The City has completed a review of the application for a Planned Industrial Permit for
development located on Lot 37 of Carlsbad Tract No. 81-46 Unit No. 2, Map 11288 in the
Airport Business Center. It is the Planning Director's determination that the project is
consistent with the City's Planned Industrial Zone regulations (Chapter 21.34) and with
all other applicable City ordinances and policies. The Planning Director, therefore,
APPROVES this request based on the following:
Findings:
1. The site indicated by the Planned Industrial Permit Exhibits labeled "A" - "E", is
adequate in size and shape to accommodate the proposed use for the following
reasons:
a. Au required setbacks have been maintained per Specific Plan 181
requirements.
b. Parking has been provided at the following ratios:
OFFICE: One space per 250 square feet of gross floor area.
MANUFACTURE: One space per 400 square feet of gross floor area.
WAREHOUSE: One space per 800 square feet of gross floor area.
C. Landscaping has been provided in the required setbacks and parking areas
per Specific Plan 181.
d. Total building coverage for the project equals 33%, where Specific Plan 181
allows a coverage of 50%.
e. Building height is 30 feet above existing grade; SP 181 permits a maximum
height of 35 feet above existing grade.

f. The improvements indicated on the approved exhibits are located in such a
manner to be related to existing and proposed streets and highways.
g. The improvements indicated on the approved exhibits are consistent with the
intent and purpose of the PM Zone, Specific Plan 181 and all adopted
development, design and performance standards as set forth in Chapter 21.34
of the City's Zoning Ordinance.
h The project will not have a significant impact on the environment and a
Negative Declaration was issued October 2,1990. Supporting envimnmentd documents are on file in the Planning Department.

Approval is granted for PIP 90-2 as shown on Exhibits "A" - "E", dated December 12,
1990, incorporated herein by reference and on file in the Planning Department.
Development shall occur substantially as shown on those exhibits unless otherwise
noted in these conditions.
The developer shall provide the City with a reproducible 24" x 36" mylar copy of the
site plan as approved by the Planning Director. The site plan shall reflect the
conditions of approval by the City. The plan copy shall be submitted to the City
Engineer prior to building, grading, or improvement plan submittal, whichever
occurs first.
This project is approved upon the express condition that building permits will not
be issued for development of the subject property unless the City Engineer
determines that sewer facilities are available at the time of application for such
sewer permits and will continue to be available until time of occupancy.
This project is also approved under the express condition that the applicant pay the
public facilities fee adopted by the City Council on July 28, 1987 and as amended
from time to time, and any development fees established by the City Council
pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance
adopted to implement a growth management system or facilities and improvement
plan and to fulfill the subdivideis agreement to pay the public facilities fee dated
July 3, 1990, a copy of which is on file with the City Clerk and is incorporated
herein by this reference. If the fees are not paid, this application will not be
consistent with the General Plan and approval for this project will be void.

This project shall comply with all conditions and mitigation measures which may
be required as part of the Zone 5 Local Facilities Management Plan and any
amendments made to that Plan prior to the issuance of building permits.
If any condition for construction of any public improvements or facilities, or the
payment of any fees in lieu thereof, imposed by this approval or imposed by law on
this project are challenged, this approval shall be suspended as provided in
Government Code Section 65913.5. If any such condition is determined to be
invalid, this approval shall be invalid unless the City Council determines that the
project without the condition complies with all requirements of law.
Approval of this request shall not excuse compliance with all sections of the Zoning
Ordinance and all other applicable City ordinances in effect at time of building
permit issuance.
This approval shall become null and void if building permits are not issued for this
project within one year from the date of project approval.
Trash receptacle areas shall be enclosed by a six-foot high concrete tilt-up screen
wall painted Frazee 5421-W ("overcast") to match doors of building and north
elevation of building. Trash receptacle area gate shall be six-foot high corrugated
steel painted Frazee 5421-W. Location shall be as shown on exhibits.
All roof appurtenances, including air conditioners, shall be architecturally integrated
and concealed from view and the sound buffered from adjacent properties and
streets, in substance as provided in Building Department Policy No. 80-6, to the
satisfaction of the Directors of Planning and Building.
No outdoor storage of material shall occur onsite unless required by the Fire Chief.
In such instance a storage plan will be submitted for approval by the Fire Chief and
the Planning Director.
Prior to issuance of a building permit, the Building Director shall review the
building plans to ensure compliance with the noise standard of the comprehensive
Land Use Plan for Mdellan-Palom Airport. That noise standard prescribes an
annual day night indoor average sound level of 50 decibels for offices. At that
time, any additional measures (thick- glazing, sound absorption material, or
shielding of vents) to further attenuate the noise to an acceptable level shall be required.

The applicant shall prepare a detailed landscape and irrigation plan which shall be
submitted to and approved by the Planning Director prior to the issuance of grading
or building permits, whichever occurs first.
The landscape and irrigation plan must reference PIP 90-2 and be consistent with
the approved landscape plan as shown on Exhibit "E", dated 12/21/90.
AU parking lot trees shall be a minimum of 15 gallons in size, except where shown
as 24" box on Exhibit "E".
All landscaped areas shall be maintained in a healthy and thriving condition, free
from weeds, trash, and debris.
The developer shall install street trees at the equivalent of 40-foot intervals along
all public street frontages in conformance with City of Carlsbad standards. The
trees shall be of a variety selected from the approved Street Tree List.
Planter width shall be a minimum of four (4) feet, not including curb, footings
and/or other paving, and parking overhang.
Prior to final occupancy, a letter from a California licensed landscape architect shall
be submitted to the Planning Director certifying that all landscaping has been
installed as shown on the approved landscape plans.
All herbicides shall be applied by applicators licensed by the State of California.
The applicant shall pay a landscape plan check and inspection fee as required by
Section 20.08.050 of the Carlsbad Municipal Code.
The first set of landscape and irrigation plans submitted shall include building plans,
improvement plans and grading plans.
All landscape and irrigation plans shall show existing and proposed contours and
shall match the grading plans in terms of scale and location of improvements.
Mounding shall be used in parking lot landscaping or preliminary plans shall explain
why mounding is not possible to the satisfaction of the Planning Director.
All parking lot trees shall be canopy trees. Palm trees shall be minimum 18 foot b.t.
height and minimum 23 feet to top of leaves.

The minimum shrub size shall be 5 gallons.
30% of trees in industrial and commercial projects shall be 24" box or greater.
Trees shall be dispersed throughout the parking lot at a ratio of one tree per three
parking stalls.
Any signs proposed for this development shall at a minimum be designed in
conformance with the City's Sign Ordinance and shall require review and approval of the Planning Director prior to installation of such signs.
Building identification and/or addresses shall be placed on all new and existing
buildings so as to be plainly visible from the street or access road; color of
identification and/or addresses shall contrast to their background color.
The project shall attempt to develop a ride to work and home program for its
employees with the North County Transit District. Furthermore, the project shall
attempt to limit the staggering of worker shifts so as to facilitate the success of said
program.
Prior to issuance of building pexmits, applicant shall record a deed restriction to the
satisfaction of the Planning Director, agreeing to maintain no fewer than ninety-
eight (98) parking stalls on the property to adequately serve the parking needs of
the property based upon the following parking ratios established by the City of
Carlsbad for the following uses:
office One stall per 250 square feet of gross floor area

one stall for each vehicle used in conjunction with the
use.
Warehouse One stall per 800 square feet of gross floor area plus one stall for each vehicle used in conjunction with the
use.
The uses of the property for either office, man6cturing or warehouse shall
maintain a pmportionate ratio of the gross square footage to ensure that the
requitednumberofparkingstallsperuseshallbepro~dedandthatthe~~
number of 98 parking stalls shall not be exceeded. If more than nkty-eight (98)
parking stalls are established on the property, the mix of uses may be altered as long as the parking requirements above are complied with.

33. The west, south and east building elevation exteriom shall be sandblasted concrete and blue glass as illustrated by the materials samples on file in the Planning
Department. The north exteIior elevation shall be concrete painted Frazee 5421-W
"overcast."
34. Prior to issuance of tenant improvements and/or business licenses for interior building space within this project (whichever comes first) the proportion of office,
manufacturing and warehouse uses for the building must conform to the approved
proportion of uses listed in Exhibits "A" - "E", so as to not increase parking demand
according to City codes unless more parking area is provided onsite to meet City codes.

Unless a standard variance has been issued, no variance from City Standards is
authorized by virtue of approval of this Site Plan.
The developer shall comply with all the rules, regulations and design requirements
of the respective sewer and water agencies regarding services to the project.
The developer shall be responsible for coordination with S.D.G.&E., Pacific
Telephone, and Cable TV authorities.
This project is approved specifically as 1 (single) phase.
Pretreatment of the sanitary sewer discharge from this project may be required. In
addition to the requirements for a sewer connection permit the developer shall
conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The
developer shall apply for an industrial waste water discharge permit concurrently
with the building permit for this project. No Certificates of Occupancy for the
project will be issued before the industrial waste discharge permit application
requirements have been met, all applicable fees paid and permit issued.
Prior to hauling dirt or construction materials to any proposed construction site
within this project the developer shall submit to and receive approval from the City
Engineer for the proposed haul route. The developer shall submit to and receive
approval from the City Engineer for the proposed haul route. The developer shall
comply with all conditions and requirements the City Engineer may impose with
regards to the hauling operation.
The developer shall exercise special care during the construction phase of this
project to prevent offsite siltation. Planting and erosion control shall be provided
in accordance with the Carlsbad Municipal Code and the City Engineer. Reference
Chapter 11.06.

Additional drainage easements and drainage structures shall be provided or installed
prior to the issuance of grading or building permit as may be required by the City
Engineer.
The structural section for the private driveway must be designed with a traffic index
of 5.0 in accordance with City standards due to a truck route through the parking
lot and/or aisles with an ADT greater than 500.
The Fire Marshal has determined that an onsite fire hydrant(s) (is/are) required to
serve this project. Prior to issuance of a building permit for the site, the applicant
must submit and receive City and water district approval for appropriate waterline
improvement plans and easements. All improvements shall be designed in
conformance with City and water district standards, plancheck and inspection fees
paid and improvement security shall be posted with the water district.
In order to comply with the City's Urban Pollutant requirements, the applicant shall
provide adequate means of eliminating grease and oils from drainage prior to
discharge. Plans for such improvements shall be approved by the City Engineer
prior to issuance of grading or building permits.

Prior to the issuance of building permits, complete building plans shall be submitted
to and approved by the Fire Department.
Additional public and/or onsite fire hydrants shall be provided if deemed necessary
by the Fire Marshal.
All required fire hydrants, water mains and appurtenances shall be operational prior
to combustible building materials being located on the project site.
All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers,
and other systems pertinent to the project shall be submitted to the Fire Department
for approval prior to construction.
All roof-top appurtenances shall be architecturally integrated into the design of the
building and shielding to prevent noise and visual impacts, subject to approval
before issuance of permit.
Building exceeding 10,000 square feet aggregate floor area shall be sprinklered.

Carlsbad MuniciDd Water District Conditions:
52. The entire potable and non-potable water systedsystems for subject project shall
be evaluated in detail to ensure that adequate capacity and pressure for domestic,
landscaping and fire flow demands are met.
53. The developefs engineer shall schedule a meeting with the District Engineer and the
City Fire Marshal and review the preliminary water system layout prior to
preparation of the water system improvement plans.
54. The developer will be responsible for all fees and deposits plus the major facility
charge which will be collected at time of issuance of building permit. The developer
shall pay a San Diego County Water Authority capacity charge which will be
collected at issuance of application for meter installation.
Utilities/Maintenance:
55. Backflow prevention assembly shall be as shown on Exhibit "F" attached hereto and
incorporated herein by reference.
