No. 2; Planned Industrial Permit (PIP)PLANNED INDUSTRJAL PERMIT October 18, 1993 McRoskeys 6212 Corte del Abeto Carlsbad, CA 92009 The City has completed a review of the application for a Planned Industrial Permit for development located at 6211 Corte del Abeto. It is the Planning Directois determination that the project is consistent with the City's Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City ordinances and policies. The Planning Director, therefore, recommends APPROVAL of this request based on the following: The site indicated by the Planned Industrial Permit Js adequate in size and shape to accommodate the proposed use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required by this chapter. The improvements indicated on the Planned Industrial Permit located in such a manner to be related to existing and proposed streets and highways. The improvements as shown on the Planned Industrial Permit consistent with the intent and purpose of this zone and all adopted development, design, and performance standards as set forth in this chapter. The proposed project is compatible with the surrounding future land uses since surrounding properties are designated for Planned Industrial development on the General Plan. This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Planning Director on September 9,1993. In approving this Negative Declaration the Planning Director has considered the initial. study, all required mitigation measures and any written comments received regarding the signrficant effects this project could have on the environment. The applicant is by condition, required to pay any increase in public facility fee, or new construction tax, or development fees, and has agreed to abide by any additional requirements established by a Local Facilities Management Plan prepared pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will ensure continued availability of public facilities and will mitigate any cumulative impacts created by the project. 2075 Las Palmas Drive Carlsbad, California 92009-1 576 - (61 9) 438-1 161 @ h PIP 93-01 - REPUBLIC TOOL & MFG OCTOBER 18,1993 PAGE 2 7) This project is consistent with the City's Growth Management Ordinance as it has been conditioned to comply with any requirement approved as part of the Local Facilities Management Plan for Zone 5. Conditions: Approval is granted for PIP 93-01 as shown on Exhibits "A" - "J", dated October 9, 1993, on file in the Planning Department and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. All uses established in this structure shall be consistent with Section 21.34.020 (Permitted Uses). Unless otherwise stated, this industrial project shall comply with all applicable City ordinances and requirements. The developer shall provide the City with a reproducible 24" x 36", mylar copy of the site plan as approved by the Planning Director. The site plan shall reflect the conditions of approval by the City. The plan copy shall be submitted to the City Engineer and approved prior to building, grading, final map, or improvement plan submittal, whichever occurs first. This project is also approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on July 28,1987 (amended July 2, 1991) and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system of facilities and improvement plan and to fulfill the subdivideis agreement to pay the public facilities fee dated July 15, 1993, a copy of which is on file with the City Clerk and is incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this project will be void. The applicant shall provide school fees to mitigate conditions of overcrowding as part of building permit application. These fees shall be based on the fee schedule in effect at the time of building pennit application. This project shall comply with all conditions and mitigation measures which may be required as part of the Zone 5 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 65913.5. If any such condition is determined to be invalid this'approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. PIP 93-01 - REPUBLIC TOOL & MFG OCTOBER 18, 1993 PAGE 3 9) Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. The applicant shall pay park-in-lieu fees to the City, prior to issuance of building permit as required by Chapter 20.44 of the Carlsbad Municipal Code. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. Enclosure shall be designed to accommodate recycling bins AND be of similar colors and/or materials to the project to the satisfaction of the Planning Director. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties ,and streets, in substance as provided in Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building. An exterior lighting plan including parking areas shall be submitted for Planning Director approval prior to issuance of building permit AU lighting shall be designed to reflect downward and avoid any impacts on adjacent homes or property. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director. Landscaping shall be added along the slope adjacent to Palomar Airport Road so as to adequately screen the loading bays from public view. ,a, )%e applicant shall prepare a detailed landscape and irrigation plan which shall be ji submitted to and approved by the Planning Director prior to the approval of grading or ing plans, whichever occurs first. All parking lot trees shall be a minimum of 15 gallons in size. A master plan of the existing onsite trees shall be provided to the Planning Director as part of the final grading plan to determine which trees shall be required to be preserved prior to the issuance of a grading permit or a building pennit, whichever occurs first. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Existing onsite trees shall be retained wherever possible and shall be trimmed and/or topped. Dead, decaying or potentially dangerous trees shall be approved for removal at the discretion of the Planning Department during the review of a Master Plan to submitted 33) PIP 93-01 - REPUBLIC TOOL & MFG OCTOBER 18,1993 PAGE 4 fL' showing existing onsite trees. Those trees which are approved for removal shall be replaced on a tree-for-tree basis as required by the Planning Department. All landscape plans shall be prepared to conform with the Guidelines Manual and submitted per the landscape plan check procedures on file in the Planning Department. Planter width shall be a minimum of four (4) feet, not including curb, footings and/or other paving, and parking overhang. Prior to final occupancy, a letter from a California licensed landscape architect shall be submitted to the Planning Director certifying that all landscaping has been installed as shown on the approved landscape plans. All herbicides shall be applied by apppcators licensed by the State of California. The applicant shall pay a landscape plan check and inspection fee as required by Section 20.08.050 of the Carlsbad Municipal Code. All landscape and irrigation plans shall show existing and proposed contours and shall match the grading plans in terms of scale and location of improvements. The minimum shrub size shall be 5 gallons. 30% of trees in industrial and commercial projects shall be 24" box or greater. All outdoor eating areas shall be shown, in detail, on the landscape plans. Any signs proposed for this development shall at a minimum be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Planning Director prior to installation of such signs. A uniform sign program for this development shall be submitted to the Planning Director for his review and approval prior to occupancy of any building. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. Prior to the issuance of a Certificate of Occupancy there shall be a Notice of Restriction placed on the deed to this property subject to the satisfaction of the Planning Director notifying all interested parties and successors in interest that the City of Carlsbad has issued a Planned Industrial Permit 93-01 on the real property owned by the declarant. Said notice of restriction shall note the property description and location of the permit file, which contains obligations and restrictioIls imposed on the property. Said notice may be modified or terminated only with the approval of the Planning Director, Planning Commission or City Council of the City of Carlsbad whichever has final decision authority for this project. #- PIP 93-01 - REPUBLIC TOOL 81 MFG OCTOBER 18,1993 PAGE 5 35) Any uses of the building or property which creates a demand for more on-site parking spaces than provided shall not be permitted unless additional parking is provided and approved as amended to this PIP. 36) Except for the two table and bench sets located at the southern comer of the property, all outdoor employee eating areas shall be constructed so as to be permanent facilities. The set of tables and benches located at the southern comer of the property as shown in &%it "A" shall not be permanently fixed to the ground or surface so that they can easily be removed from the City sewer easement. 37) AU outdoor and indoor employee eating area facilities shall be installed concurrent with development and in place prior to final occupancy. Ennineering: Unless a standards variance has been issued, no variance from City Standards is authorized by virtue of approval of this site plan. The applicant shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. The applicant shall defend, indemnify and hold harmless the City and its agents, officers, and employees from any claim, action or proceeding against the City or its agents, officers, or employees to attack, set aside, void or null an approval of the City, the Planning Commission or City Engineer which has been brought against the City within the time period provided for by Section 66499.37 of the Subdivision Map Act. Prior to building permit issuance the applicant shall pay all current fees and deposits required. Pretreatment of the sanitary sewer discharge from this,project may be required. In addition to the requirements for a sewer connection permit the applicant shall conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The applicant shall apply for an industrial waste water discharge permit concurrently with the building permit for this project. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, the applicant shall submit to and receive approval from the City Engineer for the proposed haul route. The applicant shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. The developer shall exercise special care during the construction phase of this project to prevent offsite siltation. Planting and erosion control shall be provided in accordance with the Carlsbad Municipal Code and the City Engineer. Reference Chapter 11.06. Rain gutters must be provided to convey roof drainage to an approved drainage course or street to the satisfaction of the City Engineer.
