The City has completed a review of the application for a Planned Industrial Permit
for development located on Loker Avenue within the Carlsbad Oaks Business Park
(Lot 18 of Carlsbad Tract 74-21).
It is the Planning Director's determination that the project is consistent with the City's
Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable
City ordinances and policies. The Planning Director, therefore, recommends
APPROVAL of this request based on the following:
The site indicated by the Planned Industrial Permit is adequate in size and
shape to accommodate the proposed use, and all yards, spaces, walls, fences,
parking, loading, landscaping, and other features required by this chapter have
been provided.
The improvements indicated on the Planned Industrial Permit are located in
such a manner to be related to existing and proposed streets and highways.
The improvements as shown on the Planned Industrial Permit are consistent
with the intent and purpose of this zone and all adopted development, design,
and performance standards as set forth in this chapter.
Unless otherwise stated, this industrial project shall comply with all applicable
City Ordinances and requirements.
The uses, improvements, and architecture as shown on the Planned Industrial
Permit are consistent with the intent and purpose of the Planned Industrial
Zone and all adopted development design and performance standards as set
forth in the PM zone.
Environmental Review of this project was completed and resulted in the
issuance of a Negative Declaration on December 26, 1991.

Conditions:
Planning:
Approval is granted for PIP 91-2 as shown on Exhibits "A"-"I", dated August
11, 1992, on file in the Planning Department and incorporated herein by
reference. Development shall occur substantially as shown unless otherwise
noted in these conditions.
All uses established in this structure shall be consistent with Section 21.34.020
(Permitted Uses).
All roof appurtenances, including air conditioners, shall be shielded from view
and architecturally integrated with the building design to the satisfaction of
the Planning Director.
Unless otherwise stated, this industrial project shall comply with all applicable
City ordinances and requirements.
The developer shall provide the City with a reproducible 24" x 36", mylar copy
of the site plan as approved by the Planning Commission. The site plan shall
reflect the conditions of approval by the City. The plan copy shall be
submitted to the City Engineer and approved prior to building, grading, final
map, or improvement plan submittal, whichever occurs first.
This project is approved upon the express condition that building permits will
not be issued for development of the subject property unless the City Engineer
determines that sewer facilities are available at the time of application for such
sewer permits and will continue to be available until time of occupancy.
This project is also approved under the express condition that the applicant
pay the public facilities fee adopted by the City Council on July 28,1987 and
as amended from time to time, and any development fees established by the
City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or
other ordinance adopted to implement a growth management system or
facilities and improvement plan and to fulfill the subdivider's agreement to pay
the public facilities fee dated August 7, 1991, a copy of which is on file with
the City Clerk and is incorporated by this reference. If the fees are not paid
this application will not be consistent with the General Plan and approval for
this project will be void.
Water shall be provided to this project pursuant to the Water Service
agreement between the City of Carlsbad and the Carlsbad Municipal Water
District, dated May 25, 1983.

This project shall comply with all conditions and mitigation measures which
may be required as part of the Zone 5 Local Facilities Management Plan and
any amendments made to that Plan prior to the issuance of building permits.
If any condition for construction of any public improvements or facilities, or
the payment of any fees in lieu thereof, imposed by this approval or imposed
by law on this project are challenged this approval shall be suspended as
provided in Government Code Section 65913.5. If any such condition is
determined to be invalid this approval shall be invalid unless the City Council
determines that the project without the condition complies with all
requirements of law.
This approval shall become null and void if building permits are not issued for
this project within two years from the date of project approval.
Prior to the issuance of the building permit there shall be a Notice of
Restriction placed on the Deed to this property subject to the satisfaction of
the Planning Director notifying all interested parties and successors in interest
that the City of Carlsbad has issued a Planned Industrial Permit, dated August
11, 1992, on the real property owned by the declarant. Said Notice of
Restriction shall note the property description, location of the file containing
complete project details and all conditions of approval as well as any
conditions or restrictions specified for inclusion in the Notice of Restriction.
The restrictions referred to in said notice may be modified or terminated only
with the approval of the Planning Director, Planning Commission or City
Council of the City of Carlsbad whichever has final decision authority for this
project.
Trash receptacle areas shall be enclosed by a six-foot high masonry wall with
gates pursuant to City standards. Location of said receptacles shall be
approved by the Planning Director. Enclosure shall be of similar colors and/or
materials to the project to the satisfaction of the Planning Director.
No outdoor storage of material shall occur onsite unless required by the Fire
Chief. In such instance a storage plan will be submitted for approval by the
Fire Chief and the Planning Director.
The applicant shall prepare a detailed landscape and irrigation plan which
shall be submitted to and approved by the Planning Director prior to the
issuance of grading or building permits, whichever occurs first.
All parking lot trees shall be a minimum of 15 gallons in size.
All landscaped areas shall be maintained in a healthy and thriving condition,
free from weeds, trash, and debris.

18) All landscape plans shall be prepared to conform with the Landscape Manual
and submitted per the landscape plan check procedures on file in the Planning
Department.
19) Landscape plans shall be designed to minimize water use. Lawn and other
zone 1 plants (see Landscape Manual) shall be limited to areas of special
visual importance or high use. Mulches shall be used and irrigation equipment
and design shall promote water conservation.
20) Prior to final occupancy, a letter from a California licensed landscape architect
shall be submitted to the Planning Director certifying that all landscaping has
been installed as shown on the approved landscape plans.
21) The applicant shall pay a landscape plan check and inspection fee as required
by Section 20.08.050 of the Carlsbad Municipal Code.
22) The first set of landscape and irrigation plans submitted shall include building
plans, improvement plans and grading plans.
23) All landscape and irrigation plans shall show existing and proposed contours
and shall match the grading plans in terms of scale and location of
improvements.
24) The minimum shrub size shall be 5 gallons.
25) 30% of trees in industrial and commercial projects shall be 24" box or greater.
26) For the purpose of parking lot screening as well as partial screening of the 8'
high masonrywall and chamlmk fencing around the perimeter of the property,
a fast growing 3' high plant screen shall be added to the landscape plan and
installed adjacent to the tAmnlmk fence within the 10' planter area and
outside the 8' masonry wall within the 10' planter area. This plant screen shall
be required in addition to trailing vines planted in close enough proximity for
rapid fence coverage.

27) A 3' high parking lot plant screen located directly adjacent to the driveway
aisle, parallel with Loker Avenue shall be added to the landscape plan prior to
approval and installed adjacent to the driveway aisle.
28) Building identification and/or addresses shall be placed on all new and
existing buildings so as to be plainly visible from the street or access road;
color of identification and/or addresses shall contrast to their background
color.

The project shall attempt to develop a ride to work and home program for its
employees with the North County Transit District. Furthermore, the project
shall attempt to limit the staggering of worker shifts so as to facilitate the
success of said program.
Additional drain inlets which connect to stom drains shall be installed around
the building front exterior and shown on the final landscape plan.
Planters located along the north, south, and west perimeters shall be irrigated
with drip inigation.
Standard parking spaces shall be 8 feet in width and 20 feet in length with no
overhang permitted within the rear 10' setback. Wheel stops shall be installed
to avoid any overhang where necessary.
All building exteriors shall be sandblasted concrete with painted concrete
panels and blue tinted glass windows as illustrated on the colored exhibit
incorporated herein and on file in the Planning Department.
The proposed 8' high security gates shall be wrought iron painted to match the
building exterior.
Ennineerinq:
Unless a standards variance has been issued, no variance from City Standards
is authorized by virtue of this site plan.
The applicant shall comply with all the rules, regulations and design
requirements of the respective sewer and water agencies regarding services to
the project. '
The applicant shall be responsible for coordination with SDG&E, Pacific Bell
Telephone, and Cable TV authorities.
Pretreatment of the sanitary sewer discharge from this project may be
required. In addition to the requirements for a sewer connection permit the
applicant shall conform to the requirements of Chapter 13.16 of the Carlsbad
Municipal Code. The applicant shall apply for an industrial waste water
discharge permit concuii-ently with the building permit for this project.

40) Additional drainage easements may be required. Drainage structures shall be
provided or installed prior to the issuance of grading or building permit as
may be required by the City Engineer.
41) The applicant shall comply with the requirements of the National Pollutant
Discharge Elimination System (NPDES) permit. The applicant shall provide
best management practices to reduce surface pollutants to an acceptable level
prior to discharge to sensitive areas. Plans for such improvements shall be
approved by the City Engineer prior to issuance of grading or building permit,
whichever oc.curs first.
42) The structural section for the access aisles must be designed with a traffic
index not less than 5.0 in accordance with City Standards due to truck access
through the parking area and/or aisles.
43) The grades as shown on the Site Plan are specifically approved to have a
minimum grade of 0.70 percent.
- Fire:
44) Prior to the issuance of building permits, complete building plans shall be
submitted to and approved by the Fire Department.
45) Additional onsite public hydrants shall be installed in accordance with Exhibit
"B" approved by the Fire Department on July 29,1992.
46) Proposed security gate systems shall be provided with "Knox" key operated
override switch, as specified by the Fire Department.
47) Plans and/or specifications for fire alarm systems, fire hydrants, extinguishing
systems, automatic sprinklers, and other systems pertinent to the project shall
be submitted to the Fire Department for approval prior to construction.
Water:
48) The entire potable and non-potable water system/systems for subject project
shall be evaluated in detail to ensure that adequate capacity and pressure for
domestic, landscaping and fire flow demands are met.
49) The developer's engineer shall schedule a meeting with the District Engineer
and the City Fire Marshal and review the preliminary water system layout
prior to preparation of the water system improvement plans.
SO) The developer will be responsible for all fees and deposits plus the major
facility charge which will be collected at time of issuance of building permit.

The developer shall pay a San Diego County Water Authority capacity charge
which will be collected at issuance of application for meter installation.
51) 'This project is approved upon the express condition that building permits wiu
not be issued for development of the subject property unless the water district
serving the development determines that adequate water and service is
available at the time of application for water service and will continue to be
available until time of occupancy".
