La Palma Avenue Suite 202 Anaheim, CA 92807 SUBJECT: PIP 89-03 The City has completed a review of the application for a Planned Industrial Permit for development located on lot 28 of Carl sbad Tract No. 74-21 on the NE corner of Loker Avenue East and Sea Otter P1 ace. It is the Planning Director’s determination that the project is consistent with the City’s Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City ordinances and policies. The Planning Director, therefore, recommends APPROVAL of this request based on the following findings and conditions: Findinqs: 1. The site indicated by the Planned Industrial Permit is adequate in size and shape to accommodate the proposed use for the following reasons. a. All required setbacks have been maintained per SP 200. b. Adequate parking has been provided for the proposed use. c. Landscaping has been provided per SP 200 and the requirements of the P-M Zone. Landscaping is 23.86% of the site, excluding setback areas. d. Total building coverage is only 36% while SP 200 allows up to 50% lot coverage. 2. The uses, improvements and architecture as shown on the Planned Industrial Permit are consistent with the intent and purpose of this zone and all adopted development, design and performance standards as set forth in SP 200 and the P-M Zone requirements. 4. Environmental review of this project was completed and resulted in the issuance of a Negative Declaration published on May 10, 1989. Conditions: 1. 2. 3. 4. 5. Approval is granted for PIP 89-03 as shown on Exhibits IIAl'-I'OII, dated May 25, 1989, on file in the Planning Department and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. All uses established in this structure shall conform to Exhibits "A"- "Dl' and be consistent with Section 21.34.020 (Permitted Uses) of the Carlsbad Municipal Code, and all sections of Specific Plan, SP 200, as approved by the Carlsbad City Council. The uses are predominately warehouse with auxiliary office facilities. In accordance with the parking standards for mixed-use industrial/warehouse developments, the designated proportion of uses (office, manufacturing, and warehouse) shall be maintained on the property as shown on Exhibits 'IA1l-llD'l of PIP 89-03, and no other uses creating a need for additional parking will be permitted unless more parking area is provided to meet City standards for that use. Prior to issuance of tenant improvements and/or business licenses for interior building space within this project whichever comes first, the proportion of office, manufacturing, and warehouse uses for each building must conform to the approved proportion of uses listed in Exhibits I'Atl-llD1', so as to not increase parking demand according to City codes. Said mylars shall be submitted to and approved by the Planning Director prior to the issuance of building permits. General P1 anni na and Leaal Condi t i ons: 6. If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 65913.5. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. PIP 89-03 Wesley Okamoto May 22, 1989 Paqe 3 7. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. SDecific Onsite Conditions: 8. 9. 10. 11. 12. 13. 14. 15. 16. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be as shown on Exhibits "A"-"D". Enclosure shall be of similar colors and/or materials to the project to the satisfaction of the Planning Director. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director prior to any outdoor storage. Any signs proposed for this development shall at a minimum be designed in conformance with the City's Sign Ordinance and Specific Plan Zone and shall require review and approval of the Planning Director prior to installation of such signs. Building identification and/or addresses shall be placed on a1 1 new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. Truck loading areas identified on Exhibits "A"-"D" shall be labeled and marked with pavement graphics prior to issuance of certificates of occupancy. The applicant shall prepare a detailed landscape and irrigation plan referencing PIP 89-03 which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first. This landscape plan shall also show how the outside employee eating area shall be developed. All parking lot trees shall be a minimum of 15 gallons in size. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. PIP 89-03 Wesley Okamoto May 22, 1989 Pase 4 17. The final landscape plans must show three additional 15 gallon minimum canopy/screening trees. These additional trees are to be located in the setback area adjacent to the northern lot line. Specifically they are to be located within the gaps created by the proposed 5 canopy/screening trees adjacent to the 6' high concrete block screen wall as shown in Exhibit "D", dated May 25, 1989. A uniform line of canopy/screening trees must be created to screen the project's loading area. Facilities and Services: 19. Unless otherwise stated, this project shall be consistent with all standards identified in Title 21 of the Carlsbad Municipal Code and all standards and conditions identified in Specific Plan, SP-200. Enqineerins Conditions: 20. 21. 22. 23. 24. 25. Pretreatment of the sanitary sewer discharge from this project may be required. In addition to the requirements for a sewer connection permit the developer shall conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The developer shall apply for ac industrial wastewater discharge permit concurrently with the building permit for this project. No Certificates of Occupancy for the project will be issued before the industrial waste discharge permit application requirements have been met, all applicable fees paid and the permit issued. Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the haul ing operation. Additional drainage easements and drainage structures shall be provided or installed as may be required by the City Engineer. Unless a standard variance has been issued, no variance from City Standards is authorized by virtue of approval of this Site Plan. The developer shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. The developer shall be responsible for coordination with S.D.G.&E., Pacific Telephone, and Cable TV authorities. t PIP 89-03 Wesley Okamoto May 22, 1989 Paue 5 26. This project has been reviewed for conformance with the grading ordinance and found to be a project for which a grading permits is required. Prior to any building permits being issued on the site a grading plan in conformance with City Standards and Section 11.06 of the Carlsbad Municipal Code must be submitted, approved and grading work must be completed to the satisfaction of the City Engineer. All slopes within this project shall be graded no steeper than two horizontal to one vertical unless specifically approved otherwise pursuant to these conditions. 27. An additional onsite fire hydrant is required for this project. The developer shall prepare water system improvement plans and a public water easement to the satisfaction of the City Engineer and the Water District Engineer prior to the issuance of a building permit for the project. Appropriate plan check fees shall be paid and securities posted. Fire Conditions: 28. 29. 30. 31. 32. 33. 34. 35. Additional onsite fire hydrants will be required as described in condition number 27 and to the satisfaction of the Fire Chief. Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department. Additional public and/or onsite fire hydrants shall be provided if deemed necessary by the Fire Marshal. The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and onsite roads and drives to the Fire Marshal for approval. An all-weather access road shall be maintained throughout construction. A1 1 required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site. Proposed security gate systems shall be provided with "Knox" key operated override switch, as specified by the Fire Department. All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval prior to construction. All roof-top appurtenances shall be architecturally integrated into the design of the building and shielding to prevent noise and visual impacts, subject to approval before issuance of permit. 37. Building exceeding 10,000 sq. ft. aggregate floor area shall be sprinklered or have four-hour fire walls with no openings therein which shall split the building into 10,000 sq. ft. (or less) areas.
