The City has completed a review of the application for a Planned Industrial Permit for development located on Lot 3 of CT 81-46, Unit #1, Map #11287.

The site indicated by the Planned Industrial Permit is adequate in size and shape to accommodate the proposed use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required by this chapter.
The improvements indicated on the Planned Industrial Permit are located in such a manner to be related to existing and proposed streets and highways.
The improvements as shown on the Planned Industrial Permit are consistent with the intent and purpose of this zone and a1 1 adopted development, design, and performance standards as set forth in this chapter.
The uses, improvements and architecture as shown on the P1 anned Industrial Permit are consistent with the intent and purpose of this zone and all adopted development, design and performance standards as set forth in SP- 181 and the P-M Zone requirements.

5. Environmental review of this project was completed and resulted in the issuance of a Notice of Exemption on August 23, 1989.
Conditions:

1. Approval is granted for PIP 89-12 as shown on Exhibits "A"-I'Gl', dated August 23, 1989, on file in the Planning Department and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions.
2. The developer shall provide the City with a reproducible 24" x 36", my1 ar copy of the Site Plan as approved by the Planning Department. The Plan shall reflect the conditions of approval by the City. The plan copy shall be submitted to the City Engineer prior to issuance of building permits or improvement plan submittal, whichever occurs first.
Facilities and Services
3. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final map.
4. This project is also approved under the express condition that the applicant pay the pub1 ic facilities fee adopted by the City Council on July 28, 1987 and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or facilities and improvement plan and to fulfill the subdivider's agreement to pay the public facilities fee dated January 23, 1989, a copy of which is on file with the City Clerk and is incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this project will be void.
5. This project shall comply with all conditions and mitigation measures which may be required as part of the Zone 5 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits.

6. If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be

suspended as provided in Government Code Section 65913.5. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law.
7. Approval of this request shall not excuse compl iance with a1 1 sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance.
8. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval.

Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. Enclosure shall be of similar colors and/or materials to the project to the satisfaction of the Planning Director.
All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building.
No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director.

13. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first. The landscape and irrigation plan must reference PIP 89-12 and be consistent with the approved prel iminary landscape plan as shown on Exhibit "G" dated August 23, 1989.
14. All parking lot trees shall be a minimum of 15 gallons in size.
15. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris.

Siqns and Identification
16. Any signs proposed for this development shall at a minimum be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Planning Director prior to installation of such signs.
17. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color.

The project shall attempt to develop a ride to work and home program for its employees with the North County Transit District. Furthermore, the project shall attempt to limit the staggering of worker shifts so as to . facilitate the success of said program.
As part of the plans submitted for building permit plan check, the applicant shall include a reduced version of the approving resol ution/resol uti ons on a 24" x 36" bl uel i ne drawing.
All uses established in this structure shall conform to Exhibits "A"-"G" and be consistent with Section 21.34.020 (Permitted Uses) of the Carlsbad Municipal Code, and all sections of Specific Plan, SP-181, as approved by the Carlsbad City Council.
In accordance with the parking standards for mixed-use industrial/warehouse developments, the designated proportion of uses (office, manufacturing, and warehouse) shall be maintained on the property as shown on Exhibits
"A"-'IG'l of PIP 89-12, and no other uses creating a need for additional parking will be permitted unless more parking area is provided to meet City standards for that use.
Prior to issuance of tenant improvements and/or business licenses for interior building space within this project whichever comes first, the proportion of office, manufacturing, and warehouse uses for each building must conform to the approved proportion of uses listed in Exhibits "A"-
"G", so as to not increase parking demand according to City codes.
Enqineerinq Conditions
23. Pretreatment of the sanitary sewer discharge from this project may be required. In addition to the requirements for a sewer connection permit the developer shall conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The developer shall apply for an industrial waste discharge permit concurrently with the building permit for this project. No Certificates of Occupancy for the project will be issued

before the industrial waste discharge permit application requirements have been met, all applicable fees paid and the permit issued.

The grading for this project is defined as "controlled grading" by Section 11.06.170(a) of the Carlsbad Municipal Code. Grading shall be performed under the observation of a civil engineer whose responsibility it shall be to coordinate site inspection and testing to ensure compliance of the work with the approved grading plan, submit required reports to the City Engineer and verify compliance with Chapter 11.06 of the Carlsbad Municipal
Code.
No grading shall occur outside the limits of the project unless a letter of permission is obtained from the owners of the affected properties.
Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation.
28. Additional drainage easements and drainage structures shall be provided or installed as may be required by the City Engineer.
29. Unless a standard variance has been issued, no variance from City Standards is authorized by virtue of approval of this site Plan.
30. The developer shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project.
31. The developer shall be responsible for coordination with S.D.G.&E., Pacific Telephone, and Cable TV authorities.
32. The applicant shall agree to utilize reclaimed water, in Type I form, on the subject property in all common areas as approved by the City Engineer.
33. The developer shall pay a park-in-lieu fee of .40 per square foot at the time of building permit issuance.
34. Grading permits in the property have not been released. Prior to the issuance of building permits, grading permits will need to be released.

Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department.
Additional public and/or onsite fire hydrants shall be provided if deemed necessary by the Fire Marshal.
The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and onsite roads and drives to the Fire Marshal for approval.
An all-weather access road shall be maintained throughout construction.
All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the . project site.
All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval prior to construction.
All roof-top appurtenances shall be architecturally integrated into the design of the building and shielding to prevent noise and visual impacts, subject to approval before issuance of permit.
Building exceeding 10,000 sq. ft. aggregate floor area shall be sprinklered or have four-hour fire walls with no openings therein which shall split the building into 10,000 sq. ft. (or less) areas.
