 10) Approval of PIP 88-5 is granted subject to the approval of MS-783. '.<, 11) Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the P1 anning Director. Enclosure shall be of similar colors and/or materials to the project to the satisfaction of the Planning Director. 12) All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building. 13) Compact parking spaces shall be located in large groups in locations to the satisfaction of the Planning Director. 14) The applicant shall submit a street name for the private drive consistent with the City's street name policy subject to the Planning Director's approval prior to the issuance of building permits. 15) An exterior lighting plan including parking areas shall be submitted for Planning Director approval. All lighting shall be designed to reflect downward and avoid any impacts on adjacent homes or property. 16) No outdoor storage of material shall occur onsi te unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director. 17) The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs f i rst . \ 18) All parking lot trees shall be a minimum of 15 gallons in size. 19) All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. 20) Existing onsite trees shall be retained wherever possible and shall be trimmed and/or topped. Dead, decaying or potentially dangerous trees shall be approved for removal at the discretion of the Planning Department during the review of a Master Plan submitted showing existing onsite trees. Those trees which are approved for removal shall be replaced on a tree-for-tree basis as required by the P1 anning Department. ”-. Page 4 21) The developer shall install street trees at the equivalent of 40-foot intervals along all public street frontages in conformance with City of Carlsbad standards. The trees shall be of a variety selected from the approved Street Tree List. 22) Any signs proposed for this development shall at a minimum be , designed in conformance with the City‘s Sign Ordinance and shall require review and approval of the Planning Director prior to installation of such signs. 23) Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. Utilities and Maintenance Department 24) All onsite sewer and storm drains shall be privately maintained by the Owner‘s Association per MS-783. Enqineerinq Conditions: Pretreatment of the sanitary sewer discharge from this project may be required. In addition to the requirements for a sewer connection permit the developer shall conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The developer shall apply for an industrial waste discharge permit concurrently with the building permit for this project. No Certificates of Occupancy for the project will be issued before the industrial waste discharge permi t application requirements have been met, all applicable fees paid and the permit issued. Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. The owner of the subject property shall execute a hold harmless agreement regarding drainage across the adjacent property prior to the approval of any building permit for this project. Unless a standard variance has been issued, no variance from City Standards is authorized by virtue of approval of this site plan. The developer shall comply with all the rules, regulations and design requirements of. the respective sewer and water agencies regarding services to the project. " Page 5 The developer shall be responsible for coordination with S.D.G.&E., Pacific Telephone, and Cable TV authorities. Prior to Building Permit Issuance it shall be determined by the Fire Marshall if an onsite Fire Hydrant is required. If a fire hydrant is required then the appl icant must process and receive approval for the appropriate improvement plans agreements and associated easements from the City of Carlsbad and from the Costa Real Municipal Water District. Prior to Building Permit issuance, the Parcel Map for Minor Subdivision No. 783 must be recorded. Prior to Building Permit occupancy the slope adjacent to Camino Vida Roble shall be trimmed back to provide additional sight distance from Owens Avenue to the satisfaction of the City Engineer. This remedial work shall be reflected on the building site plan prior to Building Permit issuance. A grading permit pursuant to Section 11.06 of the Carlsbad Municipal Code is not required. However, since the project proposes site grading and drainage modifications a no-fee grading permit will be issued concurrent with building permit issuance. The building site plan shall be prepared by a registered Engineer, Architect or Landscape Architect. The plan shall reflect the existing and proposed site grading and drainage conditions subject to the satisfaction of the City Engineer. Fire Conditions: Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department. Additional public and/or onsite fire hydrants shall be provided if deemed necessary by the Fire Marshal. The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and onsite roads and drives to the Fire Marshal for approval. An all-weather access road shall be maintained throughout construction. All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site. Building exceeding 10,000 sq. ft. aggregate floor area shall be sprinklered or have four-hour fire walls with no openings therein which shall split the building into 10,000 sq. ft. (or less) areas.
