SUBJECT: PIP 88-9 Mission West
a1 Permit 88-9 d The City has re-reviewed the approval letter for Planned /ndustri, ated June 12,
7989, and added a standard planning condition that was inadvertently omitted from the original
approval letter. The new condition No. 21 states that this approval shall become null and void
if building permits are not issued for this project within one year from the date of this new letter
of approval.
It is the Planning Director's determination that the project is still consistent with the City's
Planned lndustrial Zone regulations (Chapter 21.34) and with all other applicable City ordinances
and policies. The Planning Director, therefore, recommends APPROVAL of this request based
on the following:
Findinus:
7) The two sites indicated by the Planned lndustrial Permit Exhibits labeled "A through "G"
in this file, are adequate in size and shape to accommodate the proposed use for the
following reasons:
a. All required setbacks have been maintained per P-M Zone requirements (Chapter
21.34).
b. Parking standards for the office, industrial, and manufacturing use have been
provided at a ratio of one space per every 335 square feet of gross floor area.
c. Landscaping has been provided in the required setbacks and parking areas per
the P-M Zone requirements.
d. Total building coverage on Lot 10 is 28.5% and on Lot 11 is 24.2% where the P-
M Zone permits a lot coverage of 50%.

e. The improvements indicated on the approved exhibits are located in such a
manner to be related to existing and proposed streets and highways.
f. The improvements as shown on the approved exhibits are consistent with the
intent and purpose of the P-M Zone and all adopted development, design and
performance standards as set forth in Chapter 21.34 of the City's Zoning
Ordinance.
g. The environmental effects of the proposed project will create no significant
environmental impacts as identified in the Negative Declaration issued on May
19, 1989 and supporting environmental documents on file in the Planning
Department.
Plannina Conditions:
Approval is granted for PIP 88-9 as shown on Exhibits "A - "G': dared June 9, 1989, on
file in the Planning Department and incorporated herein by reference. Development shall
occur substantially as shown unless otherwise noted in these conditions.
All uses established in this structure shall be consistent with Section 2 1.34.020 (Permitted
Uses), and with the parking established on Exhibit "5", dated June 9, 1989. Any future
expansion or use change shall be subject to the parking requirements as they exist at
that time.
This project is approved upon the express condition that building permits will not be
issued for development of the subject property unless the City Engineer determines that
sewer facilities are available at the time of application for such sewer permits and will
continue to be available until time of occupancy. This note shall be placed on the final
map.
This project is also approved under the express condition that the applicant pay the
public facilities fee adopted by the City Council on July 28, 1987 and as amended from
time to time, and any development fees established by the City Council pursuant to
Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement
a growth management system or facilities and improvement plan and to fulfill the
subdivider's agreement to pay the public facilities fee dated September 16, 1988, and
the agreement to pay the Growth Management Fee dated September 16, 1988, copies
of which are on file with the City Clerk and are incorporated by this reference. If the fees
are not paid this application will not be consistent with the General Plan and approval
for this project shall be void.
The applicant shall provide school fees to mitigate conditions of overcrowding as part
of building permit application. These fees shall be based on the fee schedule in effect
at the time of building permit application.

Water shall be provided to this project pursuant to the Water Service agreement between
the City of Carlsbad and the Carlsbad Municipal Water District, dated May 25, 1983.
This project shall comply with all conditions and mitigation required by the Zone 5 Local
Facilities Management Plan approved by the City Council on August 4, 1987, incorporated
herein and on file in the Planning Department and any future amendments to the Plan
made prior to the issuance of building permits.
If any condition for construction of any public improvements or facilities, or the payment
of any fees in lieu thereof, imposed by this approval or imposed by law on this project
are challenged this approval shall be suspended as provided in Government Code
Section 6591 3.5. If any such condition is determined to be invalid this approval shall
be invalid unless the City Council determines that the project without the condition
complies with all requirements of law.
Approval of this request shall not excuse compliance with all sections of the Zoning
Ordinance and all other applicable City ordinances in effect at time of building permit
issuance.
Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates
pursuant to City standards. Location of said receptacles shall be approved by the
Planning Director. Enclosure shall be of similar colors andlor materials to the project
to the satisfaction of the Planning Director.
All roof appurtenances, including air conditioners, shall be architecturally integrated and
concealed from view and the sound buffered from adjacent properties and streets,
pursuant to Building Department Policy No. 80-6, to the satisfaction of the Directors of
Planning and Building.
No outdoor storage of material shall occur onsite unless required by the Fire Chief. In
such instance a storage plan will be submitted for approval by the Fire Chief and the
Planning Director.
A minimum of 300 square feet of outdoor eating area shall be provided for each 5,000
square feet of building area. Credit towards the required amount of square footage will
be given for indoor eating facilities on a 1:l basis, as determined by the Planning
Director. The area shall be easily accessible and located that a sense if privacy is
apparent-
The applicant shall prepare a detailed landscape and irrigation plan which shall be
submitted to and approved by the Planning Director prior to the issuance of grading or
building permits, whichever occurs first.
All parking lot trees shall be a minimum of 15 gallons in size.

All landscaped areas shall be maintained in a healthy and thriving condition, free from
weeds, trash, and debris.
A combination of trees and sbubs shall be provided along Corte Del Abeto in order to
screen the front loading portion of Building A on Exhibit "B" from view on Corte Del
Abeto.
Any signs proposed for this development shall at a minimum be designed in
conformance with the City's Sign Ordinance and shall require review and approval of the
Planning Director prior to installation of such signs.
Building identification andlor addresses shall be placed on all new and existing buildings
so as to be plainly visible from the street or access road; color of identification andlor
addresses shall contrast to their background color.
Monument signs located on the corner of Camino Vida Roble and Corte Del Nogal and
Corte Del Abeto shall be set into the slope like a retaining wall, so as not to protrude
above the slope.
This approval shall become null and void if building permits are not issued for this
project within one year from the date of project approval, November 3, 1989.
Enoineerinu Conditions
Pretreatment of the sanitaly sewer discharge from this project may be required. In
addition to the requirements for a sewer connection permit the developer shall conform
to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The developer
shall apply for an industrial waste discharge permit concurrently with the building permit
for this project. No Certificates of Occupancy for the project will be issued before the
industrial waste discharge permit application requirements have been met, all applicable
fees paid and the permit issued.
The developer shall obtain a grading permit prior to the commencement of any clearing
or grading of the site.
This project has been reviewed for conformancy with the grading ordinance and found
to be a project for which a grading permit is required. Prior to any building permits
being issued for the site a grading plan in conformance with City Standards and Section
1106 of the Carlsbad Municipal Code must be submitted, approved and grading work
must be completed to the satisfaction of the City Engineer. All slopes within this project
shall be graded no steeper than two horizontal to one vertical unless specifically
approved otherwise pursuant to these conditions.
No grading shall occur outside the limits of the project unless a letter of permission is
obtained from the owners of the affected properties.

Prior to the issuance of grading or building permits the applicant shall process waterline
improvement plans, post the necessav bonds, and secure appropriate dedication of the
proposed fire hydrant system as shown on the approved site plan.
Unless a standard variance has been issued, no variance from City Standards is
authorized by virtue of approval of this site plan.
The developer shall comply with all the rules, regulations and design requirements of the
respective sewer and water agencies regarding services to the project.
This project is approved specifically as 1 (single) phase.
The developer shall be responsible for coordination with S.D.G.&E., Pacific Telephone,
and Cable N authorities.
The applicant shall agree to utilize reclaimed water, in Type I form, on the subject
propew in all common areas as approved by the City Engineer.
Irrigation systems to accommodate future reclaimed water shall be designed consistent
with Title 17 of the California Administrative Code. Offsite future reclaimed water
distribution systems should be anticipated by the installation of adequately sized sleeves
at crossing points to minimize street excavation.
Fire Conditions
Prior to the issuance of building permits, complete building plans shall be submitted to
and approved by the Fire Department.
Additional public onsite fire hydrants shall be provided.
An all-weather access road shall be maintained throughout construction.
All required fire hydrants, water mains and appurtenances shall be operational prior to
combustible building materials being located on the project site.
All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and
other systems pertinent to the project shall be submitted to the Fire Department for
approval prior to construction.
All roof-top appurtenances shall be architecturally integrated into the design of the
building and shielding to prevent noise and visual impacts, subject to approval before
issuance of permit.

39) Building exceeding 70,000 s9. it. aggregate floor area shall be sprinklered or have four-
hour fire walls with no openings therein. which shall split the building into 70,000 sq. ft.
(or less) areas.
