HomeMy WebLinkAboutPIP 89-08A; Floral Trade Center; Planned Industrial Permit (PIP)PLANNED INDUSTRIAL PERMIT May 21, 1991 Carlmart Limited Partnership 5600 Avenida Encinas Carlsbad, CA 92008 SUBJECT PIP 89-8(A) - FLORAL TRADE CENTER The City has completed a review of the application for a Planned Industrial Permit for development located adjacent to 5600 Avenida Encinas in the City of Carlsbad. It is the Planning Director's determination that the project is consistent with the City's Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City ordinances and policies. The Planning Director, therefore, APPROVES this request based on the following: \ Findinas: 1. The site indicated by the Planned Industrial Permit is adequate in size and shape to accommodate the proposed use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required by this chapter, as demonstrated in the adequacy of the proposed circulation and loading areas, and outdoor employee eating areas while not requiring any variances. 2. The improvements indicated on the Planned Industrial Permit are located in such a manner to be related to existing and proposed streets and highways. 3. The improvements as shown on the Planned Industrial Permit are consistent with the intent and purpose of this zone and all adopted development, design, and performance standards as set forth in this chapter. The project is a multi-tenant, industrial building, expected to contain uses associated with the adjacent Floral Trade Center operations and, as stated above, no variances or exceptions to standards are necessary for the project. Conditions: 1. Approval is granted for PIP 89-8(A) as shown on Exhibits "A' - "E', dated May 21 , 1991, on file in the Planning Department and incorporated herein by reference. The developer shall provide the City with a reproducible 24' x 36", mylar copy of the Site Plan as approved by the Planning Commission. The Site Plan shall reflect the conditions of approval by the City. The Plan copy shall be submitted to the City Engineer prior to building, grading or improvement plan submittal, whichever occurs first. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This project is also approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on July 28, 1987 and 4s amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or facilities and improvement plan and to fulfill the subdivider's agreement to pay the public facilities fee dated September 17, 1990, a copy of which is on file with the City Clerk and is incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this project will be void. This project shall comply with all conditions and mitigation measures which may be required as part of the Zone 3 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, in substance as provided in Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building. An exterior lighting plan including parking areas shall be submitted for Planning Director approval. All lighting shall be designed to reflect downward and avoid any impacts on adjacent homes or property. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first. All parking lot trees shall be a minimum of 15 gallons in size. Existing onsite trees shall be retained wherever possible and shall be trimmed and/or topped. Dead, decaying or potentially dangerous trees shall be approved for removal at the discretion of the Planning Department during the review of,a Master Plan submitted showing existing onsite trees. Those trees which are approved for removal shall be replaced on a tree-for-tree basis as required by the Planning Department. Preliminary landscape plans shall be submitted. All landscape plans shall be prepared to conform with the Landscape Manual and submitted per the landscape plan check procedures on file in the Planning Department. Landscape plans shall be designed to minimize water use. Lawn and other zone 1 plants (see Landscape Manual) shall be limited to areas of special visual importance or high use. Mulches shall be used and irrigation equipment and design shall promote water conservation. The developer shall avoid trees that have invasive root systems, produce excessive litter and/or are too large relative to the lot size. Planter width shall be a minimum of four (4) feet, not including curb, footings and/or other paving, and parking overhang. Prior to final occupancy, a letter from a California licensed landscape architect shall be submitted to the Planning Director certifying that all landscaping has been installed as shown on the approved landscape plans. All herbicides shall be applied by applicators licensed by the State of California. The applicant shall pay a landscape plan check and inspection fee as required by Section 20.08.050 of the Carlsbad Municipal Code. The first set of landscape and irrigation plans submitted shall include building plans, improvement plans and grading plans. All landscape and irrigation plans shall show existing and proposed contours and shall match the grading plans in terms of scale and location of improvements. All parking lot trees shall be canopy trees. The minimum shrub size shall be 5 gallons. 30% of trees in industrial and commercial projects shall be 24" box or greater. Trees shall be dispersed throughout the parking lot at a ratio of 1 tree per threp parking stalls. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. All uses established in this structure shall be consistent with Section 21.34.020 (Permitted Uses). The existing uniform sign program for the Floral Trade Center, approved as a condition of PIP 89-8, shall be amended to include compatible signage for the new, proposed structure and uses, prior to occupancy of the proposed building. Said amendment shall be submitted and approved by the Planning Director prior to occupancy of the proposed building or installation of any signage on the site of the proposed development. Prior to the issuance of grading or building permits, the project applicant shall receive a Coastal Development Permit from the California Coastal Commission that approves development that is in substantial conformance with the City approval. Evidence that the permit has been received shall be submitted to both the Planning and Engineering Departments. Endneering: 32. Unless a standard variance has been issued, no variance from City Standards is authorized by virtue of approval of this site plan. 33. The developer shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. Carlmart Limited Partnership May 21, 1991 Paae 5 34. 35. 36. 37. 38. 39. 40. The developer shall be responsible for coordination with S.D.G.&E., Pacific Telephone, and Cable lV authorities. The owner of the subject property shall execute a hold harmless agreement regarding drainage across the adjacent property prior to approval of any grading or building permit for this project. Pretreatment of the sanitary sewer discharge from this project may be required. In addition to the requirements for a sewer connection permit the developer shall conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The developer shall apply for an industrial waste water discharge permit concurrently with the building permit for this project. No Certificates of Occupancy for the project will be issued before the industrial waste discharge perqit application requirements have been met, all applicable fees paid and permit issued. Additional drainage easements and drainage structures shall be provided or installed prior to the issuance of a grading or building permit as may be required by the City Engineer. Runoff from this project is conveyed to environmentally sensitive areas. The subdivider shall provide adequate means of eliminating grease and oils from drainage prior to discharge. Plans for such improvements shall be approved by the City Engineer prior to issuance of grading or building permit. The existing earthen drainage ditch along the west side of the site shall be concrete lined prior to the issuance of a Certificate of Occupancy for the new building. This excludes the portion of the earthen channel which is to have a storm drain constructed in it and a truck parking area constructed over it per City project number PE 2.91.09.; DWG No. 320-2. The truck loading areas on the north side of the existing building on the site shall be restriped and reconfigured to conform to the diagonal truck loading configuration as shown on the approved site pian. This includes the changing of the existing "dock high' loading door on the east end of the building to an "at grade" loading door. These improvement are to be completed prior to the issuance of a Certificate of Occupancy for the new building. .... 7 Carlmart Limited Partnership May 21, 1991 Pacre 6 41. The ultimate public improvements along the project frontage as required by Minor Subdivision, MS 800 and by the original Floral Trade Center site development plan, SDP 89-8 have been designed, approved and the required securities and agreements posted (per City Project No. PD 365; DWG No. 31 0- 2). Prior to the issuance of a Certification of Occupancy for the new building these public improvements shall be constructed to the satisfaction of the City Engineer. 42. The structural section for the new private driveway along the east, north, and west sides of the new building, must be designed with a traffic index of 5.0 in accordance with City Standards due to a truck route through the parking lot. The design of the structural section shall be shown and addressed on the building site plans for the structure. This portion of the driveway shall @ inspected by the City and the minimum improvement plancheck and inspection fees shall be paid prior to issuance of a building permit for the new building. 43. 44. 45. 46. The entire potable and non-potable water system/systems for subject project shall be evaluated in detail to ensure that adequate capacity and pressure for domestic, landscaping and fire flow demands are met. The Developer’s Engineer shall schedule a meeting with the District Engineer and the City Fire Marshal and review the preliminary water system layout prior to preparation of the water system improvement plans. The Developer will be responsible for all fees and deposits plus the major facility charge which will be collected at time of issuance of building permit. The Developer shall pay a San Diego County Water Authority capacity charge which will be collected at issuance of application for meter installation. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the water district serving the development determines that adequate water and service is available at the time of application for water service and will continue until time of occupancy. 47. Additional public and/or onsite fire hydrants shall be provided if deemed necessary by the fire Marshal. The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and onsite roads and drives to the Fire Marshal for approval prior to issuance of a building permit. All private driveways shall be kept clear of parked vehicles at all time, and shall have posted "No Parking/Fire Lane - Tow Away Zone" pursuant to Section 17.04.040, Carlsbad Municipal Code. Brush clearance shall be maintained according to the specifications contained in the City of Carlsbad Landscape Guidelines Manual. * All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval prior to construction.
