SUBJECT: PIP 89-14 - CARLSBAD OAKS EAST LOT 25
The Planning Department has reviewed Planned Industrial Permit 89-14 located on the
west side of Laker Avenue East between Sea Otter Place and El Fuerte.
It is the Planning Director's determination that the project is consistent with the City's
Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City
ordinances and policies. The Planning Director, therefore, recommends APPROVAL of
this request based on the following:
Findings:
1. The site indicated by the Planned Industrial Permit Exhibits labeled "AI - "I", in this
file, are adequate in size and shape to accommodate the proposed use for the
following reasons:
a. All required setbacks have been maintained per Specific Plan 200
requirements.
b. Parking standards for the office, industrial, and manufacturing use have been
provided at a ratio of one space per 335 square feet of multi-tenant floor
area.
c. Landscaping has been provided in the required setbacks and parking areas
per Specific Plan 200.
d. Total building coverage for the project equals 29% where Specific Plan 200
allows a lot coverage of 50%.
e. The improvements indicated on the approved exhibits are located in such
a manner to be related to existing and proposed streets and highways.
f. The improvements indicated as shown on the approved exhibits are consistent
with the intent and purpose of the PM Zone, Specific Plan 200 and all
adopted development, design and performance standards as set for in
Chapter 21.34 of the City's Zoning Ordinance.

g. Because the proposed grading is located on slopes of less than lo%, the
environmental effects of the proposed project will create no significant
environmental impacts and a Notice of Exemption was issued on May 22,
1990 and supporting environmental documents are on file in the Planning
Departments.
h. This project is consistent with the City's Growth Management Ordinance as
it has been conditioned to comply with any requirement approved as part
of the Local Facilities Management Plan for Zone 5.
Conditions:
1. Approval is granted for PIP 89-14 as shown on Exhibits "A" - "I", dated
May 12, 1990, on file in the Planning Department and incorporated herein by
reference. Development shall occur substantially as shown unless otherwise noted
in these conditions.
2. This project is approved upon the express condition that building permits will not
be issued for development of the subject property unless the City Engineer
determines that sewer facilities are available at the time of application for such
sewer permits and will continue to be available until time of occupancy.
3. This project is also approved under the express condition that the applicant pay
the public facilities fee adopted by the City Council on July 28, 1987 and as
amended from time to time, and any development fees established by the City
Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other
ordinance adopted to implement a growth management system or facilities and
improvement plan and to fulfill the subdivider's agreement to pay the public
facilities fee dated November 15, 1989, a copy of which is on file with the City
Clerk and is incorporated by this reference. If the fees are not paid this application
will not be consistent with the General Plan and approval for this project will be
void.
4. The applicant shall provide school fees to mitigate conditions of overcrowding as
part of building permit application. These fees shall be based on the fee schedule
in effect at the time of building permit application.
5. Water shall be provided to this project pursuant to the Water Service agreement
between the City of Carlsbad and the Carlsbad Municipal Water District, dated
May 25, 1983.

This project shall comply with all conditions and mitigation required by the
Zone 5 Local Facilities Management Plan approved by the City Council on
August 4, 1987, incorporated herein and on file in the Planning Department and any
future amendments to the Plan made prior to the issuance of building permits.
If any condition for construction of any public improvements or facilities, or the
payment of any fees in lieu thereof, imposed by this approval or imposed by law
on this project are challenged, this approval shall be suspended as provided in
Government Code Section 65.913.5. If any such condition is determined to be
invalid, this approval shall be invalid unless the City Council determines that the
project without the condition complies with all requirements of law.
Approval of this request shall not excuse compliance with all sections of the Zoning
Ordinance and all other applicable City ordinances in effect at time of building
permit issuance.
All roof appurtenances, including air conditioners, shall be architecturally integrated
and concealed from view and the sound buffered from adjacent properties and
streets, pursuant to Building Department Policy No. 80-6, to the satisfaction of the
Directors of Planning and Building.
As part of the plans submitted for building permit plan check, the applicant shall
include a reduced version of the approving resolution on a 24" x 36" blueline
drawing. Said blueline drawing(s) shall also include a copy of any applicable Coastal
Development Permit and signed approved Site Plan.
Specific Conditions:
11. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates
pursuant to City standards. Location of said receptacles shall be approved by the
Planning Director. Enclosure shall be of similar colors and/or materials to the
project to the satisfaction of the Planning Director.
12. No outdoor storage of material shall occur onsite unless required by the Fire Chief.
In such instance a storage plan will be submitted for approval by the Fire Chief and
the Planning Director.

All uses established in the structures shall conform to Exhibits "A" - "I", and be
consistent with Section 21.34.020 (Permitted Uses) of the Carlsbad Municipal Code,
and all sections of Specific Plan, SP 200, as approved by the Carlsbad City Council.
The uses are predominately warehouse and manufacturing with auxiliary office
facilities.
Any signs proposed for this development shall at a minimum be designed in
conformance with the City's Sign Ordinance and shall require review and approval
of the Planning Director prior to installation of such signs.
Building identification and/or addresses shall be placed on all new and existing
buildings so as to be plainly visible from the street or access road; color of
identification and/or addresses shall contrast to their background color.
This approval shall become null and void if building permits are not issued for this
project within one year from date of project approval.

The applicant shall prepare a detailed landscape and irrigation plan which shall be
submitted to and approved by the Planning Director prior to the issuance of grading
or building permits, whichever occurs first.
All parking lot trees shall be a minimum of 15 gallons in size.
All landscaped areas shall be maintained in a healthy and thriving condition, free
from weeds, trash, and debris.
The developer shall install street trees at the equivalent of 40-foot intervals along
all public street frontages in conformance with City of Carlsbad standards. The
trees shall be of a variety selected from the approved Street Tree List.
All landscape plans shall be prepared to conform with the Landscape Guidelines
Manual and submitted per the landscape plan check procedures on file in the
Planning Department.
Landscape plans shall be designed to minimize water use. Lawn and other zone 1
plants (see Landscape Guidelines Manual) shall be limited to areas of special visual
importance or high use. Mulches shall be used and irrigation equipment and design
shall promote water conservation.

The developer shall avoid trees that have invasive root systems, produce excessive
litter and/or are too large relative to the lot size.
Planter width shall be a minimum of four (4) feet, not including curb, footings
and/or other paving, and parking overhang.
Prior to final occupancy, a letter from a California licensed landscape architect
shall be submitted to the Planning Director certifymg that all landscaping has been
installed as shown on the approved landscape plans.
All herbicides shall be applied by applicators licensed by the State of California.
The applicant shall pay a landscape plan check and inspection fee as required by
Section 20.08.050 of the Carlsbad Municipal Code.
The first set of landscape and irrigation plans submitted shall include building plans,
improvement plans and grading plans.
All landscape and irrigation plans shall show existing and proposed contours and
shall match the grading plans in terms of scale and location of improvements.
Mounding shall be used in parking lot landscaping or preliminary plans shall explain
why mounding is not possible to the satisfaction of the Planning Director.
All parking lot trees shall be canopy trees.
Mature trees which are removed shall be replaced one to one with minimum 36''
box specimen. Each case shall be reviewed by the Planning Director.
The minimum shrub size shall be 5 gallons.
30% of trees in industrial and commercial projects shall be 24" box or greater.
Trees shall be dispersed throughout the parking lot at a ratio of 1 tree per three
parking stalls.
The applicant shall establish a master association and covenants, conditions and
restriction. Said CC&R's shall be submitted to and approved by the Planning
Director prior to issuance of Building Permits. CC&R's shall be strictly enforced
by the industrial park owner or manager of the Master Association.

On a yearly basis, the owner of the park or the manager of the master association
shall do an inspection of each multi-tenant project and prepare a report on any
instances of outdoor storage or operation. Said report shall be submitted to the
Planning Director and Code Enforcement Officer for review. If violations regarding
outdoor storage or operation are not corrected within 30 days from the filing of the
report, the owner/manager agrees to cancel the lease with the operator.
Prior to the issuance of the building permit there shall be a deed restriction placed
on the deed to this property subject to the satisfaction of the Planning Director
notifylng all interested parties and successors in interest that the City of Carlsbad
has issued a Planned Industrial Permit No. 89-14 on the real property owned by the
declarant. Said deed restriction shall note the property description, location of the
file containing complete project details and all conditions of approval as well as any
conditions or restrictions specified for inclusion in the deed restriction. Said deed
restriction(s) any be modified or terminated only with the approval of the Planning
Director, Planning Commission or City Council of the City of Carlsbad whichever
has final decision authority for this project.

Unless a standard variance has been issued, no variance from City Standards is
authorized by virtue of approval of this site plan.
The applicant shall agree to utilize reclaimed water, in Type I form, on the subject
property in all common areas as approved by the City Engineer.
Prior to hauling dirt or construction materials to any proposed construction site
within this project the developer shall submit to and receive approval from the
City Engineer for the proposed haul route. The developer shall comply with all
conditions and requirements the City Engineer may impose with regards to the
hauling operation.
Additional drainage easements and drainage structures shall be provided or installed
as may be required by the City Engineer.
Pretreatment of the sanitary sewer discharge from this project may be required.
In addition to the requirements for a sewer connection permit the developer shall
conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code.
The developer shall apply for an industrial waste water discharge permit
concurrently with the building permit for this project. No Certificates of Occupancy
for the project will be issued before the industrial waste discharge permit application
requirements have been met, all applicable fees paid and the permit issued.

The developer shall comply with all the rules, regulations and design requirements
of the respective sewer and water agencies regarding sexvices to the project.
The developer shall be responsible for coordination with S.D.G.&E., Pacific
Telephone, and Cable TV authorities.
Fire line easements must be dedicated prior to issuance of building permits.
There will be no substantial changes to this plan without an amendment to the
Planned Industrial Permit.
At the time of building permit the developer shall pay a park-h-lieu fee of
$0.40 per square foot.
Additional onsite fire hydrants are required for this project. The developer shall
prepare water system improvement plans and a public water easement to the
satisfaction of the City Engineer and the Water District Engineer prior to the
issuance of a building permit or grading permit for the project. Appropriate
plancheck fees shall be paid and securities posted.
Prior to approval of any grading or building permits for this project, the owner
shall give written consent to the annexation of the area shown within the boundaries
of the site plan into the existing City of Carlsbad Street Lighting and Landscaping
District No. 1.
The developer shall obtain a grading permit prior to the commencement of any
clearing or grading of the site.
This project has been reviewed for conformancy with the grading ordinance and
found to be a project for which a grading permit is required. Prior to any building
permits being issued for the site, a grading plan in conformance with City Standards
and Section 11.06 of the Carlsbad Municipal Code, must be submitted, approved
and grading work must be completed to the satisfaction of the City Engineer. All
slopes within this project shall be graded no steeper than two horizontal to one
vertical unless specifically approved otherwise pursuant to these conditions.
The grading for this project is defined as "controlled grading" by Section 11.06.170(a)
of the Carlsbad Municipal Code. Grading shall be performed under the observation
of a civil engineer whose responsibility it shall be to coordinate site inspection and
testing to ensure compliance of the work with the approved grading plan, submit
required reports to the City Engineer and verify compliance with Chapter 11.06 of
the Carlsbad Municipal Code.

- Fire:

No grading shall occur outside the limits of the project unless a grading or slope
easement is obtained from the owners of the affected properties.
A separate grading plan shall be submitted and approved and a separate grading
permit issued for the borrow or disposal site if located within the city limits.
Prior to hauling dirt or construction materials to any proposed construction site
within this project the developer shall submit to and receive approval from the
City Engineer for the proposed haul route. The developer shall comply with all
conditions and requirements the City Engineer may impose with regards to the
hauling operation.
Additional drainage easements and drainage structures shall be provided or installed
prior to the issuance of grading permit or building permit as may be required by
the City Engineer.
Prior to issuance of building permit or grading permit the developer shall enter
into an agreement with the City to pay any drainage area fees established as a
result of the forthcoming Master Drainage Plan Update.
All required fire hydrants, water mains, and appurtenances shall be operational
prior to combustible building materials being located on the project site.
Prior to the issuance of any building permit or grading permit, whichever occufs
first., a copy of the recorded reciprocal access agreement must be submitted to the
City Engineer.
The private storm drain system located onsite must be designed to City standards.
This project is lacated in Zone 5 Local Facilities Management Plan. Recent traffic
monitoring has revealed that Palomar Airport Road from El Camino Real to the
eastern City limit falls below the adopted performance standard. Therefore, prior
to the issuance of a building permit, the mer shall participate in the guarantee of
a proportional share of the cost of improving this segment of Palomar Airport
Road
Prior to the issuance of building permits, complete building plans shall be submitted
to and approved by the Fire Department.

64. Additional public and/or onsite fire hydrants shall be provided if deemed necessary
by the Fire Marshal.
65. An all weather access road shall be maintained throughout construction.
66. All required fire hydrants, water mains and appurtenances shall be operational
prior to combustible building materials being located on the project site.
67. All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers,
and other systems pertinent to the project shall be submitted to the Fire
Department for approval prior to construction.
68. All roof-top appurtenances shall be architecturally integrated into the design of the
building and shielding to prevent noise and visual impacts, subject to approval
before issuance of permit.
69. Building exceeding 10,OOO square feet aggregate floor area shall be sprinklered to
have four-hour fire walls with no openings therein which shall split the building
into 10,OOO square foot (or less) areas.
