SUBJECT: PIP 89- 16ICreekside
The City has completed a review of the application for a Planned Industrial Permit for
development located on Lot 1 of CT 80-33, Map #10061.
It is the Planning Director's determination that the project is consistent with the City's
Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City
ordinances and policies. The Planning Director, therefore, recommends approval of this
request based on the following:
Findinus:
1) The site indicated by the Planned Industrial Permit is adequate in size and shape to
accommodate the proposed use, and all yards, spaces, walls, fences, parking,
loading, landscaping, and other features required by this chapter.
2) The improvements indicated on the Planned Industrial Permit are located in such a
manner to be related to existing and proposed streets and highways.
3) The improvements as shown on the Planned Industrial Permit are consistent with the
intent and purpose of this zone and all adopted development, design, and
performance standards as set forth in this chapter.
4) Unless othenvise stated, this industrial project shall comply with all applicable City
ordinances and requirements.
5) The uses, improvements and architecture as shown on the Planned Indusirial Permit
are consistent wiih the intent and purpose of the Planned Industrial zone and all
adopted development design and performance standards as set brth in the PM zone.
6) Environmental Rewiew of this prwject was completed and resulted in the issuance of
a Negative Declaration on March 15, 1990.

Conditions:

7. Approval is granted for PIP 89-76, as shown on Exhibit(s) A - F, dated April 5, 7990,
incorporated by reference and on file in the Planning Department. Development
shall occur substantially as shown unless otherwise noted in these conditions,
2. The developer shall provide the City with a reproducible 24" x 36, mylar copy of the
site plan as approved by the Planning Director. The site plan shall reflect the
conditions of approval by the City. The plan copy shall be submitted to the City
Engineer prior to building, grading or improvement plan submittal, whichever occurs
first.
3. This project is approved upon the express condition that the final map shall not be
approved unless the City Council finds as of the time of such approval that sewer
service is available to serve the subdivision.
4. This project is also approved under the express condition that the applicant pay the
public facilities fee adopted by the City Council on July 28, 1987 and as amended
from time to time, and any development fees established by the City Council pursuant
to Chapter 27.90 of the Carlsbad Municipal Code or other ordinance adopted to
implement a growth management system or facilities and improvement plan and to
fulfill the subdivider's agreement to pay the public facilities fee dated December 7,
7989, a copy of which is on file with the City Clerk and is incorporated by this
reference. If the fees are not paid this application will not be consistent with the
General Plan and approval for this project will be void.
5. This project shall comply with all conditions and mitigation measures which may be
required as part of the Zone 5 Local Facilities Management Plan and any amendments
made to that Plan prior to the issuance of building permits.
General Plannincr and Leual Conditions
1. If any condition for construction of any public improvements or facilities, or the
payment of any fees in lieu thereof, imposed by this approval or imposed by law on
this project are challenged this approval shall be suspended as provided in
Government Code Section 65973.5. If any such condition is determined to be invalid
this approval shall be invalid unless the City Council determines that the project
without the condition complies with all requirements of law.
2. Approval of this request shall not excuse compliance with all sections of the Zoning
Ordinance and all other applicable City ordinances in effect at time of building permit
issuance.

3. This approval shall become null and void if building permits are not issued for this
project within one year from the date of project approval.
4, Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates
pursuant to City standards. Location of said receptacles shall be approved by the
Planning Director. Enclosure shall be of similar colors andlor materials to the project
to the satisfaction of the Planning Director.
5, All roof appurtenances, including air conditioners, shall be architecturally integrated
and concealed from view and the sound buffered from adjacent properties and
streets, in substance as provided in Building Department Policy No. 80-6, to the
satisfaction of the Directors of Planning and Building.
6. No outdoor storage of material shall occur onsite unless required by the Fire Chief.
In such instance a storage plan will be submitted for approval by the Fire Chief and
the Planning Director.
7. The applicant shall prepare a detailed landscape and irrigation plan which shall be
submitted to and approved by the Planning Director prior to the issuance of grading
or-building permits, whichever occurs first. The landscape and irrigation plan must
reference PIP 89-76 and be consistent with the approved landscape plan as shown
on Exhibit 'IF dated April 5, 7990.
8. AI1 parking lot trees shall be a minimum of 15 gallons in size.
9. All landscaped areas shall be maintained in a healthy and thriving condition, free from
weeds, trash, and debris.
10. Any signs proposed for this development shall at a minimum be designed in
conformance with the City's Sign Ordinance and shall require review and approval of
the Planning Director prior to installation of such signs.
11. Building identification andlor addresses shall be placed on all new and existing
buildings so as to be plainly visible from the street or access road; color of
identification andlor addresses shall contrast to their background color.
12. The project shall attempt to develop a ride to work and home program for its
employees with the North County Transit District. Furthermore, the project shall
attempt to limit the staggering of worker shifts so as to facilitate the success of said
program.
13. All building exteriors shall be grey sandblasted concrete with black tinted glass
windows as illustrated on the colored exhibit incorporated herein and on file in the
Planning Department.

Pretreatment of the sanitary sewer discharge from this project may be required. In
ao'dition to the requirements for a sewer connection permit the developer shall
conform to the requirements of Chapter 13.76 of the Carlsbad Municipal Code. The
developer shall apply for an industrial waste discharge permit concurrently with the
building permit for this project. No Certificates of Occupancy for the project will be
issued before the industrial waste discharge permit application requirements have
been met, all applicable fees paid and the permit issued.
No grading shall occur outside the limits of the project unless a letter of permission
is obtained from the owners of the affected properties.
All slopes within this project shall be no steeper than 23.
Prior to hauling dirt or construction materials to any proposed construction site within
this project the developer shall submit to and receive approval from the City Engineer
for the proposed haul route. The developer shall comply with all conditions and
requirements the City Engineer may impose with regards to the hauling operation.
Unless a standard variance has been issued, no variance from City Standards is
authorized by virtue of approval of this site plan.
The developer shall comply with all the rules, regulations and design requirements of
the respective sewer and water agencies regarding services to the project.
All private driveways shall be kept clear of parked vehicles at all times, and shall have
posted "No ParkinglFire Lane Tow Away Zone" pursuant to Section 77.04.040,
Carlsbad Municipal Code.
The developer shall be responsible for coordination with S. D. G. &E., Pacific Telephone,
and Cable N authorities.
All required fire hydrants, water mains, and appurtenances shall be operational prior
to combustible building materials being located on the project site.
10. An additional onsite tire hydrant is required for this pmwt The developer shall
prepare water system improvement plans and a public water easement to the
satishction of the Cify Engineer and the Water DisZrict Engineer prior to the issuance
of a building permit for the project. Appropriate plan check fees shall be paid and
securities posted.

Prior to the issuance of building permits, complete building plans shall be submitted
to and approved by the Fire Department.
Additional public andlor onsite fire hydrants shall be provided.
The applicant shall submit two (2) copies of a site plan showing locations of existing
and proposed fire hydrants and onsite roads and drives to the Fire Marshal for
approval.
An all-weather access road shall be maintained throughout construction.
All required fire hydrants, water mains and appurtenances shall be operational prior
to combustible building materials being located on the project site.
All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and
other systems pertinent to the project shall be submitted to the Fire Department for
approval prior to construction.
All roof-top appurtenances shall be architecturally integrated into the design of the
building and shielding to prevent noise and visual impacts, subject to approval before
issuance of permit.
Building exceeding 70,000 sq. ft. aggregate floor area shall be sprinklered or have
four-hour fire walls with no openings therein which shall split the building into 10,000
sq. ft. (or less) areas.
