The Planning Director, therefore, recommends APPROVAL of this request based on the following: Findings: 1) The site indicated by the Planned Industrial Permit is adequate in size and shape to accommodate the proposed use for the following reasons : a) All required setbacks have been maintained per SP 200. b) Mixed use parking standards of one space per 350 sq. ft. for the office, industrial, and warehouse combination use as itemized on Exhibits "AII-I'EII have been exceeded by 5 spaces. c) Landscaping has been provided per SP 200 and the requirements of the P-M Zone. Landscaping is 27.2% of the site. d) Total building coverage is only 30% while SP 200 allows up to 50% lot co,verage. 2) The improvements indicated on Exhibits IIAII-''EIl of the Planned Industrial Permit are located in such a manner to be related to existing and proposed streets and highways. Tom Awbry February 23, 1989 Pacle 2 3) The uses, improvements and architecture as shown on Exhibits ttAt'-ItEt' of the Planned Industrial Permit are consistent with the intent and purpose of this zone and a1 1 adopted development, design and performance standards as set forth in SP 200 and the P-M Zone requirements. Conditions: Approval is granted for PIP 88-10 as shown on Exhibits "A" - ''E", dated February 24, 1989, on file in the P1 anning Department and incorporated herein by reference. Development and management of the site shall occur substantially as shown unless otherwise noted in these conditions. All uses established in the structures shall conform to Exhibits "A"- ''E" and be consistent with Section 21.34.020 (Permitted Uses) of the Carlsbad Municipal Code, and all sections of Specific Plan, SP 200, as approved by the Carl sbad City Counci 1. The uses are predominately warehouse and manufacturing with auxiliary office facilities. In accordance with the interim parking standards for mixed-use industrial/warehouse developments, the designated proportion of uses (office, manufacturing, and warehouse) shall be maintained on the property as shown on Exhibits ''A'l-trEtr of PIP 88-10, and no other uses creating a need for additional parking will be permitted unless more parking area is ,provided to meet City standards for that use. Prior to issuance of tenant improvements and/or business licenses for interior building space within this project whichever comes first, the proportion of office, manufacturing, and warehouse uses for each building must conform to the approved proportion of uses listed in Exhibits IIAII-'IEI' so as to not increase parking demand according to City codes. The applicant shall prepare a 24" x 36" reproducible mylar of Exhibits l'AII-tIEII incorporating the conditions contained herein. Said mylars shall be submitted to and approved by the Planning Director prior to the issuance of building permits. General P1 anning and Legal Conditions: 6) If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 65913.5. If any such condition is determined to be invalid thjs approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. Tom Awbry February 23, 1989 Paqe 3 7) This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. Specific Onsite Conditions: Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be as shown on Exhi bits IIAI'-IIEII. Enclosure shall be of similar colors and/or materials to the project to the satisfaction of the Planning Director. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director prior to any outdoor storage. The applicant shall prepare a detailed landscape and irrigation plan referencing PIP 88-10 which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first. This landscape plan shall also show how the 2,950 sq. ft. of outside employee eating area shall be devel oped. All parking lot trees shall be a minimum of 15 gallons in size. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Any signs proposed for this development as shown on Exhibits 'IAII-I'EII along with any other signs shall at a minimum be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Planning Director prior to installation of such signs as shown on Exhibits "AII-'IEtt. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. Truck loading areas identified on Exhibits 'IAII-IIEI' shall be labeled and marked with pavement graphics prior to issuance of certificates of occupancy. Tom Awbry February 23, 1989 Paqe 4 -_ Facilities and Services: 17) This project is a1 so approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on July 28, 1987 and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or facilities and improvement plan and to fulfill the subdivider's agreement to pay the public facilities fee dated April 21, 1988, and the agreement to pay the Growth Management Fee dated April 21, 1988, copies of which are on file with the City Clerk and are incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this project shall be void. 18) Unless otherwise stated, this project shall be consistent with all standards identified in Title 21 of the Carlsbad Municipal Code and all standards and conditions identified in Specific Plan, SP-200. Engineering Conditions: 19) Pretreatment of the sanitary sewer discharge from this project may be required. In addition to the requirements for a sewer connection permit the developer shall conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The developer shall apply for an industrial waste discharge permit concurrently with the building permit for this project. No Certificates of Occupancy for the project will be issued before the industrial waste discharge permit application requirements have been met, all applicable fees paid and the permit issued. 20) The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. 21) The grading for this project is defined as "controlled grading" by Section 11.06.170(a) of the Carlsbad Municipal Code. Grading shall be performed under the observation of a civil engineer whose responsibility it shall be to coordinate site inspection and testing to ensure compliance of the work with the approved grading plan, submit required reports to the City Engineer and verify compl iance with Chapter 11.06 of the Carlsbad Municipal Code. 22) No grading shall occur outside the limits of the project unless a letter of permission is obtained from the owners of the affected properties. 23) A separate grading plan shall be submitted and approved and a separate grading permit issued for the borrow or disposal site if located within the city limits. Tom Awbry February 23, 1989 Paqe 5 All slopes within this project shall be no steeper than 2:l. Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with a1 1 conditions and requirements the City Engineer may impose with regards to the hauling operation. The developer shall exercise special care during the construction phase of this project to prevent any offsite siltation. The developer shall provide erosion control measures and shall construct temporary desiltation/detention basins of type, size and location as approved by the City Engineer. The basins and erosion control measures shall be shown and specified on the grading plan and shall be constructed to the satisfaction of the City Engineer prior to the start of any other grading operations. Prior to the removal of any basins or facilities so constructed the area served shall be protected by additional drainage facilities, slope erosion control measures and other methods required or approved by the City Engineer. The developer shall maintain the temporary basins and erosion control measures for a period of time satisfactory to the City Engineer and shall guarantee their maintenance and satisfactory performance through cash deposit and bonding in amounts and types suitable to the City Eng i neer . Additional drainage easements and drainage structures shall be provided or installed as may be required by the City Engineer. The developer shall make an offer of dedication to the City for all public streets and easements required by these conditions or shown on the Site Development P1 an. The offer shall be made prior to issuance of any building permit for this project. All land so offered shall be granted to the City free and clear of all 1 iens and encumbrances and without cost to the City. Streets that are already pub1 ic are not required to be rededicated. Unless a standard variance has been issued, no variance from City Standards is authorized by virtue of approval of this site plan. The developer shall comply with a1 1 the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. This project is approved specifically as 1 (single) phase. All private driveways shall be kept clear of parked vehicles at all times, and shall have posted "NO Parking/Fire Lane Tow Away Zone" pursuant to Section 17.04.040, Carlsbad Municipal Code. Offsite future reclaimed water distribution systems should be anticipated by the installation of adequately sized sleeves at crossing points to minimize street excavation. Fire Conditions: Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department. Additional public and/or onsite fire hydrants shall be provided if deemed necessary by the Fire Marshal. The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and onsite roads and drives to the Fire Marshal for approval. This shall include hydrants existing on public streets. An all-weather access road shall be maintained throughout construction. A1 1 required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site. All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval prior to construction. All roof-top appurtenances shall be architecturally integrated into the design of the building and shielding to prevent noise and visual impacts, subject to approval before issuance of permit. Tom Awbry February 23, 1989 Paqe 7 43) Building exceeding 10,OO square feet aggregate floor area shall be sprinklered or have four-hour fire walls with no openings therein which shall split the building into 10,000 square feet (or less) areas.
